ACTION: Proposed Rule
SUMMARY (abstract) [Eckert, Frasca, Lane, DuPaul ]: The Departments of Agriculture, Defense and Interior, and their respective land management agencies, propose this rule to allow foot-launching, landing and over-flight of powerless devices weighing less than 155 pounds designed for human recreational flight on all national parks, forests and other public lands and waters. These powerless flight devices are classified as unpowered flight vehicles under FAA FAR part 103. They are traditionally and more commonly known as hang gliders and paragliders. In an effort to provide greater management uniformity and efficiency in the federal land management system, this rule adopts the most practical and successful administrative approaches which have evolved over the last two decades under existing policies or special use rules applicable to recreational powerless foot-launch flight. Accordingly, this rule applies only to unpowered foot-launch flight devices weighing less than 155 pounds that are capable of being carried on foot to and from launch and landing areas, and used as a means for participants to experience flight

WAC 352-32-130 Aircraft. (1) No aircraft shall land on or take off from any body of water or land area in a state park area not specifically designated for landing aircraft. This provision does not apply to official aircraft used in the performance of search and rescue missions, medical emergencies, law enforcement activities, emergency evacuations or fire fighting activities. It also does not apply in cases where the director or designee specifically authorizes such landings or take offs, in writing, associated with the operational, or administrative needs of the agency or state.
     (2) Individuals who have complied with the registration process provided or who have obtained a special recreation event permit pursuant to WAC may launch and land paragliders in state park areas specifically designated by the director or designee as available for paragliding. Prior to any such designation, the director or designee shall advertise and conduct a public meeting in the region where the park is located. The director or designee shall consider the potential impacts of paragliding in the proposed area, including but not limited to the following factors: The degree of conflict paragliding may have with other park uses, public safety issues, and any potential damage to park resources/facilities. Any park designated for paragliding shall be conspicuously posted as such by the agency.
     (3) Individuals paragliding in state parks must:
     (a) Comply with the registration process provided for such purposes;

Visitors come from all over Washington to take advantage of the consistent updrafts that are prevalent along the northern slope. Rockhounders regularly come from as far away as British Columbia and the Oregon coast as well as other parts of the U.S. to converge on the Saddle Mountains in search of petrified wood that is abundant at several locations on the mountains. Lay of the Land Elevations within the Saddle Mountains Management Area range from a low of 486 feet at the Columbia River on the recreation area's west side, to approximately 2,700 feet at Wahatis Peak on the eastern side. The main plateau consists of a rather sharp ridge rising about 1,600 feet higher than the surrounding plain. These mountains were subject to considerable faulting in the geologic past. Southern slopes are gentle in comparison to the precipitously bold relief of the north facing cliffs.

The Columbia River, its headwaters flowing from Columbia Lake, between the Rocky Mountain Range to the east and the Purcell Mountains to the west, has served as a transportation route for human, beast and plant for thousands of years. 5. RECREATION
GENERAL
5.1 The relevant bodies are required to take such steps as are reasonably practicable and consistent with other enactments relating to their functions, to secure that any rights which they have to the use of water and associated land are exercised so as to ensure that the water or land is made available, in the best manner, for recreational purposes. Opportunities are particularly likely to arise in respect of:
  • inland reservoirs, flooded gravel pits and coastal waters, which may be an important resource for water sports, such as sailing, windsurfing and canoeing, and for angling, walking and birdwatching upland water gathering grounds, where there should be provision for informal recreation such as walking, mountaineering and enjoyment of the countryside. Wherever practicable, access on roads and tracks should be extended to equestrians and cyclists for informal recreation. Access for organised activities such as orienteering, climbing, paragliding and caving should be granted unless there are clear reasons why it should be refused.
5.2 The Agency also has a general duty to promote the use of inland and coastal waters and associated land for recreational purposes.
