var paraNum = 1; document.write(paraNum);paraNum += 1; Billions of securities are traded every day in public and private markets around the world. This practice is hundreds of years old and as long as securities have been traded, someone has tried to defraud the system to make a quick buck. With the advent of the Internet, new securities fraud schemes have appeared.
Fraud on the Internet: Recent Examples
document.write(paraNum);paraNum += 1; A number of recent Internet fraud cases dramatically demonstrate the extent to which this new medium creates potential for vast losses. The FBI’s Internet Fraud Complaint Center (IFCC), a joint project with the Department of Justice (DOJ), reports that most Internet fraud complaints stem from online auctions. The amount at issue in these claims, however, pales in comparison to the multi-million dollar hoaxes perpetrated in the financial markets. Internet fraud involving stock information is the second most common form of investment fraud, amounting to losses of over $10 billion a year. document.write(paraNum);paraNum += 1;

Securities Fraud Class Actions - Overview Main Practice

  • Since the passage of the Private Securities Litigation Reform Act of 1995 (the "PSLRA"), an average of 190 securities fraud cases have been filed each year. In 2004, however, this number increased to 212, a 12% increase over the previous year. Jones Day has a core group of 76 attorneys across the Firm who have substantial experience and success in litigating securities fraud cases against the plaintiffs' law firms that typically bring them. Securities fraud litigation poses particular risks and challenges, and experience in the management and strategic planning that accompany the successful defense of those cases is critical. Jones Day has successfully brought these skills to bear on behalf of companies and individuals in cases alleging, among other claims, violations of Sections 10(b) and 20A of the U.S. Securities Exchange Act of 1934 and Sections 11 and 12 of the U.S. Securities Act of 1933.
    Jones Day attorneys are also involved on behalf of many companies and individuals facing the risks of parallel securities fraud class actions, shareholder derivative claims, and government investigations, all arising from the same set of underlying facts. With our depth of experience across the Firm, Jones Day is able to provide an integrated and coordinated team approach to the defense of these cases, a defense focused on resolution through winning, not settling.

    (IDG) The Securities and Exchange Commission plans to develop a network application to scour public areas of the Internet to search for messages, unusual traffic patterns and other clues that may lead to the arrest of criminals engaged in online securities fraud. The SEC this month announced it would solicit proposals from vendors who could develop a system capable of scanning the Internet to gather data from the World Wide Web, Internet listservs and newsgroups. "Now more and more [securities fraud] cases are touching on the Internet," said John Reed Stark, chief of the SEC's Office of Internet Enforcement. MESSAGE BOARD Managing The Net The SEC each year brings charges in about 500 cases of securities fraud ranging from simple fraud to complicated schemes involving many people and corporations. Since 1995, charges have been brought in about 100 cases involving securities law violations via the Internet, Stark said.

  • Unsuitability - The broker must have reasonable grounds for believing each recommendation to a customer is suitable on the basis of the customer's other securities holdings, and financial situation, among other factors.
  • Churning - (excessive trading) - If a broker is buying and selling securities in your account to generate commissions that seem excessive, and the broker pressures you should take quick profits, there is a strong possibility that your account is being churned.
  • Unauthorized Trades - Brokers must have expressed and detailed permission of the customer unless the broker and the broker's firm have been granted written discretionary authority by the customer.
