Nonconforming New Motor Vehicles 1345.71 Definitions. As used in sections 1345.71 to 1345.77 of the Revised Code: (A) "Consumer" means the purchaser, other than for purposes of resale, of a motor vehicle, any person to whom the motor vehicle is transferred during the duration of the express warranty that is applicable to the motor vehicle, and any other person who is entitled by the terms of the warranty to enforce the warranty. (B) "Manufacturer" and "distributor" have the same meanings as in section 4517.01 of the Revised Code, and manufacturer includes a re-manufacturer as defined in that section. (C) "Express warranty" and "warranty" mean the written warranty of the manufacturer or distributor of a new motor vehicle concerning the condition and fitness for use of the vehicle, including any terms or conditions precedent to the enforcement of obligations under that warranty. (D) "Motor vehicle" means any passenger car or noncommercial motor vehicle as defined in section 4501.01 of the Revised Code, or those parts of any motor home, as defined in section 4501.01 of the Revised Code, that are not part of the permanently installed facilities for cold storage, cooking and consuming of food, and for sleeping, but does not mean any mobile home as defined in division (O) of section 4501.01 of the Revised Code, recreational vehicle as defined in division (Q) of that section, or manufactured home as defined in division (C)(4) of section 3781.06 of the Revised Code.

DEFINITIONS
Rental Agreement
Any agreement between the landlord and tenant, whether written or oral. The Ohio Landlord/Tenant Law, Ohio Revised Code (ORC) Chapter 5321 is implied into every rental agreement. The rental agreement must contain the name and address of the landlord. If the agreement is oral, the landlord, at the beginning of the tenant's occupancy, must provide the name and address of the landlord in writing. The rental agreement may never contain any terms that conflict with the Ohio Landlord/Tenant Law, any such conflicts would be decided according to the state law, not the terms of the agreement.

Date: Subject: ohio revised code Question Answer John: I have no expertise in Ohio civil service rules of testing and promotion; you should obtain a full explanation from your union on its position and proceed from there. It is not clear to me whether the state law you cite forbids reliance on oral exams or simply requires that a written exam be required whether or not oral exams are part of the process. But your union should be able to explain this to your satisfaction,and if not then you should consult with a labor attorney familiar with this area and get his/her opinion. You may have to pay for a consultation fee for such an attorney but it would be money well spent given this involves your professional future and his/her advice to you should resolve your questions one way or the other. You should pursue this as quickly as you can as I suspect that there are provisions either within your union contract and/or civil service that require you to act within a given time.

Enns Political Activities By Employees of the State of Ohio By Terri Enns Ohio Revised Code Section 124.57 imposes restrictions on political activities by public employees in the classified service. "Classified service" is the competitive classified civil service of the state, the counties, cities, city health districts, general health districts, city school districts, and civil service townships. The restriction generally prohibits partisan political activity while permitting nonpartisan participation in the political process. However, two possible exceptions require further information to determine the applicability of this code section to any specific individual. Ohio Constitution Section 3, Article XVIII, provides for home rule powers for some political subdivisions. When a city has a charter, that charter will take priority over the code section regarding political activities by employees of the city or other home rule entity. At least one court has upheld a charter imposing restrictions even on some nonpartisan activities.

(A) Subject to divisions (A)(2) and (3) of section 955.261 [ 955.26.1] of the Revised Code , a dog that is chasing or approaching in a menacing fashion or apparent attitude of attack, that attempts to bite or otherwise endanger, or that kills or injures a person or a dog that chases, injures, or kills livestock, poultry, other domestic animal, or other animal, that is the property of another person, except a cat or another dog, can be killed at the time of that chasing, approaching, attempt, killing, or injury. If, in attempting to kill such a dog, a person wounds it, he is not liable to prosecution under the penal laws which punish cruelty to animals. (B) The owner, keeper, or harborer of a dog is liable in damages for any injury, death, or loss to person or property that is caused by the dog, unless the injury, death, or loss was caused to the person or property of an individual who, at the time, was committing or attempting to commit a trespass or other criminal offense on the property of the owner, keeper, or harborer, or was committing or attempting to commit a criminal offense against any person, or was teasing, tormenting, or abusing the dog on the owner's, keeper's, or harborer's property.
