Legislative Reports Vol. 26 No. 13, 126th General Assembly, July 18, 2005 Taft signs budget bill; over 200 districts will see no increase The Ohio General Assembly has passed Amended Substitute House Bill (HB) 66, and Gov. Bob Taft signed the $51.2 billion budget bill
into law on June 30. According to simulations provided by the Legislative Service Commission (LSC), 204 school districts will receive no increases in total state aid in either Fiscal Year (FY) 2006 or in FY 2007. Copies of the LSC district-by-district projections, including average daily membership (ADM) and valuation changes, can be viewed at www.osba-ohio.org/advocacy.htm. Following is a brief description of the budget. Funding formula
  • Eliminates the 1998 Guarantee for school districts and the 1999 Guarantee for joint vocational schools.
    • Transitional aid also will be provided to joint vocational school districts at 100% in both years.
    Requires two ADM counts:
    • The first count will be in the first full week of October and used for the first six months of the fiscal year.

Ohio School AED Program Akron General Medical Center has been named the administering organization for the funds provided by the State of Ohio to supply automated external defibrillators (AEDs) to individual schools throughout the State. In June, Governor Bob Taft signed legislation that made available 2.5 million dollars generated from the tobacco settlement to fund the first step in an effort to provide AEDs for Ohio's 5,000 public and private schools. It is estimated that a total of approximately 7.5 million dollars must be raised to fully implement the goal of placing an AED in every Ohio school. By naming the Akron General Medical Center as the not-for-profit administering organization, the State has put into motion the initial phase of this very important program. AEDs have made it possible for trained, as well as untrained, lay rescuers to deliver life-saving defibrillation shock to cardiac arrest victims. These small, portable devices administer an electric shock through the chest wall to the heart. A built-in computer assesses the patient's heart rhythm, judges whether defibrillation is needed, and then administers the shock. Audible and/or visual prompts guide the user through the process. These shocks can convert ventricular fibrillation into a normal heart rhythm and save lives.

    OSFC Has Funded 200 Schools in 75 Counties, Spends $2 Million a Day on Schools
    COLUMBUS (February 20, 2004) - Governor Bob Taft today announced that the Ohio School Facilities Commission (OSFC) has now disbursed over $3 billion to fund school construction projects in 150 active school districts in 75 Ohio counties. Administrated by the OSFC, the funding allows statewide school districts to renovate existing buildings and build new facilities. "We are making excellent progress toward our goal of creating good, modern, and safe places for Ohio's school children," said Taft. "Thanks to continuing support from the General Assembly and from the efforts of local communities, we will continue to do all we can to enable every single child to receive a good education." Since its inception in 1997, the OSFC has provided funding for 200 new school buildings across the state. Over the past three years, spending on OSFC-funded projects in both state and local dollars has averaged over $2 million a day. "Reaching this milestone shows the continued emphasis that Governor Bob Taft and the Ohio General Assembly place on ensuring that Ohio's school children have the opportunity to go to school in a quality learning environment," said OSFC Executive Director Lynn Readey.

    I. Background and Context
    On July 1, 1999, House Bill 282 went into effect, establishing a grant program in the amount of $40 million to encourage the development of alternative schools/programs for those youth who are habitually truant and experience school failure, who bully or threaten their classmates, or otherwise regularly disrupt the school's learning environment. Children who are not attending school regularly or who drop out can pose significant problems for educators, police officers, juvenile court judges, probation officers, and the public. These are also the individuals who are most likely to bring weapons to school. When they are not in school and not in the labor force, they are at high risk of engaging in delinquent acts. Among the factors that contribute to youth ending up outside the education mainstream include:

    Recent Events Costing Out Historical Background The Ohio State Constitution requires the General Assembly to provide and fund "a thorough and efficient system of common schools throughout the State." In Miller v. Korns , 140 N.E. 773 (1923), the Ohio Supreme Court interpreted this provision to mean, inter alia, that a thorough and efficient system could not be one in which any school districts are "starved for funds" or "lacked teachers, buildings, or equipment." In 1976, the court upheld the state's then-current funding system on the basis that all districts had the fiscal resources necessary to meet state minimum standards. In that opinion, Board of Education of Cincinnati v. Walter , 390 N.E.2d 813, the court left the door open for possible future "adequacy" litigation when it said that a funding system would violate the constitution if "a school district was receiving so little local and state revenue that the students were effectively being deprived of educational opportunity."     Voters Overwhelmingly Reject Ohio Legislature's Ballot Issues
    Voters overwhelmingly rejected the state legislature's proposals by a margin of 6 to 1. Governor Voinovich, Senator Finan, House Speaker Davidson and other state leaders actively promoted the ballot issues. Nearly all schools and school related organizations were opposed to the issues because the package in total fell far short of what was needed. In the end, voters listened to those closest to their schools and rejected the proposals. The legislation included 2 ballot issues to be put before voters on the May 5, 1998 primary election.
    • ISSUE 1 - Allow the state to issue general obligation bonds for the purposes of school facility construction and repair. State general obligation bonds carry the full faith and credit of the state of Ohio and thus have a lower interest rate than bonds issued by individual schools. Passage of this issue will reduce the cost of school facility construction. ISSUE 2 - Increase the state sales tax from 5 to 6 cents per dollar.
    REACTIONS TO THE GENERAL ASSEMBLY ENACTMENTS
    Governor Voinovich and legislative leaders contend the enactments satisfy the Supreme Court order. The Adequacy and Equity Coalition which filed the initial lawsuit contends the legislature has still not addressed the fundamental issues. Many legislators and nearly all schools and school related organizations agree the solution is inadequate.

    INTRODUCTION
    Is Ohio's school funding system fair and adequate? Not according to the Ohio Supreme Court which on March 24, 1997 declared the current system unconstitutional and directed Ohio lawmakers to enact a new system by March 24, 1998. Two years later, Perry County Court Judge Linton Lewis has ruled Ohio's actions to meet the March 1998 deadline have failed miserably and directed the State to enact a new system by the end of 1999. Since the Ohio Supreme Court ruling, there has been much debate and many plans for a new system have been proposed. The Ohio General Assembly enacted 7 new laws, which included a proposed sales tax increase defeated overwhelmingly by voters on the May 1998 ballot. State leaders claimed and still claim these enactments satisfy the Supreme Court's directive. Other lawmakers and many others including nearly all schools throughout Ohio disagree. With Judge Lewis's decision, the State Board of Education and State Department of Education have been directed to recommend a new system to the General Assembly and the General Assembly is directed to enact a new constitutional system by the end of 1999. Governor Taft, House Speaker Davidson, and Senate President Finan have announced they will appeal the ruling to the Supreme Court.
