Who Must File?
Corporations and artificial entities that conduct business, or earn or receive income in Florida, including out-of-state corporations, must file a Florida corporate income tax return unless specifically exempted by law. The return must be filed, even if no tax is due. Sole proprietorships, individuals, estates of decedents, and testamentary trusts are specifically exempted and are not required to file a return. Corporations and other artificial entities, including those located in other states, that are partners in a partnership or members of a joint venture doing business in Florida must file Florida Form F-1120 Corporate Income/Franchise and Emergency Excise Tax Return ). History of the U.S. Tax System
The federal, state, and local tax systems in the United States have been marked by significant changes over the years in response to changing circumstances and changes in the role of government. The types of taxes collected, their relative proportions, and the magnitudes of the revenues collected are all far different than they were 50 or 100 years ago. Some of these changes are traceable to specific historical events, such as a war or the passage of the 16th Amendment to the Constitution that granted the Congress the power to levy a tax on personal income. Other changes were more gradual, responding to changes in society, in our economy, and in the roles and responsibilities that government has taken unto itself. Colonial Times For most of our nation's history, individual taxpayers rarely had any significant contact with Federal tax authorities as most of the Federal government's tax revenues were derived from excise taxes, tariffs, and customs duties. Before the Revolutionary War, the colonial government had only a limited need for revenue, while each of the colonies had greater responsibilities and thus greater revenue needs, which they met with different types of taxes. For example, the southern colonies primarily taxed imports and exports, the middle colonies at times imposed a property tax and a "head" or poll tax levied on each adult male, and the New England colonies raised revenue primarily through general real estate taxes, excises taxes, and taxes based on occupation.

While Congress considers slashing or even eliminating the federal estate tax, some revenue-hungry states are taking the opposite approach. Connecticut just approved a law that includes higher taxes on many large estates. Washington state enacted a new estate tax to replace one a court struck down this year. And the North Carolina Legislature took action to prevent the scheduled demise of its estate tax at midyear. These changes come on top of moves by numerous other states in recent years to protect their own lucrative estate and related taxes, which otherwise would have dried up because of a federal tax law change enacted in 2001. That law called for a total repeal of the federal estate tax in 2010, after a phase-out period and then a resurrection of the tax in 2011. The law included the phase-out of a federal estate-tax credit for state "death" taxes. Many states had tied their taxes to the amount of this credit, which disappeared entirely this year. As a result of the federal move, these states faced losing billions of dollars in revenue. Confronted by this threat, about one-third of the states have taken various actions to shore up their own estate-tax systems, including separating (or "decoupling") from the federal estate-tax system, says Bruno Graziano of CCH Inc. Among those who have gone their own way in one form or another are New York, Illinois, New Jersey, Massachusetts and Connecticut.

Fed/State Online Filing Fed/State On-Line (Home Filing) Program
Taxpayers will be able to transmit their 2004 federal and state income tax returns electronically in one transmission from their home computer. This method of filing is referred to as the Fed/State On-Line (home filing) Filing Program. Fed/State On-Line filing is available to taxpayers with the necessary computer hardware and use software that has been accepted by the IRS and the SC Department of Revenue specifically for the Fed/State On-Line (home filing) Filing Program.
You can pay your balance due by Electronic Funds Withdrawal (EFW). Funds are automatically withdrawn from your checking or savings account based on the payment date you select. EFW is a FREE service to taxpayers. However, you must pay your balance due in full by May 2, 2005 to avoid incurring penalties and interest. Selection of a date later than May 2, 2005 will result in penalties and interest being applied from April 15, 2005 until payment date. South Carolina participates in the State Only filing program that allows taxpayers to no longer be required to transmit both their federal and South Carolina returns simultaneously or to submit multiple state returns (example: may need to file both a North Carolina and South Carolina return) electronically. Please be advised that software developers may not offer the ability to file your federal and state returns separately. If the developer does offer the ability to file federal and state returns separately, you may be required to electronically file the federal return first before submitting a state return.
