Held , in view of the foregoing, the claimant is precluded from becoming entitled to child's insurance benefits on his father's earnings record.
Section 404.305(b) of Regulations No. 4 provides, in pertinent part, that
"(b) Insured's death caused by an intentional act. You may not become entitled to or continue to receive any survivor's benefits or payments on the earnings record of any person if you were convicted of a felony or an act in the nature of a felony of intentionally causing that person's death. . . ."
For certain homicides, e.g., first or second degree murder, the Social Security Administration (SSA) presumes intent, because by definition, these crimes involve intent. However, voluntary manslaughter may or may not be defined as involving intent; therefore, SSA establishes no presumption of intent. Instead, SSA bases its decision as to entitlement or nonentitlement on whether the State where the conviction occurred treats voluntary manslaughter as an intentional homicide. If State law is inconclusive, development of the facts related to intent is required. In Ohio, voluntary manslaughter is a felonious homicide. However, a person can be convicted of voluntary manslaughter if he or she "knowingly" caused the death of another regardless of whether he or she "intended" to cause that death.

This is the ordinance itself, as opposed to the municipal code. The words in capitals are the ones added in 1998. ORDINANCE NO. -1998 amending and/or supplementing Title 9, Chapter 92, Section 92.25 "Control of Dogs" and 92.99 "Penalty" to add Canary Dogs and American Bulldogs to the list of breeds subjects to special regulations, to add dogs the cause seriousohysical harm to the definition of "Vicious Dog", and to provide the microship identification for dogs banned from the City and subsequent destruction if these dogs are found within the City; and declaring an emergency. BE IT ENACTED by the Council of the City of Akron: Section 1. It would be very convenient if all state and federal codes, statutes, and caselaw were available on the World Wide Web. This would give lay people easy access to the laws that they must follow and it would allow attorneys to do legal research without having to leave their office to go to a law library, or pay for expensive collections of casebooks. Unfortunately, economic realities dictate that we may never see all of the substantive law of all the states on the Web. Several states receive quite a bit of income by selling the exclusive rights to publish that state's caselaw. In addition, it is quite expensive to publish and maintain a web site, and money for such a project is not available in all states. Caselaw on the Web ideally would include decisions from at least the last 30 years, a sophistocated search engine for locating relevant law, case summaries, headnotes, etc. Providing all of these on a Web site would be very expensive. Given the above, it is impressive how much substantive law

Points of view in this document are those of the author and do not necessarily represent the official position or policies of the U.S. Department of Justice. In the 1997 legislative year, only seven states and the District of Columbia had not enacted any domestic violence related laws. Four other state legislatures were still in session but had not enacted such laws as of September 2, 1997. The Maryland, Minnesota, Nevada, and Texas legislators were the most active in passing new laws. The Texas legislators were the most active, passing seven distinct acts relating to domestic violence including reenactments of the code provisions relating to civil protective orders and stalking.
Summary of Changes
Among the 39 states whose legislatures enacted domestic violence laws, the types of laws passed ranged from creation of new criminal offenses to technical amendments of existing statutes to clarify language ambiguities. Among the most important areas of change were new criminal law provisions, criminal procedure amendments, stalking law changes, provisions for full faith and credit to out-of-state protective orders, other amendments to civil protection order provisions, police training requirements, and collateral effects of a conviction for domestic violence.

  • Ministry of Justice (in Greek) The 1975 constitution, which describes Greece as a "presidential parliamentary republic," includes extensive specific guarantees of civil liberties and vests the powers of the head of state in a president elected by parliament and advised by the Council of the Republic. The Greek governmental structure is similar to that found in many Western democracies and has been described as a compromise between the French and German models. The prime minister and cabinet play the central role in the political process, while the president performs some governmental functions in addition to ceremonial duties. The president is elected by parliament to a 5-year term and can be reelected once. The president has the power to declare war and to conclude agreements of peace, alliance, and participation in international organizations; upon the request of the government a three-fifths parliamentary majority is required to ratify such actions, agreements, or treaties. The president also can exercise certain emergency powers, which must be countersigned by the appropriate cabinet minister. Changes to the constitution in 1986 limited the president's political powers. As a result, the president may not dissolve parliament, dismiss the government, suspend certain articles of the constitution, or declare a state of siege. To call a referendum, he must obtain approval from parliament.

    United States Supreme Court ruling: Roe v. Wade (1973):
    Prior to the U.S. Supreme Court's famous Roe v. Wade decision, abortions were permitted in certain states but banned in others. The court ruled in 1973 that, anywhere in the U.S.: a woman and her doctor may freely decide to terminate a pregnancy during the first trimester, state governments can restrict abortion access after the first trimester with laws intended to protect the woman's health. abortions after fetal viability must be available if the woman's health or life are at risk; state governments can prohibit other abortions. The Roe v. Wade case involved a pregnant single woman ("Roe") who brought a class action challenging the constitutionality of the Texas criminal abortion laws, which prohibited any abortion except to save the woman's life. A married couple (the "Does") separately attacked the laws on the basis that an accidental pregnancy could find them unprepared for childbearing and could pose a hazard to the wife's health. The Does' appeal was rejected as being too speculative. The Supreme court found that: "
