The Citizens Commission on Human Rights (CCHR) applauds Governor Jeb Bush signing Senate Bill 1090 into law thereby creating safeguards for parents in Florida from being coerced to put their children on dangerous psychotropic drugs or from being psychologically evaluated. Parents' Rights
Family Involvement This is the Web version of a document developed by the California Department of Education in response to California law that specifies the legal rights of parents to participate in their children's education (Chapter 864, Statutes of 1998). In a democracy parents and guardians are encouraged and welcomed to become involved in the formal education of their children enrolled in public schools. This early and consistent parental involvement helps children to do well academically. When this involvement is combined with a partnership between home and school, the student, the school, and the community benefit. Parents and guardians of enrolled students have the right to be included in the educational process and to have access to the system on behalf of their children. These rights are outlined in Chapter 864, Statutes of 1998:

Understand Parents’ Rights Consider these common situations: Parents believe a teacher is picking on their child. Parents are unhappy with their child’s grades. Parents expect to talk with the teacher every day about their child's program. Parents have their own ideas about what and how teachers should teach. In any of these scenarios, parents can turn their concerns into a positive experience with their child's teacher, but they can also easily turn them into serious problems. To ensure positive experiences, parents and teachers should understand parents' rights and boundaries within the educational process. Parents have strong but limited rights to participate in their children's education. They have no right, however, to disrupt their child's school or monopolize a teacher's time.

Why should you, as a parent, go to the trouble of finding out what your rights are? Because failure to know or assert your rights becomes, in effect, a waiver [ of your rights as the parent of a learning disabled child. Of course, the public school system has rights too, and both school and parents have certain responsibilities, as defined by Public Law 94-142 and 101-476, Individuals with Disabilities Education Act (IDEA).
The parental rights which are outlined below are interpreted in different ways by different individuals. Also, laws frequently change. Therefore, you should be careful to determine that your position is correct before you assert a right.

What's Wrong With "Parental Rights"?
Spring 1996 A divisive campaign is snowballing around the country. It wrongly assumes that educators and parents are adversaries and books are the enemy. Watch for this campaign in your state; it's a camoflouge for censorship! ...Proponents of something called the "Parental Rights Amendment" are trying to amend all state constitutions and eventually the federal Constitution. The proposed amendment states: "The right of parents to direct the upbringing and education of their children shall not be infringed." ....What's wrong with this amendment? On first reading, it certainly sounds innocuous. As a parent, I want my rights...Why the fuss, then? The Religious Right insists that public school officials have some nefarious scheme for subverting "parental rights," primarily by choosing curriculum and other material that are at odds with their moral values. The bottom line of the Parental Rights Amendment is to give parents active in Religious Right groups a type of constitutional "trump card" to override any decision public schools make that they don't like. How would this work in practice? The Massachusetts legislature gave us one example two years ago when it considered a "parental rights" bill that required two weeks' written notice to parents whenever the children were to be involved in any teaching or activity deemed "controversial." These were not just the hot button topics of homosexuality and abortion, but everything from discussions of values to death and marriage. Worse, if parents did not affirmatively "opt in" every time actually filling out a form noting it would be all right for their children to be exposed to these topics their children were barred from participation.

I believe that teachers and parents must work together to educate our children. Several years ago, I passed a Parents' Bill of Rights and Responsibilities to make sure that parents can participate in decisions made concerning their children in our public schools. These rules, which have been modified several times since their original passage, are part of the Texas Education Code and as such, they must be observed by every Texas public school, including charter schools. Please note that parents have other rights that are not specifically in this list. Local school boards also have policies that may include additional rights and procedures, as long they do not conflict with those listed below. It is always best to bring concerns to the attention of local administrators and school board members before enlisting help from the state. If you have a problem with your school, talk the the principal or the person the principal designates. If you cannot resolve the situation at the school, contact the district superintendant's office. Ask how you can bring this issue to the attention of the district administration. If you still are unable to resolve the issue, your school board members are the local officials responsible for setting policy for the district. Your problem should be brought to your board member's attention. If all attempts to resolve the problem fail, and you believe that either the Parents' Bill of Rights or another education law is being violated, you can contact the

Almost 96% of children attend free co-educational, non-selective and comprehensive state schools managed by Scottish Local Authorities. Around 4% of children attend fee-paying schools. To improve the quality of education provided, some authorities promote particular initiatives such as special arrangements for children to complete homework, and summer schools where senior pupils work with mentors to help encourage them to undertake further education. The Government is allocating significant resources to ensure that study support (including homework clubs and a wide range of school clubs) is in place in all secondary schools and as many primary schools as possible by 2001. Education authorities also promote good practice across schools in important aspects of learning and teaching, for example managing difficult behaviour, promoting positive discipline and anti-bullying measures.

Family Educational Rights and Privacy Act (FERPA)
FERPA gives parents certain rights with respect to their children's education records. These rights transfer to the student when he or she reaches the age of 18 or attends a school beyond the high school level. Students to whom the rights have transferred are "eligible students."
  • Parents or eligible students have the right to inspect and review the student's education records maintained by the school. Schools are not required to provide copies of records unless, for reasons such as great distance, it is impossible for parents or eligible students to review the records.     An educational voucher is a check/certificate for tuition made out in the name of a child and sent to the parents who can then take it to the school - public, private or parochial - of their choice.
  • Who are the chief supporters of educational vouchers?
    Parents who use private schools are the chief supporters of educational vouchers. However, those who recognize the injustice and the failure of the present public (government) school system are also supportive of parents' right to choose schools. In addition, support comes from taxpayers who see that non-government schools can educate better for less than half the cost of government schools and realize that opening the educational system to competition will reduce costs and bring down taxes. Finally, parents who also want a moral/religious education for their children are very supportive.
