MISSOURI SEX OFFENDER REGISTRY

The Revised Statutes of Missouri, Sections 589.400 to 589.425 and 43.650, RSMo., mandate that the Missouri State Highway Patrol shall maintain a sex offender database and a web site on the Internet that is accessible to the public. Additional information and verification may be obtained from the Chief Law Enforcement Official (Sheriff) of the county where the sex offender resides. The web site is intended to supplement and compliment the sex offender registries maintained by the various counties.
The information on the web site refers only to persons who have been convicted of, found guilty of or plead guilty to committing or attempting to commit sexual offenses and may not reflect the entire criminal history of a particular individual. Offenders required to register for crimes of kidnapping, felonious restraint or child abuse may not be listed on this web site.
The Sex Offender Registry was created in response to the Missouri Legislature's resolution to facilitate public access to available information about persons registered as sexual offenders. The Missouri State Highway Patrol, Criminal Records and Identification Division, has not considered or assessed the specific risk of re-offense with regard to any individual prior to his or her inclusion on this web site and has made no determination that any individual included on the web site is currently dangerous. Individuals included on the web site are included solely by virtue of their conviction record and Missouri state law. The primary purpose of providing this information is to make the information easily available and accessible, not to warn about any specific individual.

The trend in recent years has been to treat children as adults when they enter the criminal justice system, subjecting them to adult consequences on the theory that they deserve it for committing "adult crimes." That philosophy is tough on a kid who grows up and wants a fresh start in life. It's particularly tough when the kid may be branded as a sex offender for a good part of his adulthood. Shawn Murphy was 13 when he forced his 11-year-old cousin to have sex with him. Now that he's turned 18, his name has been posted on Iowa's sex offender registry website. "It causes a lot of problems and doesn't make much sense," said Gail Ryan of the National Adolescent Perpetrator Network's Kempe Children's Center. "With juveniles, we have pretty strong consensus in the field that we shouldn't be calling kids sex offenders when they're adolescents, when they're still forming their identities." Juvenile sex offenders particularly those who have been through a treatment program are unlikely to become recidivists, but being labeled a sex offender may become a self-fulfilling prophesy.

    Tuesday :: April 12, 2005 Sex Offender Registration and the Internet We get letters. This one is in response to one of the several posts TChris and I have written criticizing sex offender registries , particularly those posted on the Internet I read your article about sex offenders....I have to tell you i am on that list. In the state of Wisconsin I will be on it for the rest of my life. When I was 20 there was a girl that accused me of having sex with her. I will admit we messed around a bit but we never had sex. There was never any intecourse. When i plead guilty ( bad attorney) there was no sex offender registration. If there was, I would have taken my chances and probably won with a jury. But I guess thats besides the point now. Now I get evicted from apartment, people vandalize my truck and I can't get a job in my chosen profession. And it's all because I'm all over the Internet. I'm 33 years old now, I did my time...but after the fact the state added a life sentence. Thanks for listening. ill keep reading. Tom from Wisconsin

    Sarah Welchans University of California-Los Angeles This article presents a literature review of the empirical evaluations of sex offender registration and community notification policy, Law is provided. Literature searches presented 12 empirical evaluations focused on stakeholder, client-centered, goal-oriented, and process evaluations. Many sex offenders found some value DNA collection was used in reducing false accusations. Implementation of this policy varied both within states and between states. effectiveness. Suggestions for future evaluative research on this policy are given.

    Sex-offender registries raise legal red flags in workplace By JENNIFER ROBISON

    Sex-offender registries are designed to inform citizens of where felons convicted of sexual crimes live. However, such registries increasingly are a factor in the workplace as well. A nationwide spate of high-profile child kidnappings in recent months, coupled with California's well-publicized launch last winter of its massive 63,000-person registry, has boosted traffic on Internet sites that post rosters of convicted sex offenders. Numbers from the Nevada Department of Public Safety, which administers the state's year-old sex-offender registry at www.nvsexoffenders.gov, show 21,654 hits on the Web site in April. That tally is up from 7,729 hits in March and 7,523 in February. Now, unpleasantly surprised employers who stumble across workers listed on Internet registries are calling labor lawyers with questions about their rights, as well as those of their employees. "It's just starting to be an issue here," said Patrick Hicks, managing partner of the Las Vegas office of Littler Mendelson, a national labor law firm.

"Part-time" in this subdivision means for more than fourteen days in any twelve-month period.

    August 2, 2005 State lawmakers proposed a sweeping overhaul of Massachusetts sex offender laws yesterday, unveiling legislation that would dramatically increase the number of convicted offenders identified online, stiffen penalties for those who fail to register, and ratchet up the monitoring of those on parole. The bill, offered by Representative James E. Vallee and backed by several dozen lawmakers from both parties, would increase by four times the number of sex offenders whose names, photos, and addresses are posted online. The measure was proposed amid heightened public concern about sex offenders possibly committing new crimes. ''You can't open the newspaper on almost a daily basis without seeing that a child or a woman is being victimized, and often it's by a former sex offender," said Vallee, a Franklin Democrat and a former chairman of the state's Joint Committee on Criminal Justice. Flanked by relatives of several victims, Vallee outlined some of the 80 or so other provisions, some of which could end up part of a law that the Legislature votes on this fall.

Internet sex offender registries prompt high court to look into openness issues The U.S. Supreme Court in February agreed to hear arguments in a case concerning Alaska's sex offender registration program and determine whether the notification law violates the U.S. Constitution's prohibition on ex post facto laws when it is applied to those convicted of sex crimes before the new law was enacted. The case before the Supreme Court, Otte v. Doe , will consider the decision of the U.S. Court of Appeals in San Francisco (9th Cir.) that found that the Alaska law constituted an additional "punishment" because it allowed law enforcement agencies to post information about the offenders on the Internet. Although there is no direct First Amendment claim in the case, it indirectly touches upon important record access issues. The court found that the listings constitute an additional penalty even though most of the information is a matter of public record that could be found in court files of criminal convictions. The Alaska statute requires all convicted sex offenders to register with the state, be photographed, provide fingerprints and provide name, date of birth, address, place of employment and details about the conviction. The state publishes such information on its Web site, which allows searches of the database.
