The much debated Chapter 14 Special Education regulations, which include Early Intervention for children ages 3-5, were published in the PA Bulletin on June 9. Some of the recommendations offered by advocates, the Independent Regulatory Review Commission (IRRC) and the House Education Committee were incorporated, while others were not. Parents and advocates were very concerned about the complexity of incorporating the federal regulations by reference. The final-form regulations do this, adding information in those areas where the federal regulations require greater detail, when the Commonwealth's statutes or court decisions require specific language and when practices in Pennsylvania are different from those in other jurisdictions. The Department said they will develop documents and websites that link federal and state regulations in a "side-by-side" format upon final publication. The IRRC recommended that a definition of "student with a disability" be added for clarification, and this has been done. The IRRC's recommendation of clarifying the role of foster parents in obtaining special education or early intervention services has been followed. State and county approved foster parents will be able to act as parents for the purposes of Special Education. There was strong advocacy among all the stakeholders, the House Education Committee and the IRRC that current language requiring the IEP to be implemented within 10 days be restored. That change has been made. Class size restrictions, however, were not restored.

Jacobsburg Environmental Education Center
Jacobsburg offers environmental education programs from the preschool environmental awareness programs to high school level environmental problem solving programs, historical programs, teacher workshops and public interpretive programs. Once the site where the famous Henry Rifle was made, the Jacobsburg National Historic District lies almost entirely within the park. Henrys Woods offers very scenic hikes and the rest of the center grounds have multi-use trails. The center office is open 8 a.m. to 4 p.m., Monday through Friday. The center’s main parking area on Belfast Road is open from sunrise to sunset, seven days a week for your enjoyment. The original land for the center was purchased by the Department of Forests and Waters from the City of Easton in 1959. In 1969, additional land was purchased using funds from Project 70. This brought the total land area of the center to its present size of 1,168 acres.

Sitting astride South Mountain, Kings Gap offers a panaramic view of the Cumberland Valley. Sixteen miles of hiking trails interconnect three main areas and are open year-round. Regulation of Charitable Gift Annuities
This page updated on April 19, 2005. Degree of Regulation: Under Pennsylvania Statutes, Title 10, Sections 361-364, charitable gift annuities are exempt from insurance regulation. To qualify for the exemption, a charity must have been in operation for at least three years and have unrestricted assets of at least $100,000, plus one-half of the principal value of outstanding annuities. In addition, the organization must be a "qualified charity," which includes many categories.
Notification/Contact with State Regulators: Notification is not required.
Disclosure Language Required: Very detailed disclosure language is required.

The Individuals with Disabilities Education Improvement Act (IDEA 2004), 20 U.S.C.  1400 et seq., provides federal funds to assist state and local agencies in educating disabled children. IDEA 2004 conditions the receipt of such funds upon a state's compliance with certain goals and procedures. State legislatures and departments of education have enacted statutes and promulgated regulations respectively to ensure compliance with IDEA 2004 requirements. IDEA 2004 and its implementing regulations require schools to conduct functional behavioral assessments (FBAs) but provide little to no guideance on what an FBA is or how to conduct one. State laws and regulations are filling the gap. To learn about your state's FBA requirements, follow the links below and contact your State Department of Education directly.
