Before a plant or animal species can receive protection under the Endangered Species Act, it must first be placed on the Federal list of endangered and hreatened wildlife and plants. Our listing program follows a strict legal process to determine whether to list a species, depending on the degree of threat it faces. The Endangered Species Act
The Fish and Wildlife Service, in the Department of the Interior, and the National Marine Fisheries Service, in the Department of Commerce, share responsibility for administration of the Endangered Species Act. History of The Act Coastal California gnatcatcher

Congress passed the Endangered Species Preservation Act in 1966. This law allowed listing of only native animal species as endangered and provided limited means for the protection of species so listed. The Departments of Interior, Agriculture, and Defense were to seek to protect listed species, and insofar as consistent with their primary purposes, preserve the habitats of such species. Land acquisition for protection of endangered species was also authorized. The Endangered Species Conservation Act of 1969 was passed to provide additional protection to species in danger of "worldwide extinction". Import of such species was prohibited, as was their subsequent sale within the U.S. This Act called for an international ministerial meeting to adopt a convention on the conservation of endangered species.

When conducting surveys, considerations for the seasonal activity or occurrence must be taken into account as many Federal, candidate, and state listed plants must be in either flower or fruit stage for precise identification.

Many authorities believe the most far-reaching legislation protecting wildlife and habitat in the United States has been the federal Endangered Species Act of 1973. Though thirty years old, this legislation remains controversial. The Act provides for a number of activities to protect listed endangered and threatened species. The Act also provides for the protection of critical habitat and the creation of a recovery plan for each species listed. Since the Endangered Species Act was enacted, additional federal wildlife protection legislation has been passed. States have also enacted legislation to protect species and habitat.   • The U.S. Fish and Wildlife Service is required to devise a process for listing endangered or threatened species . An endangered species is one that is threatened with extinction throughout all or a significant portion of its range. A threatened species is one that is on the verge of being endangered. The agency is also required to list the status of the candidate species, a species that is likely to become threatened in the near future. Any person has the right to petition the Fish and Wildlife Service to list a species for the endangered or threatened list. The determination for listing is based on scientific evidence. A species must be listed in the Federal Register as endangered and threatened for the Act to apply. The Fish and Wildlife Service must develop and implement a recovery plan for listed endangered and threatened species. Recovery plans describe what is needed for a species to recover to the point that it no longer needs to be listed as endangered or threatened. In the United States, fewer than 60 percent of listed species have recovery plans. Species with recovery plans have a better chance of survival than those without.

A process and methodology has been developed to identify and designate these species, and to assign numerical ratings that reflect the degree to which they are at risk. The process is here described, and the designated species are listed in ranked order to reflect the relative degree of endangerment of each. A list of 10 species believed to be extirpated is appended. INTRODUCTION The state of Florida is blessed by a wealth of interesting plants, many of them subtropical and part of the Caribbean flora and thus found nowhere else in the United States, while others are endemic and thereby truly unique. But the state is also beset by an ever-growing human population that unceasingly intrudes upon and displaces these rare native species. The progressive loss of the habitat essential to these plants has stimulated both scientific investigation and legal and administrative efforts to remedy or at least to mitigate the loss of these valued components of the distinctive Florida biota.

Welcome to the Maine Department of Inland Fisheries and Wildlife Endangered Species Web Site. This site contains lists of the endangered and threatened fish and wildlife of Maine, provides information on each of the listed species, documents the Maine Endangered Species Act and how species become listed, explains Essential Habitat protection, and includes current Essential Habitat regulatory maps. Introduction The Maine Endangered Species Act was passed by the Maine Legislature in 1975 due to concern that various species of fish and wildlife were in danger of disappearing from the State. This act provides the foundation for Maine's Endangered Species Program. Authority to oversee implementation of the Act resides with the Commissioner of the Department of Inland Fisheries and Wildlife. Special Rule To Control the Trade of Threatened Beluga Sturgeon (Huso huso)
SUMMARY: We, the U.S. Fish and Wildlife Service (Service), are promulgating a special rule under Section 4(d) of the Endangered Species Act of 1973, as amended (Act), to exempt the import and export of and foreign and interstate commerce in certain products of beluga sturgeon (Huso huso) from threatened species permits normally required under 50 CFR 17.32. The beluga sturgeon's historical range includes 18 countries within the watersheds of the Caspian Sea, Black Sea, Sea of Azov, and the Adriatic Sea. The species is currently known to occur only in the Caspian and Black Seas and certain rivers connected to these basins. Of the 14 countries where the species still occurs, only 11 have significant beluga sturgeon habitat in the Caspian Sea, Black Sea or Danube River and consequently these countries take responsibility for cooperative management of the species (Azerbaijan, Bulgaria, Georgia, Islamic Republic of Iran, Kazakhstan, Romania, Russian Federation, Serbia and Montenegro, Turkey, Turkmenistan, and Ukraine; hereafter referred to as the ``littoral states''). Overharvest, severe habitat degradation, and other factors have led to the listing of beluga sturgeon as threatened throughout its range under the Act and in Appendix II of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES).
