The Convention represents a major step forward in the fight against transnational organized crime and signifies the recognition of UN Member States that this is a serious and growing problem that can only be solved through close international cooperation. The Convention, concluded at the 10th session of the Ad Hoc Committee established by the General Assembly to deal with this problem, is a legally binding instrument committing States that ratify it to taking a series of measures against transnational organized crime. These include the creation of domestic criminal offences to combat the problem, and the adoption of new, sweeping frameworks for mutual legal assistance, extradition, law-enforcement cooperation and technical assistance and training.

Organized Crime
Advances in communication and technology have dramatically expanded legitimate commercial enterprise between states, shrinking distances, rendering state frontiers porous, and opening up previously unimaginable opportunities for commercial, political and social interaction. Yet this process of globalization has a dark side: expanding opportunities for legitimate commercial activities have been paralleled by unprecedented openings for illegitimate activities by criminal groups and enterprises. The threat posed by transnational organized crime to the political, economic and social fabric of societies was recognized by the international community beginning in the mid-1990s. The subsequent negotiation of an International Convention against Transnational Organized Crime was a historic step forward in countering this threat.
Global Programme against Transnational Organized Crime
The Convention against Transnational Organized Crime provides the normative framework and orientation for the global programme. The programme aims at ensuring that states ratify the Convention and that they take effective, practical steps, in line with the provisions of the Convention, to fight organized crime.

In 1970, Congress passed the Racketeer Influenced and Corrupt Organizations (RICO) Act, Title 18, United States Code, Sections 1961-1968. At the time, Congress' goal was to eliminate the ill-affects of organized crime on the nation's economy. To put it bluntly, RICO was intended to destroy the Mafia. Throughout the 1970's, RICO's intended purpose and its actual use ran parallel to each other. Seldom was RICO used outside of the context of the Mafia, and it is not an overstatement to say that civil claims under RICO were simply not brought. In the 1980's, however, civil lawyers noticed section 1964(c) of the RICO Act, which allows civil claims to be brought by any person injured in their business or property by reason of a RICO violation. Any person who succeeded in establishing a civil RICO claim would automatically receive judgment in the amount of three times their actual damages and would be awarded their costs and attorneys' fees. The financial windfall available under RICO inspired the creativity of lawyers across the nation, and by the late 1980's, RICO was a (if not the most) commonly asserted claim in federal court. Everyone was trying to depict civil claims, such as common law fraud, product defect, and breach of contract as criminal wrongdoing, which would in turn enable the filing of a civil RICO action.

In fact, a look at the economic impact alone gives a glimpse of the importance of this issue. The Center for Strategic and International Studies, Global Organized Crime Project, Financial Crimes Task Force estimates global organized crime reaps profits of close to $1 trillion per year. The FBI's fight against organized crime is unlike other criminal programs. Instead of focusing on these crimes as individual events, the FBI's Organized Crime Program targets the entire organization responsible for a variety of criminal activities. The FBI has found that even if key individuals in an organization are removed, the depth and financial strength of the organization often allows the enterprise to continue. The FBI focuses its efforts on structured criminal groups that pose the greatest threat to American society. These criminal enterprises include traditional, well-entrenched organizations such as La Cosa Nostra and Italian Organized Crime, Russian/Eurasian Organized Crime, Nigerian Criminal Enterprises, and Asian Criminal Enterprises. Additionally, because many organized crime groups are drawn to the lucrative profits associated with drug trafficking, the FBI also focuses investigations on the Cali, Medellin, and North Coast Colombian drug cartels, Mexican Drug-Trafficking Organizations, and organizations based in the United States.
