Business Structure Additional Employer Responsibilities I-B-1. Federal Tax Information Any business with employees must have an Employer Identification Number (EIN) which identifies the tax accounts of employers, corporations, partnerships, limited liability companies with more than one owner, estates, trusts and other entities. Under federal guidelines, you also need an EIN if you have a qualified retirement plan, operate your business as a corporation or partnership, or file employment taxes, or excise taxes. You should have only one EIN. To obtain an EIN, call the Internal Revenue Service for Form SS-4 . Complete the form, and then either mail the form to the IRS, or call to receive your number. Business owners may also be required to file self employment taxes quarterly. Contact the IRS for its publications 533 and 509 on self-employment taxes. If the business does not have employees and does not expect to have any, the IRS may not allow the business to obtain an EIN. In such a case, the business owner's social security number is used as the Federal Tax Identification Number.

Individuals who earn wages by performing services in Montana are liable for Montana income tax. As an employer, it is your duty by law is to deduct the tax from the wages you pay. Every employer who resides in Montana and every non-resident employer who pays wages for services performed in Montana must withhold Montana income tax. This money belongs to the employee and is only held, in trust, by the employer until paid to the state. Withholding should not be used by the employer to operate the employer's business.

"APRIL IS the cruellest month," wrote T. S. Eliot in the opening lines of The Waste Land, but he was thinking in a poetic context — not, as many of us will do, in the terms of April 15, the due date for the 1040 forms which represent the final return for federal and state income taxes. The state income tax became effective seven years ago and its net receipts have become the second biggest state revenue source, exceeded only by the sales tax. Money from the income tax is almost equal to the total that the state receives from the federal government for high- ways, public assistance, education, etc. The peak months
April, May and June are the peak months for income tax receipts for the state. Last year the receipts that flowed into the treasury from the income tax during these three months were more than $500 million, or almost one-third of the total income tax receipts for the entire 1975 fiscal year. During the same three months, sales tax receipts totaled $367 million, and other general fund revenues (excluding federal aid), came to $229 million. The importance of the state income tax can be judged from one comparison: Last fiscal year, this tax brought in almost $1.6 billion, but the state spent almost $1.7 billion for elementary and secondary education and the state education agency.
