Education Legal Provisions Individuals with Disabilities Education Act
First enacted in 1975 as P.L. 94-142, the major federal law affecting educational services for children with disabilities is now called the Individuals with Disabilities Education Act (IDEA)
IDEA sets forth the rights of children with disabilities to receive a free, appropriate public education in the least restrictive environment. The law authorizes federal financial assistance to states so that they can help local school districts cover the cost of providing full educational opportunities to children and youth with disabilities.
IDEA has been amended repeatedly over the years, with the most recent changes enacted in 1997. For information on IDEA and a summary of changes made by the 1997 Amendments, visit the NICHCY web site at http:// www.nichcy.org/publist.htm . Select the publication "Education of Children and Youth with Special Needs: What Do the Laws Say?" and "IDEA Amendments of 1997."

SPECIAL EDUCATION - Classroom Disruption

A disabled, violent student in North Carolina broke her teacherUs arm in a classroom fray. A disabled Oklahoma student stabbed her teacher with a nail she had secreted into class. What followed? Summary expulsion, or at least placement in more restrictive classrooms?
No. Under the 1975 Individuals With Disabilities Act, or IDEA, which provides the special programs designed to educate and create opportunities for disabled students, the teachers and school officials in the two states may deal with such violent and disruptive students with only mild punishments.
The Oklahoma student received a three-day suspension, for example, and the North Carolina girl was suspended from school for two days, even though similar acts by nondisabled students would have resulted in much harsher measures.
Such incidents, now commonplace, have led the two major teachers' unions - the American Federation of Teachers and the National Education Association - along with several professional organizations, such as the National Association of Elementary School Principals, to demand a major overhaul of the IDEA. They believe its provisions have been responsible for allowing the situation to get completely out of hand and they are glad it is before Congress for reevaluation.

("What is your State definition of special needs?") A child with special needs is defined as a child that has at least one of the following needs or circumstances that may be a barrier to placement or adoption without financial assistance:
    • Eight years of age or older Racial or ethnic factors (Indian, Hispanic, Asian, and African-American children three years of age or older) Member of a sibling group of any age placed together Physical disability requiring regular treatment with a specific diagnosis given by the child's physician Mental disability meeting the eligibility criteria for educable multi-handicapped (EMH) or trainable multi-handicapped (TMH) classes and evaluated by a licensed psychologist, psychometrist, school, or recognized diagnostic center. Note: A child with a demonstrable need for intensive adult supervision beyond ordinary age needs also qualifies Emotional disturbance established by a physician, a psychologist, behavioral therapist, or social worker; corroborated by a Child Welfare worker's observations of the child's behavior; corroborated by one or more caregivers such as foster parent, Head Start or school personnel, church nursery, or child care provider; and documented with a specific diagnosis and prognosis, if applicable

    to see what happened to thirty individuals age 8 to adult, 15 to 25 years later. They were taught in small groups in clinical practice, and had abilities ranging from Gifted, Average, to Severe Deficiencies. Where are they now?
    These case studies of success were published two to four years following the treatment in 1989. ( Journal of Accelerative Learning and Teaching , Summer 1989, 14, 1, 113-141) These summaries have been updated to reveal the current status of each participant. Fifteen-Day (24-hours of intensive training) classes were taught in small homogeneous groupings by age and ability, according to their pre-course assessments. Various classes included both high and low academic achievers, and various Special Needs populations of Gifted and Talented, Learning Disabled, Dyslexic, and Developmentally Disabled. This data set of forty students had longitudinal maintenance gains. They all attended college and are successfully employed. The following cases reviewed within in each Special Needs category, with tests that were routinely administered in the early 1980's.
