"To set this standard by what is natural to the community’s pariahs is to say that the abnormal should be the standard, and the normal and natural might become the peculiar to some few persons." The Post-Revolution Period, 1776-1873 Ohio was created out of the Northwest Territory. A Council was created to enact laws and, in 1795, it adopted a statute that received all of the common law of England as well as all English statutes adopted prior to the English settlement of North America in 1607. This included the English buggery statute that mandated a sentence of death for male-male buggery. This statute created "endless confusion" as to what was legal and what was not. After statehood, this law was repealed by a statute of 1804, thus legalizing sodomy. The new code made no mention of sodomy, the legislators apparently believing that the common-law statute was sufficient, creating the possible circularity that the common-law statute was to last only until the code became effective, but, once the code was enacted, the common-law statute was kept to cover other crimes not mentioned in the code. "The transaction and the evidence is so vile and nauseating that we shall refer to it as briefly as possible, and in such language as that a reading between the lines may be necessary at some points." The Post-Revolution Period, 1776-1873 When the Iowa Territory was organized in 1838, it received the laws of the Wisconsin Territory. Wisconsin itself had received all Michigan laws when it was organized in 1836, so Iowa ended up with the Michigan sodomy law that provided a penalty of up to three years in prison, with the common-law definition. In 1840, the Iowa Territory adopted a law abrogating all laws received from Michigan and Wisconsin, which included the Wisconsin/Michigan sodomy law. Also, when Iowa passed its first criminal code in 1843, there was no mention of sodomy. Thus, Iowa made a decision to keep sodomy legal, and this freedom remained for almost a half-century. Sentencing Commission Enabling Legislation
§181.21 Creation
(A) Terms of Office
When the chief justice and governor make their appointments to the commission, they shall consider adequate representation by race and gender.
(B) Meetings The commission shall select a vice-chairperson and any other necessary officers and adopt rules to govern its proceedings. The commission shall meet as necessary at the call of the chairperson or on the written request of eight or more of its members. Sixteen members of the commission constitute a quorum, and the votes of a majority of the quorum present shall be required to validate any action of the commission. All business of the commission shall be conducted in public meetings.
Compensation The members of the commission shall serve without compensation, but each member shall be reimbursed for the member's actual and necessary expenses incurred in the performance of the member's official duties on he commission. In the absence of the chairperson, the vice-chairperson shall perform the duties of the chairperson.
(C) Staff The commission shall establish an office and shall appoint and fix the compensation of a project director and any other employees necessary to assist the commission in the execution of its authority under sections 181.21 to 181.26 of the Revised Code. The project director shall have a thorough understanding of the criminal laws of this state and experience in committee-oriented research. The other employees may include a research coordinator with experience and training in policy-oriented research; professional staff employees with backgrounds in criminal law, criminal justice, political science, or related fields of expertise; administrative assistants; and secretaries. The commission also may appoint and fix the compensation of part-time data collectors, clerical employees, and other temporary employees as needed to enable the commission to execute its authority under sections 181.21 to 181.26 of the Revised Code.

(States With Homicide Laws That Recognize Unborn Children as Victims Throughout the Period of Pre-natal Development) Arizona:
The "unborn child in the womb at any stage of its development" is fully covered by the state's murder and manslaughter statutes. For purposes of establishing the level of punishment, a victim who is "an unborn child shall be treated like a minor who is under twelve years of age." Senate Bill 1052, signed into law on April 25, 2005, amending the following sections of the Arizona Revised Statutes: 13-604, 13-604.01, 13-703, 13-1102, 13-1103, 13-1104, 13-1105, 13-4062, 31-412, 41-1604.11 and 41-1604.13. Idaho: Murder is defined as the killing of a "human embryo or fetus" under certain conditions. The law provides that manslaughter includes the unlawful killing of a human embryo or fetus without malice. The law provides that a person commits aggravated battery when, in committing battery upon the person of a pregnant female, that person causes great bodily harm, permanent disability or permanent disfigurement to an embryo or fetus. Idaho Sess. Law Chap. 330 (SB1344)(2002).
