A majority of states have reorganized or reduced department of education staff and/or introduced changes in state board structure or authority. One tool states use is the oversight commission. Commissions vary widely in scope of duties, structure and composition. Some have a very specific purview and limited term of operation, while others are broad in scope and ongoing in nature. All, however, seem to have accountability as a general goal, although their role is advisory. Here is a look at how some states structure and use education commissions. State Commission Information Alabama Ala. Code The Alabama Education Study Commission is designated as a standards on excellence commission. The commission is currently responsible for examining the public elementary and secondary schools and making an annual report on the status of public education. The Commission examines the required courses, testing programs for teacher candidates, promotion and retention standards, student assessment programs and the performance-based accreditation standards, as well as overall compliance under The Alabama Education Improvement Act of 1991 (Acts 1991, No. 91-323), and reports its findings to the governor, legislature and the state board.

Retention Standards The Oklahoma State Regents for Higher Education (OSRHE) have adopted a progressive policy concerning satisfactory academic performance. Students failing to maintain an appropriate grade average will be placed on either academic notice or academic probation as a condition of continued enrollment. Back to Academic Regulations Academic Notice Students attempting 30 or fewer credit hours and having a cumulative grade point average of 1.7 to less than 2.0 will be placed on academic notice. Academic notice is a warning designed to alert a student to the possibility of future academic progress difficulties. Academic notice does not lead to academic suspension. Back to Academic Regulations Academic Probation Any student whose cumulative grade point average falls below the designated level for a given semester is on academic probation. Academic probation can lead to academic suspension. Students will be placed on academic probation if they fail to meet the following requirements: Credit Hours Attempted Cumulative GPA Requirement Freshman students with 30 or fewer credit hours, with a GPA of 1.7 to less than 2.0, will be placed on academic notice. All courses in which a student has a recorded grade will be counted in the calculation of the grade point average for retention purposes. Any student not maintaining satisfactory progress toward his or her academic objective as indicated above will be placed on probation for one semester. At the end of that semester, the student must have a semester GPA of 2.0 in regularly graded course work or meet the minimum cumulative GPA standard required above, in order to continue as a student. Students not meeting either of these criterion will be immediately suspended and may not be reinstated until one regular semester has elapsed.

Parents have the right to seek review of any decisions affecting their child's education through a due process hearing conducted by the state educational agency. See Honig v. At the beginning of his senior year at Stroud High School, T.S. requested a due process hearing from the Oklahoma State Department of Education on the grounds that the school district had denied him a FAPE. The matter was assigned to a hearing officer, Mark L. Reed. At the hearing, T.S. alleged that the school district had denied him a FAPE because his IEP did not identify a weakness in his typing skills and did not address his preferred modifications for his English and horticulture classes. Reed found in favor of the school district, and T.S. appealed. In April 1999, the appeal officer affirmed Reed's decision. He held that T.S.'s IEP was appropriate, needed no modification and exceeded the school district's obligations under the IDEA. Although he had a right to do so

Education
The Department of Corrections Education Unit will provide, at no cost to the offender, educational programs designed to meet the academic needs of individuals from zero level through high school diploma or equivalent, and, upon completion of high school equivalency, the possibility of college-level courses. (4-4464, 4-4465) The college program may require some expense to the offender but is available at most facilities. The goal of the educational unit is to assist the offender in acquiring basic academic and life skills which will better equip him/her to become a more productive citizen upon release. Summary
Actions to downsize government and increase efficiency dominated the legislative agendas of SREB states in 1995, and schools and colleges in many states found themselves accepting more freedom and flexibility in return for more accountability.
It was also a belt-tightening year across the region. In most states, education budgets grew less than they did one year ago. Increases to elementary and secondary education budgets for 1995-96 are lower in nearly every SREB state, while higher education budget increases are lower in two-thirds of the states. Pay raises for school teachers and college faculty are also generally lower.
Despite the slowdown in the growth of public college and university budgets across the region, tuition increases for in-state students were generally modest. A few states saw increases as high as 7 percent, but more states held tuition steady.
Three SREB states passed charter school bills designed to encourage more educational innovation. Most other states considered such bills or agreed to study the concept further.
Higher education budgets
Higher education budget increases in the SREB states ranged from about 1 percent to 9 percent. Increases of less than 4 percent were approved in Kentucky, Louisiana, Maryland, Oklahoma, South Carolina, and Virginia. Four-year colleges in North Carolina and Tennessee institutions will operate at about last year's funding level. Colleges in Georgia will see the greatest boost at 9 percent. Budgets in Arkansas, Florida, Mississippi, Texas, and West Virginia are up 6 to 8 percent. Funding in Alabama will decline 7.6 percent.

The Oklahoma Department of Human Services appealed a decision by the
Health Care Financing Administration disallowing $268,045 in federal
financial participation claimed under Title XIX of the Social Security
Act. The basis for the disallowance was that, in determining the
Medicaid reimbursement rate for intermediate care facilities for the
mentally retarded (ICF/MRs) for calendar year 1978, the State had
improperly included educational activity costs. Based on a preliminary analysis of the issues, the Board issued an
order directing the State to show cause why the disallowance should not

Oklahoma The Oklahoma Diabetes Prevention and Control Program (DPCP) has received funding from the Centers for Disease Control and Prevention since 1993. Activities supported by the Oklahoma DPCP include the following:
  • Collecting data on health. The Oklahoma DPCP, University of Oklahoma Health Sciences Center, College of Public Health, and Indian Health Service collaborate to collect data on the health of Native Americans; this includes diabetes-related data to support preventive interventions. The Native American Supplement to the Oklahoma Behavioral Risk Factor Surveillance System collects additional items of information and oversamples Native Americans. The Oklahoma DPCP supports the supplement, which is now in the third year of data collection. Sponsoring a demonstration project for rural Oklahomans.

Joann Harding is a 22-year veteran teacher, a multiple sclerosis survivor, sole custodian of two grandchildren, and care provider for her mother. She loves teaching and doesn’t mind living meagerly on a teacher’s salary because she provides her grandchildren a home, her mother medical care, and herself a fulfilling career. However, the trials she faced over the last three years almost cost her everything. It began with a complaint that she improperly administered the state test from parents whose child had been recently disciplined. Before she knew what was happening, the State Department of Education sought to revoke her teaching certificate with a number of specious allegations. Joann contacted OEA and our Legal Department intervened. We represented Joann during a nine-hour hearing, after which the Hearing Officer ruled in Joann’s favor, holding she did not intentionally violate regulations. Joann was relieved and hoped her ordeal was over. Unfortunately, it was far from finished. The State Board overturned the Hearing Officer’s ruling, without explanation, and suspended her certificate into the school year, ensuring termination. Our office sued the Board and obtained an injunction so Joann could continue working until trial. The matter was ultimately tried in July 2002, and the court ruled for Joann, ordering the Board to provide her with a new hearing.

Paperwork:
  • The completion of the 506 Form qualifies the student for services under Title IX. To qualify for Johnson O'Malley, you must submit a copy of your child's Certificate of Degree of Indian Blood (CDIB). If a CDIB is not available, the student may submit a copy of the natural parent's CDIB card and a copy of the student's birth certificate. The following documents need to be on file in the Student Services office:
