Between:
The Government of Canada as represented by the Department of Fisheries and Oceans ("DFO" or "Canada")
And:
The Government of Prince Edward Island as represented by the Department of Fisheries, Aquaculture and Environment ("DFAE" or "Prince Edward Island")
(also referred to individually as "Party" and collectively as "Parties")
Whereas, the Constitution Act, 1867 assigns to Canada exclusive jurisdiction for sea coast and inland fisheries, and; whereas the Fisheries Act sets out the powers and duties of DFO with respect to the conservation and protection of fish habitat; Whereas, the Constitution Act, 1867 assigns to the provinces exclusive jurisdiction over matters dealing with property and civil rights, and the management of public lands, and matters of a local or private nature in the province and; whereas, based on these heads of power, the provinces may regulate certain aspects relating to fisheries and fish habitat such as conveyances, leases, and resource usage and protection; Whereas , DFAE manages "Provincially owned" lands, water and recreational fisheries in non-tidal waters through various legislation, policies and guidelines, and has established laws and policies that provide for the integration of fish habitat protection and conservation considerations and measures in its decision making processes;

The following History is the work of Duncan Campbell, and was printed in 1875 by Bremner Brothers, 44 Queen Street, in Charlottetown. Often I have been asked about the landlord-tenant question, and the negotiations leading up to Confederation, and, as this book was written shortly after these events, it contains excellent information on these subjects. I was fortunate enough to be able to obtain an original copy of the book through an Australian antiquarian book seller, and have transcribed it for you. I have maintained the original spellings used in the book, and have stayed as close to the original format as I could. PREFACE. It was necessary that a considerable portion of the work should deal with the Land Question. To its consideration the Author came in comparative ignorance of the entire subject, and therefore unprejudiced by ideas and associations of which it might be impossible for a native of the island entirely to divest himself. The soundness of the conclusions arrived at may be questioned but it can be truly said that they have not been reached without deliberate consideration, and an anxious desire to arrive at the truth. BACKGROUNDER
WIND POWER PROJECT IN PRINCE EDWARD ISLAND
Background The Government of Canada, the Government of Prince Edward Island and Maritime Electric Company, Limited (MECL) have signed agreements for the development of a market for wind power in Prince Edward Island. Under the agreement, the Government of Canada will spend $4.5 million over ten years to purchase 13 million kilowatt-hours of wind power annually. This investment will mean a yearly reduction of approximately 11,300 tonnes of greenhouse gas emissions from federal government facilities alone. With this agreement, the Government of Canada will be using wind to power about 75 percent of its electricity requirements on the Island. This agreement results from the announcement in Budget 2000 that the Government of Canada would procure $15 million of renewable energy over the next ten years in Saskatchewan and Prince Edward Island, following on a very successful pilot project undertaken in Alberta. The Government is buying sufficient green power from Enmax, the City of Calgary's electric system, to meet its requirements in Alberta. To date, these purchases have resulted in annual reductions of about 11,000 tonnes of greenhouse gas emissions. The success of the agreement subsequently led Enmax to launch Greenmax, an offering of wind energy to its residential and commercial customers. Alberta, Saskatchewan and Prince Edward Island, as well as Nova Scotia, have the most carbon-intensive electricity in Canada. An agreement between the Government of Canada and SaskPower, Saskatchewan's electricity supplier, was signed in October 2000.

PROVIDE GREEN POWER
NORTH CAPE, PEI Eight windmills generating an expected 16.6 million kilowatt hours per year of electrical power will be constructed next to the existing Atlantic Wind Test Site at North Cape. The project was officially launched today at a ceremony in North Cape. The windmills will be constructed by the province of P.E.I. through the P.E.I. Energy Corporation. "This initiative will help develop markets for renewable energy like wind power in Prince Edward Island and the rest of Canada," said Ralph Goodale, Minister of Natural Resources Canada. "Our investment in renewable electricity will help us meet a significant proportion of our energy requirements in a way that is environmentally friendly and consistent with our national action plan on climate change. We are pleased that our contribution is a driving force in the construction of the North Cape wind power facility." The ability to pursue the project was, in part, due to the Government of Canada's Budget 2000 commitment to purchase electricity from emerging renewable sources in Saskatchewan and Prince Edward Island. The Government of Canada and the provincial government have committed $4.5 million and $1.1 million over a 10-year period, respectively, toward the purchase of electricity generated by the windmills. P.E.I. Energy Corporation will build the windmills at an expected cost of $9.3 million.

PRINCE EDWARD ISLAND
PRINCE EDWARD ISLAND , a province of the Dominion of Canada, lies between 45 58 and 47 7 N. and 62 and 640 27 W. The underlying geological formation is Permian, though outliers of Triassic rock occur. The coal seams supposed to underlie the Permian formation are apparently too deep down to be of practical value. The rocks consist of soft red micaceous sandstone and shales, with interstratified but irregular beds of brownish-red conglomerates containing pebbles of white quartz and other rocks. There are also beds of hard dark-red sandstone with the shales. Bands of moderately hard reddish-brown conglomerate, the pebbles being of red shale and containing white calcite, are seen at many points; and then greenish-grey irregular patches occur in the red beds, due to the bleaching out of the red colors by the action of the organic matter of plants. Fossil plants are abundant at many places. Beds of peat, dunes of drifted sand, alluvial clays and mussel mud occur in and near the creeks and bays. Area and Population.The greatest length of the island is 145 m., its greatest breadth 34 m., its total area 2184 sq. m.

A Brief History
In 1904, the legislation was again amended and, at that time the sections relating to the assessment of qualifications were repealed and the self regulation powers of the council were established. The Council was now the body to determince qualifications for licensure and the regulation of the profession and government was no longer involved. Over time there were some minor changes to the legislation but in 1932 the entire act was modernized as well as incorporating the " Dental Association of PEI " and detailing more fully the by-laws. the regulatory body was still the Council but it was named a cou cil of the general membership. The legislation then changed very little until 1953 when it was altered to allow the licensing of dental hygienists and specialties of dentistry. In 1974 it was again opened and further regulations were added but there have been no further amendments to the present time.
Outside legislative changes, through amendments to the by-laws, dental assistants were granted intra-oral duties and the Council, being the regulatory body was seperated totally from the professional association in 1985. With a part-time Registrar and for the first time, non dental lay persons were given representation on the regulating body. This seperation allowed there to be a visible split between the protection of the public and service to the profession of dentistry on PEI.

OTTAWA - The Honourable Wayne Easter, Solicitor General of Canada, on behalf of the Honourable John McCallum, Minister of National Defence, today announced the Government of Canada's contribution of almost $265,000 to the Province of Prince Edward Island to enhance municipal and provincial emergency preparedness. Under the Joint Emergency Preparedness Program (JEPP), the Government of Canada's contribution will assist in further development of the province's emergency preparedness program and with the purchase of an all-terrain vehicle and search and rescue equipment. The province has also committed almost $183,000 for these projects. "The combined federal and provincial investment in the province's emergency preparedness program will go a long way in enhancing the province's overall response capacity," said the Solicitor General. "In 2000, a severe snowstorm hit the Maritimes for six days, causing flooding that washed out several bridges as winds gusted to 120 kilometres per hour. Municipalities require the right equipment to respond effectively to these types of emergencies, and for search and rescue operations."

For immediate release GOVERNMENT OF CANADA MAKES $722,000 FINAL PAYMENT FOR 1999 PRINCE EDWARD ISLAND FLOOD OTTAWA - The Honourable John McCallum, Minister of National Defence and Minister Responsible for Emergency Preparedness, today announced the Government of Canada's final payment under the Disaster Financial Assistance Arrangements (DFAA) to the Province of Prince Edward Island for flooding that occurred in September 1999. This payment brings the total Government of Canada contribution for this flood to over $1 million. An interim payment was provided to P.E.I. in June 2001.
"As Minister Responsible for Emergency Preparedness, I am pleased to provide P.E.I. with this funding to help offset the costs associated with damages caused in the aftermath of Hurricane Harvey," said Minister McCallum. "Emergencies like this are prime examples of how Canadians stand shoulder to shoulder to help each other deal with natural disasters. In this case, by providing financial support through the Government of Canada, we have helped repair damages and replace essential infrastructure." The severe flooding, which was the result of 200 millimetres of rain that fell in the area over a two day period, caused extensive damage to eight highways and two bridges in the West Prince area of P.E.I. Classified as a "one in one hundred year storm", P.E.I. experienced damages in excess of $1.4 million to provincial highway infrastructure, private property, small businesses, the fishing/farming sectors and municipalities.
