Your Internet e-mail address: March 11, 1998 DIVORCE SEMINAR REQUIREMENT UPHELD The Oklahoma Supreme Court has upheld the constitutionality of requiring divorcing parents in Oklahoma to attend the "Helping Children Cope with Divorce" seminars. In Nelson v. Nelson , decided February 3, 1998, the husband was served with a divorce petition which notified him of his obligation to attend the seminar. Husband failed to answer the petition, and did not attend the seminar. In granting a default divorce, the court denied visitation to the husband, based upon his failure to attend. On appeal, the husband argued that the requirement of attending the seminar was a violation of equal protection and due process. The Supreme Court denied the equal protection challenge, on the basis that the requirement applies to all divorcing parents, and is intended as a protection for children of divorcing parents. The court further held that the simple requirement that divorcing parents attend the seminar was not a violation of due process, however, since nothing in the papers which were served on the husband notified the husband that he could be denied visitation based on his failure to attend, the court held that the trial court should have vacated its earlier decree when challenged by the husband.

BACKGROUND AND PROCEDURE Gates filed a complaint asserting causes of action for defamation and invasion of privacy. The complaint alleged that in 1988 Will Nix and others conspired to and succeeded in murdering Salvatore Ruscitti. Gates was an employee of Nix. While initially charged as a co-conspirator, Nix eventually pleaded guilty to being an accessory after the fact and was sentenced to three years in prison. Discovery was the producer of a television series, The Prosecutors. The program re-enacted notorious crimes, identified the perpetrators and victims and included interviews with investigators and prosecutors. In 2001 the series aired an episode entitled "Deadly Commission" dealing with the Ruscitti murder. The program purported to portray Gates's involvement in the crime.

There is a difference. It is a difference much like that between a man looking at his favorite hunting dog–and a physiologist looking at the same dog. As we have learned from quantum physics, the object is altered by the point of view of the observer as well as by the act of observation. In fact, even the language which describes an object may differ radically depending on the observer. This seems especially true in the professions. One becomes accustomed to–if not at ease with–the Latinate baroque of medical and legal terminology, agree-ing that it imbues discussion of its objects of contemplation with a degree of precision lacking in everyday talk. That is surely true. As far as it goes. But even as legal terminology and legal analysis add precision to discourse, they tend to create alternate realities in which lawyers come to live and act and have their being. If the price of regional precision is loss of overall reality, one needs, as it were, another place to stand in order to determine when the fictions of the legal system part altogether with what one experiences as real in terms of the larger universe we all inhabit. The battle between the logos of the poet or novelist and the lex of the lawyer seems embodied in an essay written by a friend of mine back when we were both studying at Tulane Law School.
