Regulations of the Pennsylvania State Board of Education
The Pennsylvania State Board of Education promulgates regulations through a regulatory process, which includes the publication of proposed rules in the Pennsylvania Bulletin. After comments and revision, the State Board gives approval to the regulations but the Independent Regulatory Review Commission, the House and Senate education committees, and the office of the Attorney General of Pennsylvania must still approve the regulations. When the regulations have been given final approval they are published in the Pennsylvania Code in volume 22. These regulations are binding on the Pennsylvania Department of Education and the school districts of the Commonwealth. See and
Each regulation is placed in the appropriate chapter of volume 22 and can be located by using a citation, which includes the section of the chapter in which the regulation is located. For example, regulations concerning students are placed in Chapter 12. The section of Chapter 12 dealing with "Corporal punishment" is § 12.5. A citation to the section of the State Board regulations dealing with corporal punishment is: 22 Pa. Code § 12.5 (i.e. volume 22 of the Pennsylvania Code; Section 12.5 of Chapter 12 of that volume). Note: These regulations are in addition to those found earlier in the Bulletin, which are applicable to all School of Education students.
The Department of Instruction and Learning offers four options in teacher education:
Option 1. The Professional Yearfor students seeking initial teacher certification but not a graduate degree.
Option 2. Additional Field Certificationfor students already possessing an Instructional I or Instructional II certificate who are seeking teacher certification in an additional specialty area, but who are not pursuing a graduate degree.
Option 3. Master of Arts in Teachingfor students seeking the Master of Arts in Teaching degree, which includes initial teacher certification.
Option 4. Certification Plus a Graduate Degreefor students seeking initial teacher certification along with a master's or doctoral degree.
Applicants seeking admission for teacher education study in the professional year or for additional field certification are subject to admissions requirements and regulations stipulated in this part of the Bulletin. Those seeking admission for a Master of Arts in Teaching degree, or certification along with a graduate degree, are subject to admissions requirements and regulations stipulated in the "Graduate Regulations" section of this Bulletin.

  • Preparation for Teacher Education Initial teacher certification is offered in the School of Education within the Department of Instruction and Learning. Admission is at the graduate level only. Regulations described in this part of the Bulletin apply to individuals seeking initial teacher certification only (i.e., certification alone, not coupled with a master's or doctoral degree).

    PHEA's cautionary words for those new to home education in Pennsylvania
    From Diana Baseman: The state of PA does not require permission. Here are the texts of the two statutes in PA. The first is the private tutoring provision, which may be used if a parent is also a PA certified teacher; followed by Act 169. Note that Section 1327.1is titled "Home Education Program." Private Tutoring Provision Of The Pennsylvania School Code Regular daily instruction in the English language, for the time herein required, by a properly qualified private tutor, shall be considered as complying with the provisions of this section. For the purposes of this section, "properly qualified private tutor" shall mean a person who is certified by the Commonwealth of Pennsylvania to teach in the public schools of Pennsylvania; who is teaching one or more children who are members of a single family; who provides the majority of the instruction to such child or children; and who is receiving a fee or other consideration for such instructional services. No person who would be disqualified from school employment by the provisions of subsection (E) of section 111 may be a private tutor, as provided for in this section. The private tutor must file a copy of his Pennsylvania certification and the required criminal history record with the student's district of residence superintendent.

    The biennial renewal of dental licenses in Pennsylvania will occur in March 2005. Are you prepared to document your compliance with the mandatory CPR certification and continuing education regulations?
    Here's What You Need:
    • Dentists, dental hygienists and dental assistants who are certified must supply evidence of current CPR certification in adult, infant and child CPR, and your certification card must indicate, "adult, infant and child CPR" or "Health Care Provider." Dentists will need to document proof of attendance of 30 hours of continuing education (between April 1, 2003, and March, 31, 2005). Dental hygienists must document 20 hours of CE, and expanded functions dental auxiliaries (EFDAs) require 10 hours.
    Continuing education subject topics that are accepted by the State Board include those areas that contribute directly to the maintenance of clinical competence, such as: diagnosis and treatment of oral pathosis; clinical and technological subjects; emergency procedures other than CPR certifications; infection control; neglect and abuse; medical and scientific subjects; laws and regulations pertaining to the practice of dentistry, dental hygiene and expanded functions dental auxiliaries. Credit is not acceptable for courses about billing, office management, practice building, insurance reimbursement, or communication skills.

Such programs do not come under federal or state special education due process procedures. Health: Safety: Transportation: Public Aid for Private Schools/Private School Students: The Pennsylvania Constitution prohibits any appropriation of money raised for the public schools to a sectarian school. Pennsylvania Const. Art. 3, Sec. 15. In addition, appropriations to educational institutions not under the absolute control of the Commonwealth, other than teacher training schools, are prohibited unless passed by two-thirds of all the members elected to each House. Pennsylvania Const. Art. 3, Sec. 30. Miscellaneous: Home Education Programs: The supervisor of the home education program shall maintain a portfolio of records and materials, including a log of time spent, title of reading materials and samples of writings, worksheets, workbooks or creative materials used or developed by the child and results of standardized tests in grades 3, 5, and 8 with an evaluation of the student's education progress by a licensed clinical or school psychologist or a certified teacher with two years experience or a nonpublic school teacher or administrator with two years experience in the last 10 and provide it to the superintendent annually by June 30 or as requested in writing.

    What we know as the Individuals with Disabilities Education Act (IDEA) was originally enacted by Congress on November 19, 1975, as Public Law (PL) 94-142. At that time it was called the Education for All Handicapped Children Act of 1975. Congress enacted this legislation in response to the outcomes of two Supreme Court decisions, as well as to factual information provided by testimony in Congressional hearings that was impossible to ignore. Because there was no mandatory special education law at the federal level prior to 1975, many students with disabilities were provided an inadequate education or none at all: many states allowed schools to exclude children with disabilities from their mandatory attendance laws. If special education was offered, generic special education classes were often provided, in which students with all varieties of disabilities were placed in one classroom, or were required to attend segregated programs. Often the only choice for deaf and hard of hearing students was a state school for the deaf.
