Famous Cases Lemon v. Kurtzman, 403 U.S. 602 (1971) Mr. Chief Justice BURGER delivered the opinion of the Court. These two appeals raise questions as to Pennsylvania and Rhode Island statutes providing state aid to church-related elementary and secondary schools. Both statutes are challenged as violative of the Establishment and Free Exercise Clauses of the First Amendment and the Due Process Clause of the Fourteenth Amendment. Pennsylvania has adopted a statutory program that provides financial support to nonpublic elementary and secondary schools by way of reimbursement for the cost of teachers’ salaries, textbooks, and instructional materials in specified secular subjects. Rhode Island has adopted a statute under which the State pays directly to teachers in nonpublic elementary schools a supplement of 15% of their annual salary. Under each statute state aid has been given to church-related educational institutions. We hold that both statutes are unconstitutional. I The Rhode Island Statute In order to be eligible for the Rhode Island salary supplement, the recipient must teach in a nonpublic school at which the average per-pupil expenditure on secular education is less than the average in the State’s public schools during a specified period. Appellant State Commissioner of Education also requires eligible schools to submit financial data.

School buses manufactured or converted prior to September 14, 1996, must comply with the regulations in effect at the time they were manufactured or converted, except that Subchapter G (relating to operation standards for vehicles subject to this chapter) applies to vehicles subject to this chapter regardless of the date of manufacture or conversion. Vehicles manufactured as school buses and operating in interstate commerce are required to be in compliance with Federal Motor Carrier Safety Regulations as established by the Federal Highway Administration (FHWA) at 49 CFR Parts 393 and 396 (relating to parts and accessories necessary for safe operation; and inspection, repair and maintenance). Senior Education Fellow, US Freedom Foundation One of the main arguments against public funding of school choice is that it constitutes an establishment of religion in violation of the First Amendment of the U .S. Constitution. The argument continues despite the U.S. Supreme Court's ruling, in Zelman v. Kimmons-Harris on June 27, 2002 that such funding is not a constitutional violation. While the decision was 5-4, all five in the majority joined in the decision written by Chief Justice William H. Rehnquist, which means the ruling constitutes binding Court precedent. One point that came up is heard too often, too little noted, and shows that even a Supreme Court Justice can make a statement without the slightest proof. And it was not challenged. That occurred when Justice Sandra Day O'Connor noted that the Ohio law does not permit religious schools to even favor students of their faith. Justice David H. Souter said, "What difference does that make? If they are proselytizing, why wouldn't they want anyone who comes along?"

Child Lures Prevention Implemented Statewide CHICAGO—In an effort to protect children and prevent child abduction and exploitation in Illinois, Gov. Rod R. Blagojevich today launched the nationally recognized Child Lures Prevention Initiative, which teaches parents and children to recognize potential danger signs and make smart decisions to avoid child predators. The Child Lures Prevention Program, founded by renowned child personal safety expert Ken Wooden, will be introduced in 3,200 public elementary and middle schools statewide as a resource to help protect children against predatory crime. NBC5 in Chicago is partnering with Child Lures Prevention, Gov. Blagojevich, the Illinois State Police, the State Board of Education and the Illinois Principals Association to bring Child Lures Prevention to the children and families of Illinois. NBC 5 will broadcast a one-hour "Smart Choices, Safe Kids: A Child Lures Prevention Town Hall Meeting" on Saturday, September 17, at 6:00 p.m. The town hall meeting will also be broadcast by WMBD-TV/WYZZ-TV in Peoria, KWQC-TV in Davenport, WGEM-TV in Quincy, WPSD-TV in Paducah, WTVO-TV in Rockford, and WCIA-TV in Springfield.

A nonpartisan grassroots civics organization EDUCATION POSITION IN BRIEF Support equal access to quality public education, to be achieved by participation of government and citizens at all levels and by adequate financing based on an equitable and flexible tax system. BACKGROUND The original position was adopted in 1975, recognizing the interrelationship of LWVPA positions on education, equality of opportunity, and taxation. Since that time, language on school funding has reflected current positions on taxation and fiscal policy. The position was updated after a 1985-1986 review of teacher and other professional evaluations, preparation, certification, and tenure. In 2003, the position was further updated, emphasizing the need for both adequate state funding and a system that distributes these funds in a manner that diminishes the dependence of school districts on the resources of local taxpayers, thereby decreasing the unacceptable disparities in resources between rich and poor districts. As part of the 2003 update, the position was expanded to address implementation of the 1997 Charter School Law and the problems inherent in the system of state funding of local special education costs.
