Bush et. al. in an attempt to investigate the Buckeye State's bitterly contested November 2 election. Robert Fitrakis, Susan Truitt, Cliff Arnebeck and Peter Peckowsky were named by Attorney-General James Petro in a filing with the Ohio Supreme Court. Petro charges the November Moss v Bush and Moss v. Moyer filings by the Election Protection legal team were "frivolous". Petro is demanding official censure and fines. "Instead of evidence, Contesters offered only theory, conjecture, hypothesis and invective," the attorney general's January 18th memo in support of the suit said. "A contest proceeding is not a toy for idle hands. It is not to be sued to make a political point, or to be used as a discovery tool, or be used to inconvenience or harass public officials, or to be used as a publicity gimmick." But Cliff Arnebeck says it is has been Petro and Ohio's partisan Republican Secretary of State, J. Kenneth Blackwell, who have stonewalled the election challenge legal proceedings. Both have refused to submit any evidence to the court to refute the allegations in the election challenge case - claiming George W. Bush did not win a majority in Ohio - and Petro's office has also refused to allow any Ohio public election official to be deposed.

Stiff legal sanctions sought by Ohio's Republican Attorney General James Petro against four attorneys who have questioned the results of the 2004 presidential balloting here has produced an unintended consequence a massive counter-filing that has put on the official record a mountain of contentions by those who argue that election was stolen.
In filings that include well over 1,000 pages of critical documentation, attorneys Robert Fitrakis, Susan Truitt, Peter Peckarsky and Cliff Arnebeck have counter-attacked. Their defense motions include renewed assertions that widespread irregularities threw the true outcome of the November vote count into serious doubt. That assertion has now been lent important backing by a major academic study on the exit polls that showed John Kerry winning the November vote count.
Petro's suit is widely viewed as an attempt at revenge and intimidation against the grassroots movement that led to the first Congressional challenge to a state's Electoral College delegation since 1876. The attorney general's action was officially requested by Secretary of State J. Kenneth Blackwell, who administered the Ohio presidential balloting while serving as co-chair of the state's Bush-Cheney campaign. Petro and Blackwell have labeled as "frivolous" the election challenge filing. Their demand for sanctions will be reviewed by the Republican justice of the Ohio Supreme Court.

History of the Library
The history of the Supreme Court of Ohio Law Library began around 1860. The initial collection of nearly two thousand volumes of law books was originally a part of the State Library collection, which was transferred to rooms assigned to the Supreme Court in the State Capitol building upon the completion of the building in 1860. The first law librarian, who served between 1858 and 1860, was Richard Riordan, a court crier. Riordan's successor was Herman Ruess, also a court crier who served as librarian from 1860 to Feb. 11, 1866. The law officially creating the office of Law Librarian was an act passed by the 57 th General Assembly of Ohio on Feb. 16, 1867. The first Law Librarian to be elected under this law was James H. Beebe who served until July 12, 1880. Frank N. Beebe, who became the second Law Librarian upon the death of his father in July, 1880, served until his own death while in office in September, 1903. The size of the collection was increased from 2,500 volumes to 7,500 volumes in 1880 under the elder Mr. Beebe. At the time of the death of this son, the collection was about 20,000 volumes. In 1901, while the younger Mr. Beebe was in office, the library moved into its new quarters in the State House Annex, and the Law Librarian's title was changed to Marshal and Law Librarian. E. Howard Gilkey served as Marshal and Law Librarian from Oct. 3, 1903 to Sept. 1, 1913. A count in 1907 showed that the library had 28,000 volumes. Edward Antrim, who succeeded Mr. Gilkey, served from Sept. 1, 1913 through 1921. A catalog published by Mr. Antrim in 1914 had a collection of 35,000 volumes.

... OSU Home Page Since August 2000, the Legislation Clinic at the Michael E. Moritz College of Law has enabled participating students to develop legislative analysis and lawyering skills and to benefit from exposure to Ohio legislative practice. In addition, the Clinic fosters new scholarship on the operations of and challenges facing state legislatures, and offers an important public policy service to Ohio legislators. In February 2002, the Clinic sponsored the first in a series of one-day conferences devoted to a public policy issue of particular relevance at the state legislative level, "Early Returns on Legislative Term Limits." For details on the April 2004 conference, "Medicaid, Medicines, and Malpractice: Issues in State Health Care," see the Conference Information page. The Legislation Clinic is a natural outgrowth of the College of Law’s decision a decade ago to include a Legislation course in the required first-year curriculum, making it one of only a handful of American law schools with such a requirement. The accompanying faculty strength and student experience in the legislative area, coupled with our location in the state capitol and the College’s interdisciplinary Center for Interdisciplinary Law and Policy Studies , render the College an ideal setting for the Legislation Clinic. The increasing devolution from the U.S. Congress to the state legislatures of many key public policy issues, along with the advent of legislative term limits in Ohio (which for the first time forced legislators from office at the conclusion of 123rd Ohio General Assembly in December 2000), make this an especially important time to operate a Legislation Clinic. With the assistance of the Center and the support of others at the University and the Statehouse, the College of Law secured a permanent budget increase from the University to establish the Clinic.

Bill Files

A bill file typically contains various versions of a particular bill, a synopsis of committee amendments, committee reports, testimony, fiscal notes, and local impact statements. Bill files are compiled by the Legislative Service Commission and housed at the Ohio Historical Society. Committee Reports
As a bill works its way through the legislative process, it will be assigned to a standing committee. If the committee reports the legislation back to the full House/Senate, it will issues a committee report. Typically, reports are not available before 1989. Available reports can be found in the Bill file or online at Ohio Capital Connection.
