Court finds sex offender registry law unconstitutional
  • The high court barred local police departments and the state's Criminal Justice Data Center from releasing information on sex offenders to the public.
Information on convicted sex offenders is no longer available to the public in Hawaii after the state's Supreme Court struck down portions of its sex offender registration law as unconstitutional on Nov. 21. The court held that Hawaii's version of Megan's Law, which requires convicted sex offenders to register with local law enforcement agencies and requires those agencies to publish personal information about the offender, violates an offender's due process rights guaranteed by the state constitution. All county police departments and the Hawaii Criminal Data Justice Center promptly removed the sex offender registries from their Web sites and public access terminals with notification that, due to the court ruling, the sex offender registry is no longer available for public viewing. Prior to the ruling, the center made sex offender registries available by ZIP code and by street address. All sex offenders living in a particular ZIP code or on a particular street could be called up through the Web site or through public access terminals at the center. Now, only criminal histories on requested persons are given out since they are public records. There is a statutory $15 charge for each criminal history for any member of the public, including the media.

Highly publicized sex crimes committed by repeat offenders in recent years have prompted state legislatures to ratify laws that increase social controls on these offenders. State and federal laws have been enacted that require released sex offenders to register with law enforcement or other state agencies. Registration laws require offenders to supply their addresses and other identifying information to a state agency or law enforcement. These laws have been enacted in every state. In the United States, offender registration was first used in the 1930s. These early ordinances focused on repeat criminal offenders as well as sex offenders. They operated as a means to drive out persons who were undesirable (Lieb et al, 1998). Current registration statutes make sex offenders more visible to law enforcement and the public, with the intent of increasing public safety. The first of these current sex offender registration statutes was enacted in California in 1947. This document compares state registration statutes and identifies promising and comprehensive practices in use throughout the country.

RECENTLY CHANGES and innovations in public policies and sentencing structures have extended criminal sanctions beyond the immediate needs of offenders, victims, and society in general. One clear example of reaching beyond immediate needs and extending the form, length and consequences of sentencing is the use of community notification and registration of sex offenders. The present research identifies how such practices have created unintended and potentially serious collateral consequences for convicted sex offenders, with a special focus on female sex offenders. Research on sex offenders has historically focused, almost exclusively, on male offenders. Studies of female sex offenders are relatively rare, at least in part because most known sex offenders are male. Females comprise only 1.2 percent of arrests for rape and 8.0 percent of arrests for all other sex offenses (U.S. Department of Justice, 2002). Women who are sex offenders are most often convicted of offenses against children (Faller, 1987; Lewis and Stanley, 2000; Rosencrans, 1997; Vandiver and Walker, 2002) or low level felonies (other than rape); because of the latter, female sex offenders are often considered "less serious" sex offenders (Hetherton, 1999). In the criminological literature, attention to female sex offenders is rare, with the first articles appearing in the 1980s. Although recognized, female sex offending is not only often considered less serious than that of males (Hetherton, 1999), but is also acknowledged as possibly less likely to be detected or reported (Berliner and Barbieri, 1984; Johnson and Shrier, 1987).

  • Supreme Court to Hear Megan's Law Cases. On Wednesday, November 13, the Supreme Court will hear arguments in two cases determining the constitutionality of posting Megan's Law registries on line. In August, EPIC filed an amicus brief (PDF), urging the Court to hold that the Alaska Megan's law statute violates the Ex Post Facto clause of the Constitution because the mandatory online dissemination of a sex offender registry is excessive when weighed against the statutory purpose of protecting people in the geographic vicinity of released offenders. In tomorrow's consolidated hearing, the Court will also review the Second Circuit's determination that the Connecticut Megan's Law violates procedural due process. (Nov. 12)

If what we have presently is the answer, why do the police continue to say that they want a quicker response, that they want the registration to be this way or that way? The hon. member would know that in her province the police support the provincial registry. It is not something that only we are saying. It is being said across Canada. Abstract
One promising aspect of GIS mapping is its potential for addressing public safety concerns. GIS provides a quick method for establishing whether or not an offender residence is located in accordance with his or her state's laws. In an exploratory study, the registered addresses of convicted child sexual offenders are plotted and checked for violations of Illinois' prohibition against such perpetrators living within a 500 foot radius of schools and other designated areas. Any subjects within the forbidden perimeters will be highlighted, and the implications of such findings discussed. Chaiken Of these laws, the registries created to meet the objectives set by the Jacob Wetterling Act, when combined with the use of a GIS mapping program, potentially offers law enforcement officials a cost effective first line of defense that so far many have overlooked. An obvious and realistic concern of police is the issue of compliance to their individual state's registration parameters. Though granted some latitude within the federal guidelines established by the Wetterling Act, a majority of the states set proximity limitations for these offenders, restricting them from living or loitering within a predetermined distance from schools, parks, daycare facilities, etc. The laudable intent of this aspect of the law is to keep the offender from gaining easy access to possible victims. But the question arises: do a majority of police departments routinely check to see if offenders' addresses violate the boundaries put in place by their state? The answer to date is no.

Comments FWIW, in Missouri back when I was in practice, the criminal code had been revised so that minors having sex with other minors close in age could be charged only with lesser degrees of "sexual misconduct", and were not stigmatized with charges of "statuory rape". I don't know it it was intentional or not, but the way the relevant statute was written, there was a one year legal window: it was totally legal (i.e., there was no statute making this a criminal offense) for a 16 year old to have consensual sex with another 16 year old.     A four-time sex offender who readily acknowledges his crimes, Cary Verse does not ask for our sympathy. But his very existence is leaving a small community in Contra Costa County with no choice but to deal with child sexual assault. It may be that the most effective approach is grounded in compassion and an acknowledgement of the humanity of even the most egregious offenders. Verse has been searching for a home for more than two years a search that spanned the length of California yet turned up few willing to take a chance on him. Those who came forward to help were hounded by relatives and neighbors and withdrew their offers. Driven by community protests from transient hotels to shelters and from town to town for the past year, Verse will now appear before a judge on Friday to hear whether the community of Bay Point will allow him to rebuild his life there. Verse is recognized throughout California because of the publicity surrounding his case, but also because his name and photo appear on the state's sex offender registry Web site. Proponents of wide dissemination of information about sex offenders argue that registries are a powerful tool for parents to protect their children. But all too often, the registries become vehicles for the vicious ostracism and pointless torment of the men and women identified on them.

    Confidentiality Provisions for Registered Sex Offenders in California and Massachusetts
    Introduction
    In 1947, the state of California established America's first sex offender registry to help monitor the whereabouts of dangerous sex offenders living within its borders . In the 52 years since, the other forty-nine states have also passed legislation that requires released sex offenders to register with local law enforcement in the area in which they establish residence . Until 1996, the information contained in California's registry (and others) was available only to law enforcement agencies. The concern was that the public release of such information might violate the offender's right to privacy and to live without fear of discrimination. According to Dan Lungren, former Attorney General of the state of California , "Until now, sex offenders have been just about the most protected class of convicted criminals on the streets" Lungren and other supporters of publicly available registry information claim that by releasing that information, we better equip people to protect themselves and their children from sexual predators. The issue, like any that pits personal privacy against public safety, is far from simple. Sixty-two percent of states have chosen to err on the side of caution, including no provisions to protect the privacy rights of convicted sex offenders. In the 38% of states that do have such provisions, the degree of protection and the mechanisms used to ensure it vary greatly.
