Dr. Henry M. Fassler has successfully contested a 1998 Massachusetts law that requires a non-custodial parent to have court certification as a non-batterer on a yearly basis before he (or she) is allowed access to their children's school records. The school system currently views all
non-custodial parents as guilty of battery until proven innocent. But all that is going to change. The specifics of Fassler's case : he wanted to see the academic class list for his 17-year-old daughter Lindsay, who had asked him for help. No charge or complaint had ever been filed against Fassler; he is on good terms with his ex-wife and children. When the school refused the class list, Fassler not only got angry, he also got active. Last October, he complained to the Family Policy Compliance Office at the U.S. Department of Education, challenging the statute as discriminatory. On May 6, the DOE sent a letter to

The first week of school in August all students get a reprieve from the swat. Beginning with the second week, misbehavior marks begin counting. By the middle of the second week, Susan accumulated four marks and got the swat. On Thursday, she got another four marks, again requiring the swat. Her great-grandmother was called, told what was going on, and invited to witness the swat.
After the swat, principal Troy Bond, the teacher, Susan and her great-grandmother all prayed, and Susan hugged her teacher.

PARENT NOTICES Under No Child Left Behind (NCLB)Act of 2001, parents of students attending Title I schools are required to be notified of certain provisions and standings of schools, teachers, and opportunities to participate. The following descriptions are intended to meet these requirements. Highly Qualified Teachers Under NCLB all teachers must be "highly qualified" for the subjects they teach by the June 30, 2006. This requirement specifies that teachers must be certified by the State of Michigan for the subjects they teach, and must have the equivalent of 30 semester hours of college coursework in the subjects. Parents have the right to check on the certification status of any of their child's teachers. This can be done by logging into the State web site at http://meis.mde.state.mi.us/teachercert/sr_teaCerts.asp , and entering the teacher's last and first name. Clicking on their certificate number provides all relevant information. Parents may also contact the building principal to request the information. Teachers of students in Title I schools, (all Coldwater elementary schools and Legg Middle School), are required to identify teachers of core academic subjects who are not highly qualified and notify parents of the fact beginning in the 2002 school year.

We would like to make changes in local and national legislation regarding the needs and rights of our schoolchildren who have Diabetes. Many parents do not know where to turn for answers about the care and the rights of their diabetic child while attending school. The purpose of this web site is to inform and educate these parents. We want to share with you what we have done, and are doing now, to try to end the risk of your child not being allowed to care for themselves properly during the day. Randolph In modern societies, as a practical matter, the state has the power to legislate on a wide variety of concerns. It is a separate question whether the state has the right to do so. One of the most controversial issues facing American society today concerns the right of parents to determine the way in which their children shall be educated. On the one hand, many parents believe that they have a fundamental right to educate their children in any manner they see fit. On the other hand, many people in positions of power wish to limit this parental right by regulating the choices parents may make regarding the education of their children. Some of these critics of parental choice seek to limit their choices to a range of government-approved and government-regulated schools, whether government-funded or not. Others seek to limit these choices to government-funded schools, often called public schools. Either of these types of restrictions would effectively forbid parents to educate their own children in their own home according to their own beliefs and values. The basic question that must be asked (even though unwelcome to the advocates of omnipotent government) is whether any such restrictions on the right of parents to determine the setting and content of the education of their children is morally within the bounds of legitimate governmental action.

Parents' Rights and Responsibilities. 1984 Digest, Revised.
Public Law 94-142 clearly defined the rights of handicapped children and their parents. A fundamental provision of the law is your right to be in the educational decision-making process, including your right to: A free appropriate public education for your child. Free means at no cost to you as parents. Appropriate means meeting the unique educational needs of your child. Be notified whenever the school wishes to evaluate your child or to change your child's educational placement, or refuses your request for an evaluation or for a change in placement. Initiate an evaluation if you think your child is in need of special education or related services. Informed consent. Informed consent means you understand and agree in writing to the evaluation and educational program decisions for your child. Your consent is voluntary and may be withdrawn at any time. Obtain an independent evaluation if you disagree with the outcome of the school's evaluation.
