The Committee on Pardons receives applications for pardons concerning sentences handed down by the Federal Criminal Court or a federal administrative authority, as well as for military criminal cases taken to the Federal Court. After passing applications for pardon to the Federal Council for their comments and proposals, the Committee on Pardons makes a preliminary examination of the files and communicates its proposal to parliament for their decision.
The Committee on Pardons is also mandated to fulfil the tasks of the Rehabilitation Committee.

  • (a) General Rule.

(a) General Rule. For the purpose of attacking the credibility of a witness, evidence that he has been convicted of a crime shall be admitted if elicited from him or established by public record during cross-examination but only if the crime (1) was punishable by death or imprisonment in excess of one year under the law under which he was convicted, and the court determines that the probative value of admitting this evidence outweighs its prejudicial effect on a party or (2) involved dishonesty or false statement, regardless of the punishment.
(b) Time Limit. Evidence of a conviction under this rule is not admissible if a period of more than ten years has elapsed since the date of the conviction or of the release of the witness from the confinement imposed for that conviction, whichever is the later date, unless the court determines, in the interests of justice, that the probative value of the conviction supported by the specific facts and circumstances substantially outweighs its prejudicial effect. However, evidence of a conviction more than ten years old as calculated herein is not admissible unless the proponent gives to the adverse party sufficient advance written notice of intent to use such evidence to provide the adverse party with a fair opportunity to contest the use of such evidence.

A visitor to Canada faces possible deportation upon conviction for impaired driving, drive over 80 mgs., or refuse breath sample. A person who has committed a comparable offence abroad could be denied entry to Canada. Visitor includes anyone lawfully in Canada as a tourist, or on a work or student visa. It also includes a person who has approval in principle for landing on humanitarian and compassionate grounds.
Inadmissible to Canada
A person seeking to come to Canada as a landed immigrant or as a visitor is likely inadmissible if he or she has been found guilty abroad of a drinking and driving offence.
Permission to enter Canada
A person found guilty of drinking and driving can apply for a temporary resident permit. Issued at the discretion of immigration authorities, the permit is valid up to three years. It can authorize single or multiple entries. The fee is $200 Cdn. Once five years have passed from the completion of any sentence imposed for the offence, including any driving suspension, a person with a drinking and driving conviction may overcome inadmissibility upon receiving approval of rehabilitation from an authorized immigration official.

    2. CRIMINAL REFUSALS
    2.1 INTRODUCTION
    An application for permanent residence made by a member of the family class can be refused if the member of the family class or a dependant, is "criminally" inadmissible to Canada. Sponsorship refusals based on criminal inadmissibility are not considered on a regular basis by the Appeal Division. This chapter will only provide an outline of the issue of criminal inadmissibility. For a detailed analysis, reference should be made to chapters 7 and 8 of the paper entitled Removal Order Appeals (Legal Services, Immigration and Refugee Board, February 1, 2002. The applicable provisions are found in section 19 of the Immigration Act. The most common basis for criminal inadmissibility is the visa officer's conclusion that the applicant is a person described in section 19(1)(c), (c.1), (c.2); 19(1)(d); 19(2)(a), (a.1); or 19(2)(b). All of these provisions connect the applicant to offences found in an Act of Parliament. In addition, there are other provisions which have significant criminal elements. These are sections 19(1)(e); 19(1)(f); 19(1)(g); 19(1)(j); 19(1)(k); and 19(1)(l).     8. CRIMINAL EQUIVALENCY
    8.1 INTRODUCTION
    There are several areas in the Immigration Act (the "Act") where the issue of equivalency of foreign criminal convictions to Canadian offences arises. If a person is found described in one of the equivalency provisions that render him or her inadmissible to Canada or removable from Canada, a removal order may be issued against that person. As indicated earlier, certain persons (notably, permanent residents) will then have a right of appeal to the Appeal Division from the removal order on both grounds of appeal, that is, that the removal order is not legally valid and that the discretionary jurisdiction of the Appeal Division should be exercised in the appellant's favour. Paragraphs 27(1)(a.1) and (a.3) are the criminal equivalency provisions for the removal of permanent residents and paragraph 27(2)(a) deals with non-permanent residents inside Canada, while paragraphs 19(1)(c.1) and 19(2)(a.1) and (b) deal with the criminally inadmissible classes at the port of entry and in other contexts. This Chapter also canvasses the related provisions dealing with organized crime-paragraphs 19(1)(c.2) and 19(1)(d)-and war crimes and crimes against humanity-paragraph 19(1)(j).

    In an incredible true story, a 19 year-old New York University undergraduate student was recently arrested and charged with committing three felonies, including criminal sale and possession of a controlled substance, and criminal sale of a controlled substance on or near school grounds — each charge carrying a maximum sentence of 25 years in prison. The undergraduate student sold high-grade marijuana, cocaine and hallucinogenic mushrooms to an undercover New York City police officer on eight separate occasions from the lobby of her dormitory. But that's not the incredible part. Despite facing up to 75 years in prison for her offenses, the student, a white female from a wealthy family, will actually never see a prison cell if she satisfies the gracious terms of the deferred prosecution agreement brokered between a Manhattan District Attorney and the defendant's private attorney. The sweetheart deal — brace yourself for this one — includes 10 months at a drug rehabilitation center in Idaho followed by 8 months of work or school, and 5 years probation. Moreover, she will be permitted to plead guilty to lesser charges (perhaps misdemeanors) in 2006, pending successful completion of her "sentence." Perhaps most importantly, her case was handled by state, rather than federal, authorities, allowing her to avoid severe federal mandatory minimum laws that would have likely resulted in a lengthy prison sentence.

    The Constitution itself offered no guidance on how the President's pardon power was to be administered. Pardons were issued from the time of President Washington , but routine responsibility for supervising their issuance was not vested in any particular officer of the government, apart from the President. In 1865, however, as the Civil War came to a close, the office of Pardon Clerk was set up; its functions were tranferred to the office of the Attorney in Charge of Pardons in 1893, which eventually became the U.S. Department of Justice's Office of the Pardon Attorney . The present Pardon Attorney is Roger Adams , appointed to that post in 1998. Working with him in 1999 were approximately 14 junior attorneys, paralegals and support staff. Regulations General regulations regarding the submission, consideration and award of pardons are set down in Title 28 of the U.S. Code of Federal Regulations , Sections 1.1-1.10. The regulations suggest a five-year waiting period (after conviction or the end of incarceration) before a person becomes eligible to apply for a pardon, set out the forms and information that should be submitted by persons seeking pardon, allow for FBI investigation of the petitioner before a pardon is recommended, and give the Pardon Attorney jurisdiction to review the completed pardon application and recommend action to the President. The President retains the right to grant or deny the pardon request. If the President does not act on a recommended denial of pardon within 30 days, his concurrence with the denial recommendation is assumed. All petitioners are notified in writing of recommendations on their cases.

    I do not intend to speak to the merits of any particular clemency cases decided by President Clinton in his final weeks in office, nor will I speculate about the way in which particular decisions were reached. Rather, I will comment generally on the way President Clinton's pardoning practices differed from the practices of his predecessors, and offer some suggestions about how the administration of the President's pardon power can in the future be reformed so that it can once again play the role envisioned for it by the Framers of the Constitution. Historical Background The Attorney General has been responsible for advising the President on all applications for executive clemency since the middle of the 19 th century. The Attorney General's central role in administering the constitutional pardon power reflects and reinforces the link that has historically existed between clemency and the day-to-day operation of the federal criminal justice system. Until quite recently, pardon could be counted on to assure a fair result in individual cases, to signal the President's law enforcement priorities, and to underscore the value of rehabilitation as a goal of the justice system. In 1898 the first clemency rules promulgated by President McKinley directed all applicants for executive clemency to submit their petitions to the Attorney General, and specified how such applications would be processed within the Justice Department. Over the next hundred years these clemency regulations would be reissued on several occasions, but they remained remarkably similar in each new iteration, providing perhaps our most venerable and consistent framework for governmental decision-making.
