Abstract
This paper discusses that promoting parole and probation over incarceration is cost-effective and reduces taxpayer responsibility for funding prisons. The author points out that criminals who are offered parole or probation are placed into the care of outside agencies, which are often volunteer-based or privatized. The paper concludes that integration into the community places the focus of criminal justice issues back to the root causes of poverty, poor schooling, and other issues that jails simply do not address.

"Moreover, parole and probation are humanitarian approaches to criminal justice, which often serves only to dehumanize offenders. Parole and probation both address crime as a community-based social issue and encourages the partnership of law enforcement agencies, faith-based organizations, and social service providers. Because human beings are capable of change, parole and probation encourage a realistic, humane outlook on the part of law enforcement, the criminal justice system, and the population at large. The American Probation and Parole Organization's official position on probation is that human beings are capable of change; moreover, probation as a sentence offers due process of law for the offenders at the same time as it protects society and victims from harm."

    Q: What is a presentence investigation report and what is it used for?
    A: A presentence investigation report, often called a “probation report,” is a report prepared to help the judge decide what sentence to give someone who has either pled guilty to a crime or been found guilty of a crime. The report is prepared by a probation department, which should be a neutral agency, as it is independent from both the prosecution and the defense. The report will include sections on the defendant’s personal and employment history and prior criminal history, as well as details of the offense. While the probation officer interviews the defendant, he or she will often describe the details of the offense as set out in police reports received from the prosecutor. The report may also contain statements from victims. The report will often conclude with a sentencing recommendation. With the possible exception of the final sentencing recommendation, the report is given to the defendant before sentencing, so that the defendant can object if desired.

    Tribal Probation/Parole serves the people through the authority of the Tribal Council. Until July of 1996 the programs (adult probation, juvenile probation and community services) were components of the Tribal Court System. At that time, upon the request of the Chief Tribal Court Judge and the Chief Adult Probation Officer (Jacque Morigeau), Tribal Council gave approval for the Tribal Probation/Parole Department to separate from the court. Physical separation was effective August 1, 1996 and budget separation became effective October 1, 1996. Since that time there have been changes, programs have come and gone. The Department now consists of Adult Probation, Juvenile Probation, Youth Community Services and Administration.
    To provide a framework for adult and juvenile probationers in order for them to become productive citizens of the community. The Tribal Probation Department can provide rehabilitative measures by offering diversion opportunities, educational opportunities, educational opportunities, treatment opportunities, compliance incentives, job training opportunities, which will instill work habits, give the probationer a sense of self-worth, which will aid in maintaining the family unit, fulfill fine obligations, fulfill incarceration requirements, pay restitution, satisfy the probationers debt to society, and be released from Probation/Parole as successful.

  • What is the difference between probation and parole?

    Any juvenile or adult offender that is committed to a state institution such as the California Youth Authority or state prison will be released on parole. They will be supervised by state parole officials and the Probation Department will have no jurisdiction over their case with respect to supervision. Offenders that are placed on probation may be supervised by the Probation Department, or may be on conditional release/summay probation. With respect to conditional release/summary probation cases, individuals are on probation directly to the court and are not supervised by the probation office. All juvenile offenders that are placed on probation are supervised by the probation department.

    Improve Youth Offender Services Summary Texas has two state agencies devoted to delivering juvenile justice services. Texas should merge these functions into a single state agency. Doing so would remove obstacles to better service coordination, reduce administrative duplication and expand possibilities for increased federal funding. Background More than 100,000 youths are referred to 168 Texas county juvenile probation departments each year. For minor violations, police may warn the child and parents. More serious cases are forwarded to local juvenile probation officers. Some cases are resolved through counseling or by referrals to social service agencies; others involve some form of probation supervision in the community or a private residential treatment facility. In fiscal 2002, Texas spent an estimated $400 million from all funding sources on juvenile justice services through both TYC and TJPC. TJPC spent $118.7 million, about a third of the total; TYC spent the remaining $283.6 million. These amounts exclude the local support counties provide to their juvenile probation departments, which accounts for 70 percent of all probation funding.

The uniting of schools and probation departments has been successful in communities and counties across the United States, including Allentown, PA; Jefferson, IN; Norfolk, VA; and Fresno, Kern, Yuba, and Monterey Counties, CA. Educators and juvenile probation officers share a common goal: helping young people acquire knowledge and develop skills that lead to positive and productive lifestyles. As officials of the juvenile court, school-based probation officers provide control, supervision, and incentives that delinquent youth often need to attend school regularly and comply with school rules and regulations. School-based probation officers can also intervene in crisis situations involving juvenile probation clients and can assist schools in handling disruptive behavior by clients. Schools can contribute to probation objectives by providing student probationers with a structured environment for learning basic life skills and by designing an academic program tailored to the juvenile's individual needs.

    Back NORTH DAKOTA PAROLE AND PROBATION HISTORY By Sharon Bachmeier, Community Corrections Agent, ND Division of Field Services The concept of parole was first discussed in 1888 in a report generated by the ND State Penitentiary directed to the governor of the Dakota Territory. A few years later, the ND State Penitentiary initiated an early release program for short-time prisoners to the custody of an employer, typically a farmer. The local sheriff returned parole violators to the prison when the employer tired of them, usually after harvest. The ND Pardon Board assumed the duties of paroling authority in 1939. At that time, the Legislature authorized the Executive Branch to hire a staff of one person to manage parolees. Art Vandal was appointed Chief Parole Officer. Mr. Vandal was responsible for the development of the ND parole and probation laws, the supervision of parolees, and the duties of clerk to the ND Pardon Board. In 1963 the Legislature authorized a dual board system which allowed the ND Pardon Board to review requests for pardon and required the development of a separate Parole Board to review requests for parole. The two boards worked independently of each other.

    Section 170-G:16
    Juvenile probation and parole officers under the administration of the department of health and human services shall have the power and duty:
    I. To serve as officers of the court and investigate at the request of any justice of the district courts which they serve, any case, matter, or questions, and to report the results of such investigation with recommendations to the authority which ordered the investigation.
    II. To take charge of and provide supervision of juveniles, attempting to assist them in establishing law-abiding lives while monitoring their behavior through school, home, work, office, and other contacts to insure that they comply with court orders.
    III. To report promptly to the appropriate district court violations of court orders and conditions which are required by statute, the district court, or which, in the opinion of the officer, are serious enough to warrant consideration. Such reports shall include recommendations as to actions which the officer believes to be appropriate.
    IV. To arrest and take into custody any minor who is found violating any law, or who is reasonably believed to be a fugitive from justice, or whose circumstances are such as to endanger his person or welfare, unless immediate action is taken.
