An endorsement or testimonial (they’re treated identically) is defined as any advertising message that consumers are likely to believe reflects the personal opinions, beliefs, findings or experience of the person giving the endorsement or testimonial. As always in advertising law, consumer perception is legal reality. For example, if a TV commercial depicts two female actors discussing a detergent in a supermarket, one’s comment to the other about how well her brand works would be considered a fictional dramatization, not an endorsement, if the dramatization is obvious. The rule prohibits the undisclosed use of professional actors to simulate endorsements of ‘ordinary consumers.’ Or suppose that an on-screen actor touts a drug’s ability to deliver fast pain relief. If he reasonably appears to be speaking

NASCAR Transporters
by William Burt
Description: Once available only to NASCAR's top stars, the huge tractor-trailer rigs that transport equipment from race to race are today crucial to the daily businesses of every team. Veteran NASCAR reporter Bill Burt pounds the infields at NASCAR ovals to give fans a behind-the-scenes look at transporters used by the teams of favorite drivers.
This fascinating new book takes readers inside the mobile facilities that not only get the cars and tools from point A to point B, but also convert into high-tech offices and living quarters complete with the latest business and entertainment electronics, satellite dishes, bathrooms, kitchens, and sometimes even jacuzzis.
Color photography depicts the high-tech gadgetry and creature comforts now common to NASCAR transporters, each of which can cost anywhere from a quarter-million to several million dollars. Bill Burt is the author of MBI's Behind the Scenes of NASCAR and Stock Car Race Fan's Reference Guide. Softbound, 8-1/4" x 9", 96 pages, 90 color

  • Robby Gordon's Team Wins Drive-Thru Award
The No. 31 pit crew for Robby Gordon squeaked by Dale Earnhardt Jr.’s crew to capture the McDonald’s Drive-Thru Pit Championship fueled by POWERade in Sunday’s (March 14) 500-mile NASCAR NEXTEL Cup race at Atlanta Motor Speedway. While Gordon’s crew grabbed the $20,000 weekly prize, the pit crew for Tony Stewart moved into first place with 154 points. Kurt Busch’s crew stands second, one point behind at 153. Earnhardt’s crew, the reigning McDonald’s/POWERade champion, is third with 148 points. Though Earnhardt’s No. 8 Chevrolet found its way to winner’s circle in Atlanta, it was Gordon’s Cingular Wireless Chevy that spent the least amount of time on pit road. Gordon’s pit road time of 281.691 seconds was just over a second quicker than Earnhardt’s time of 282.864. Jeff Burton’s Ford was third at 284.833.(3-17-04)

The Bookworm Critique "DRIVE TO WIN:
    THE ESSENTIAL GUIDE
    TO RACE DRIVING"

by Carroll Smith ; Published by Carroll Smith Consulting, Inc by Mark Glendenning,
    Australia
Books that address the art of driving a racing car are nothing new. These kinds of publications are probably unique amongst the various genres of motorsport writing in that it is difficult to write a really good manual on racing unless you are in a position of some authority on the subject. Amongst those that have produced such works in the past are Ayrton Senna, Alain Prost, Emerson Fittipaldi, Niki Lauda, and Denis Jenkinson. Guys that know what they're talking about, in other words. What sets this offering by Carroll Smith apart from the others is the basic approach. Traditionally, racing manuals have been written from the driver's point of view. 'Drive to Win', though, looks at the role and requirements of the driver from a variety of perspectives, particularly those of the race engineer and team manager. For sure, concepts such as racing lines are dealt with to some extent, but for the most part they are not examined in any great depth. As Smith himself indicates, this particular territory has already been very thoroughly covered in the past. Actually, the author goes one step further than merely pointing out that a great deal of literature already exists on that aspect of racing, and provides the reader with a list of what he considers to be the best works on the subject (along with a recommendation that these books be read before embarking upon 'Drive to Win').

The Bookworm Critique "Juan Manuel Fangio:
    Motor Racing's Grand Master"
    By Karl Ludvigsen.
    Published by Haynes.
    by Mark Glendenning,
    Australia
Juan Manuel Fangio was arguably the greatest talent to slide in behind the steering wheel in the history of the sport. His race record is almost freakish - 200 starts netted the stocky Argentine driver 147 placed finishes, including 78 victories. Along the way, he collected no less than five world championships; a record that will probably never be surpassed. Fangio was also among motor racing's most effective ambassadors, as demonstrated by the fact that he remains a worldwide household name despite having retired more than forty years ago. Released last year, this book is the third in a series that previously explored the careers of Stirling Moss and Jackie Stewart. I have not yet had the opportunity to read the two earlier books, however having just finished this one I can safely say that this is a situation that I'll be making every effort to rectify as soon as possible. Driver biographies tend to vary in quality to a greater extent than any other category of motorsport books (except, perhaps, officially approved team biographies), but this one delivers the goods in fine style from beginning to end. The definition of the term 'biography' has become increasingly flexible over the years, and this book reflects the ways that these kinds of books are changing. It must be difficult to write about an individual like Fangio - his life and career have already been exhaustively documented, and coming up with new ways to explore such a driver would not be an easy task. In this case, the book is not an exhaustive account of Fangio's life, but it is clear from the outset that this is not really the author's intention.

    I Remember Dale Earnhardt
Dale Earnhardt was known as the Intimidator on the Nascar circuit. He truly was a living legend in the world of racing, but his life ended tragically in February 2001 when he was killed on the last lap of the Daytona 500. Dale Earnhardt's untimely death at age forty-nine shocked the racing world and the world at large.
Although in recent years Dale Earnhardt had relinquished his No. 1 spot among Winston Cup drivers to others, he was still considered the greatest threat to win every time he took the wheel. Indeed, his craggy, mustachioed countenance remained as familiar to millions as any other sight in the Nascar world, and his greatness seemed to grow every time he raced.
Nascar's Rookie of the Year in 1979, Dale Earnhardt forged a career that included seven Nascar national championships, seventy-six career wins (including his lone Daytona 500 victory in 1998), and over $34 million in prize money, which is more than any other driver has ever won. Dale Earnhardt was as tough as they come behind the wheel, also earning the name of "Old Ironhead" in part because of his reputation for never backing down on the track, where close calls and bumps at nearly 200 miles per hour are part of the sport's inherent risk.
In I Remember Dale Earnhardt, the Intimidator is remembered through hundreds of anecdotes, stories, and insights recounted by fellow drivers, team members, Nascar officials, and friends and associates. Together they offer a unique and touching reminiscence of one of the greatest and most charismatic racecar drivers ever to climb behind the wheel.

One of the events to fall victim of the infamous FISA-FOCA power struggle, the 1981 South African GP was officially not an F1 race. In fact, it was probably the last Formula Libre race ever. So technically, it wasn't even a non-championship F1 event since the cars present did not conform to the new-for-1981 F1 rules prohibiting the use of skirts. This decision generated serious problems in Johannesburg. The organizers had started promoting the race, printing and distributing posters with the original date, while event sponsor Nashua had also signed on for February 7. Furthermore, the South Africans claimed, the April date could lead to a meteorological debacle that would have been similar to the spectator mudwrestling match at the 2000 British GP. We should not forget that April is the Southern-hemisphere equivalent of October in the northern part of the world, meaning that weather conditions could well be less than favourable. On top of that, Kyalami Enterprises - the new company that managed the track - had signed a contract with FOCA for the specific date of February 7!
