Daniel B. Ross, Ph.D.
COMMISSIONER of the OHSAA since August 1, 2004.
Dan is the ninth commissioner of the OHSAA. He replaced Clair Muscaro, who retired July 31, 2004, after nearly 15 years as commissioner and 20 years on the OHSAA staff. Ross has extensive experience as a school administrator in Ohio, having served as a superintendent, principal, teacher, counselor and coach for 30 years, and he also has experience as a college instructor, in manufacturing and as a contest official.
Ross left the education profession for a year in 1977 to serve as a production supervisor with the Didier-Taylor Corp., a manufacturing company in South Shore, Ky. He returned to education the following year when he became the principal at Portsmouth Notre Dame Junior-Senior High School.
After three years at Notre Dame, Dan moved to Bowling Green in 1981 and served as an instructor at Bowling Green State University while working on his doctorate degree. He completed his Ph.D. at BGSU in 1983 in educational administration and supervision.
For the past 21 years he has served as superintendent at three different school districts, leading the Patrick Henry Local Schools in Hamler (Henry County) for three years from 1983 to 1986, the Pickerington Local Schools (Fairfield County) for 11 years from 1986 to 1997 and the Avon Lake City Schools (Lorain County) for seven years from 1997 to July 31, 2004.

October 6, 2004 Dear Faculty: The first quarter of the school year is a good time to review your obligations under FERPA (the Family Educational Rights and Privacy Act). “FERPA Basics,” was prepared by the Offices of Academic Affairs and Legal Affairs. Please take a few moments to review it to ensure that you are familiar with the basic provisions of FERPA, so that you do not inadvertently violate this federal law. FERPA BASICS Offices of Academic Affairs and Legal Affairs October 6, 2004 FERPA is a federal law designed to protect the privacy of students' education records. Education records include any information or documentation that is recorded in any way, including records produced by handwriting, computer, e-mail, audio, and video, among others. Educational records contain information directly related to a student, and are maintained by Ohio State or any party acting on its behalf. FERPA protects the privacy of students' education records by setting forth strict instructions and limitations governing the release of information about students. Although FERPA contains exceptions for the release of “directory information” without a student's prior written consent, students have the right to request that even such directory information be withheld from disclosure to third parties.

Purpose
Ohio University actively encourages interactions with both the public and private sectors as an important component of its research, education, and public service activities. Research, educational, and public service activities supported by grants, contracts, or gifts from public and private entities and individuals provide a valuable source of funds, equipment, and topics for Ohio University activities. Professional interactions, including consulting arrangements, between faculty and governmental entities and private businesses advance Ohio University's ability to provide a high quality research and educational experience for students and enhance employment opportunities for students. Ohio University's licensing of technology, assisting in new business start-ups, and other forms of technology transfer to both public and private entities are critical to meeting society's needs.
Policy
Ohio University and its employees are committed to conducting themselves and their activities in accordance with the highest standards of integrity and in compliance with state and federal regulations governing ethics and conflicts of interest. Interactions with the private sector carry with them an increased risk of conflict of interest. Ohio University's responsibilities in this area include the identification of the potential for conflicts of interest and the assurance that they do not improperly affect Ohio University in its relationship to sponsored projects involving research, education, and public service activities. It is the purpose of this policy to set forth the principles for identifying such potential for conflicts and the procedures for reviewing and addressing the potential for conflicts that occur. It seeks to protect the university faculty and staff so that the public trust and confidence is ensured.

I. Underlying Principles
Ohio University's commitment to its educational mission and to the students and society it is obligated to serve demands that it maintain various records. No education records will be maintained that are not directly related to the basic purposes of the University. All policies and practices governing the collection, maintenance, review, and release of records will be based upon the principles of confidentiality and the student's right to privacy, consistent with the Family Educational Rights and Privacy Act of 1974. This policy shall govern the collection, maintenance, review, and release of student records on the Athens and regional campuses of Ohio University. A student is herein defined to mean any person for whom the University maintains educational records or personally identifiable information, but does not include a person who has not been in attendance at the University or any of its regional campuses.

by Ellis Jacobs While attention has been focused on legislative developments in Washington, much of the future of telecommunications and how that future will impact low income people is being worked out right now in proceedings in front of state public utility commissions. Those proceedings, which involve existing phone companies seeking to change the way they have historically been regulated and new competitors submitting to state regulation for the first time, provide an opportunity for low income advocates to address both lack of access to basic phone service and lack of access to computer and telecommunications technology and related educational opportunities.[1]
The Problem
Lack of a telephone is common problem for American low income families. While 94% of all American households have a phone, 31% of all families receiving food stamps have no telephone and 43.5 of households completely dependant on public assistance lack telephones.[2] African American and Hispanic households are more than three times as likely as white households to not have phones.[3] In households headed by women in any of these categories, the likelihood of not having a telephone is even greater.[4] Not having a telephone poses significant problems. It creates a barrier to getting timely medical attention and makes it difficult to report other emergencies such as fire or crime. One study has shown that the inability to contact agencies by phone is one important factor in keeping people from getting benefits for which they qualified. It is a barrier to employment: jobs are frequently offered and accepted via telephone.[5]

Excuses from Compulsory Attendance for Home Education 3301-34-01 Definitions. The following terms are defined as they are used in this chapter. (A) "Certified teacher" means a person who holds a valid Ohio teaching certificate, excluding the certificate issued under section 3301.071 of the Revised Code. (B) "Home education" means education primarily directed and provided by the parent or guardian of a child under division (A)(2) of section 3321.04 of the Revised Code which child is of compulsory school age and is not enrolled in a nonpublic school. (C) "Parent" means a parent, guardian or other person having charge or care of a child as defined by section 3321.01 of the Revised Code. (D) "School district of residence" means the public school district within which the parent resides. (E) "Superintendent" means the superintendent of schools of the city, county, or exempted village school district in which the parent resides. 3301-34-02 Statement of purpose.

In addition to employees represented by OCSEA, employees represented by certain other labor unions participate in the Trust pursuant to negotiations between those unions and the State. All of the individuals eligible to participate in the Trust are current or former employees of the State or their dependents. ERISA section 4(b)(1) provides that Title I of ERISA does not apply to any employee benefit plan that is a "governmental plan" as defined in ERISA section 3(32). Section 3(32) of ERISA defines the term "governmental plan," in pertinent part, as "a plan established or maintained for its employees by the Government of the United States, by the government of any State or political subdivision thereof, or by any agency or instrumentality of any of the foregoing." It is the view of the Department of Labor (“Department”) that the term "governmental plan" as defined in ERISA section 3(32) is not limited to plans established by the unilateral action of employers which are governmental agencies. In this regard, the Department has interpreted the term "governmental plan" to include plans established or maintained pursuant to a collective bargaining agreement between a governmental entity and a labor union where such plans are funded by, and cover only employees of, governmental entities.

I. Introduction

Approximately 90,000 young people are now in custody in public and private juvenile correctional facilities in the United States. Those incarcerated are disproportionately male, African-American, poor, and have significant learning and/or emotional problems that entitle them to special education services. The most common disabling conditions among juvenile offenders are developmental and learning disabilities as well as emotional or behavioral disorders. Many juveniles with disabilities in detention do not receive the educational services to which they are entitled.
Studies document the failure of juvenile correctional institutions to provide adequate educational services to young people with disabilities. Ineffective governance of education programs in juvenile corrections, the mobility of adjudicated young people, and poorly developed links between public schools and institutional settings contribute to the academic problems of incarcerated young people.
