West Virginia Boating Regulations and Laws
The West Virginia Boating Safety Education Card (also referred to as the West Virginia boating license) is proof that a boater has taken and passed an approved boater education course. The West Virginia Division of Natural Resources Law Enforcement Section currently has a mandatory boater education requirement that has been law since January 1, 2001 requiring all boaters born on or after December 31, 1986 to have the West Virginia boating license on board when the vessel is underway to satisfy the West Virginia boating regulations. Many boating fatalities occur because boaters aren't educated about boating safety. The West Virginia DNR Law Enforcement Section believes that an educated boater is a safer boater.

  • Courses are available throughout the state. You must register for a course by calling the contact number provided. Some courses are taught free of charge by volunteer instructors. Some courses are taught for a fee. The fees may vary from course to course. When registering, you should inquire about fees, hours, sessions, etc. Courses taught by the U.S. Coast Guard Auxiliary and U.S. Power Squadron are not listed here.

Before setting foot on a boat, follow these safety precautions:
  • Take a safety course. Local Coast Guards, power squadrons, yacht clubs and many related organizations offer courses in boating safety. A government-approved boating safety course will provide you with the mandatory Pleasure Craft Operator Card (PCOC) needed to operate a pleasure craft. Listen to the local weather forecast. Bad weather and high seas can be very hazardous, even for the experienced boater or sailor. Know the waters you are sailing. Inquire about conditions or hazards you should know before venturing out, including hazardous rocks and strong currents. Leave a float plan. Let someone know where you are going and when you are expected to return. Then, when you are back ashore, let your contact person know you have returned. Wear a personal flotation device (PFD). You are required by law to carry one PFD for each person on board. Ensure you have a paddle on board. If the wind dies or your boat breaks down, the paddle will help you return to shore. Take navigation tools, including a wristwatch and compass, as well as some regular tools including a knife, screwdriver, pliers, duct tape, line, a first aid kit and sunscreen.

Safety - General safety obligation
As the fundamental principle of the Transport Operations (Marine Safety) legislation, the general safety obligation transfers the responsibility of safety to owners and operators and encourages risk management. The Act imposes general safety obligations on:
Ship designers, builders and surveyors about the condition of ships.
Persons involved with the operation of a ship to operate it safely.
Owners and masters about safety equipment.
All owners and operators, masters and crew members must ensure the ship is:
Safe.
Properly equipped and crewed. Operated in a safe manner. In short, these general safety obligations prohibit a ship from going to sea if it is not properly built and maintained, equipped, crewed and operated in accordance with its proposed operating environment. The Act provides penalties for breach of safety obligations of up to $A37,000 or one year imprisonment. Should the breach cause death or grievous bodily harm to a person, the penalty is up to $A375,000 or imprisonment for two years. The Federal Communications Commission (FCC) requires a Ship Station License for some vessels equipped with VHF radios, RADAR, EPIRBs and some other telecommunications equipment. As of 1996, most recreational vessels no longer need the FCC license if operating domestically.
