State Laws Rightly Criminalize Fraudulent Bulk Spamming According to a recent report from an Internet security firm, in September 2004, a whopping 82% of inbound email messages to consumers consisted of spam. Does the sheer volume of spam mean it is impossible to stop? The answer is potentially no. According to one spam watchdog group, Spamhaus , only 200 spam operators are responsible for 80 percent of the spam received by internet users in North America and Europe - and it is well-known exactly who these "spam kingpins" are. Shutting these operators down, then, should drastically reduce the spam clogging our inboxes. Some states have gotten serious about these spam kingpins - passing laws that provide for criminal penalties for fraudulent spam. Three States Now Have Anti-Spam Laws, But All Fifty Should Adopt Them

January 19, 2005, The Free Press (Columbus, Ohio) By Steve Rosenfeld and Harvey Wasserman Excerpt from the article: In a stunning legal attack, Ohio's Republican Attorney General has moved for sanctions against the four attorneys who sued George W. Bush et. al. in an attempt to investigate the Buckeye State's bitterly contested November 2 election. Petro's action raises suspicions that revenge and an attempt to chill further legal actions are the core motivations for this latest GOP assault on the election protection process. Robert Fitrakis, Susan Truitt, Cliff Arnebeck and Peter Peckarsky were named by Attorney General James Petro in a filing with the Ohio Supreme Court. Petro charges the November Moss v Bush and Moss v. Moyer filings by the Election Protection legal team were "frivolous." Petro is demanding court sanctions and fines. "Instead of evidence, contesters offered only theory, conjecture, hypothesis and invective," the Attorney General's January 18th memo about the suit said. "A contest proceeding is not a toy for idle hands. It is not to be used to make a political point, or to be used as a discovery tool, or be used to inconvenience or harass public officials, or to be used as a publicity gimmick."

Estate Tax
The monies collected from the estate tax are distributed by law, 36% to the State of Ohio and 64% to the taxing district (City, Township or Village) in which the decedent had resided and/or owned real property. For dates of death on or after January 1, 2001, the distribution is 70% to the municipality and 30% to the State of Ohio and for dates of death after January 1, 2002, the distribution is 80% to the municipality and 20% to the State of Ohio. The County Auditor is the Chief Fiscal Officer of the County. It is the Auditor's responsibility to account for all dollars received each year by the County and to issue warrants (checks) in payment of all County obligations, including the distribution of tax dollars. The Auditor's Office is responsible for all County funds and maintains the official records of all receipts, disbursements and fund balances. Over a billion dollars is accounted for on an annual basis.
  • It is the Auditor's responsibility to serve as the paymaster for County employees.
  • The Auditor also distributes gasoline taxes, estate taxes, fines, and local government funds in addition to real estate, personal property and manufactured homes taxes.

Conclusion
Under Ohio law, the goal has been to protect both the interests of the public and the upland owner. Ohio significantly accommodates upland, littoral owners by giving them the right to lease the public's Lake Erie lands (at a nominal cost) for the exclusive use and occupation of those lands to wharf out for the purposes of navigation and to protect upland property from erosion. In discussing this issue, we must not lose sight of the fact that there are more than 11 million Ohioans who do not reside on property bordering Lake Erie and therefore do not enjoy the direct benefits of living along the Lake Erie shore. Yet it is all of the people of Ohio who own Lake Erie. The interests of all Ohioans are embraced at the heart of Ohio's Public Trust Doctrine. Under the law known as the Public Trust Doctrine, each State holds title in trust to the lands of the Great Lakes and Oceans within the territorial boundaries of that State. These lands were granted to the people of the State at statehood up to the ordinary high water mark. On the other hand, the grants of uplands bordering the Great Lakes and Oceans conveyed no title below the ordinary high water mark. After statehood, each State manages the lands and navigable waters that it holds in trust in accordance with that State's law. In Ohio, a submerged land lease allows a littoral property owner to lease the right to use and occupy the territory of Lake Erie occupied by their improvement. The validity of a deed which contains a legal description for lands lakeward of the current natural location of the ordinary high water mark of Lake Erie is not an issue that the ODNR has the legal authority to decide, nor does ODNR attempt to decide, in reviewing lease applications.
