On April 20, nine school districts in Michigan, Texas and Vermont, along with the National Education Association, and 10 NEA affiliates in Michigan, Texas, Vermont, Connecticut, Illinois, Indiana, New Hampshire, Ohio, Pennsylvania and Utah filed a lawsuit asking the courts to recognize that the No Child Left Behind Act requires the federal government to pay for billions of dollars in new mandates, and to prevent taxpayers in school districts across the country from being forced to shoulder the burden of these regulations at the expense of proven classroom programs for their children. Detroit News editorial Lawsuit Reveals Flaws in No Child Left Behind If the federal government wants to dictate policies to local public schools, it should fork over the money for meeting those mandates. That's the premise of a lawsuit filed in federal court in Detroit last week by the Pontiac School District, the National Education Association and others... ...While the federal courts aren't the proper place for making budget appropriations, the lawsuit hopefully will bring much-needed focus to the problems with No Child Left Behind.

by Susan Boswell ASHA members are hoping to shape the development of regulations for the Individuals with Disabilities Education Improvement Act of 2004 (IDEA '04) by submitting more than 1,600 comment letters and speaking at nearly all regional public hearings hosted by the U.S. Department of Education (ED). The pre-regulatory comment period ended Feb. 28. Regional meetings took place in Delaware, Ohio, Massachusetts, California, Georgia, Wyoming, and the District of Columbia from Jan. 28 through Feb. 24 to gather input and suggestions for developing regulations for IDEA '04. The ED reported that a total of 6,000 written comments were collected and about 450 people testified at the seven regional meetings.

Summary: Recently, the Ohio Department of Education issued an opinion regarding the regulations which govern homeschooling in Ohio. If this opinion stands, parents who wish to begin homeschooling their children after the school year has begun might have to wait up to 14 days to withdraw their child from school. Children who were never enrolled might appear to be subject to the opinion as well, since the opinion discusses both a specific case as well as general homeschooling requirements. The opinion implies that there is a process of "approval" rather than "notification." Ohio regulations have been used by homeschoolers since 1989 with no rights for the state to "approve" of homeschooling. It is important that we take action now to preserve homeschooling freedoms in Ohio.
Background: Ohio Revised Code (ORC) 3321.04 states in part that: "Every parent of any child of compulsory school age...must send such child to a school or a special education program that conforms to the minimum standards prescribed by the state board of education..." The law goes on to describe situations wherein an excuse from compulsory attendance may be granted, including for the purposes of homeschooling. This statute, along with ORC 3321.01, which states that "A child between six and eighteen years of age is 'of compulsory school age'...", together make up the compulsory school attendance laws.

Summary Report on the NCREL Capacity Building Conference on No Child Left Behind

September 18, 2002 This conference was designed to help state and local education agencies, as well as education service providers, move the comprehensive NCLB legislation into the field with as much ease as possible. Over 100 participants, representing a variety of stakeholders from throughout the NCREL region, gathered to discuss strategies for effectively putting NCLB into practice. State-level educational representatives shared implementation plans with districts; topical experts contributed their insight on building capacity to respond to NCLB; and education professionals met with others with similar responsibilities to discuss options to leverage resources in response to NCLB. This summary includes an overview of participant questions from your states and customized responses from the corresponding state education agencies. Gina Burkhardt, Executive Director of NCREL, opened the meeting with a welcome address and a meeting outline. Paul Kimmelman, Special Advisor to the Executive Director at NCREL, presented an overview of NCLB regulations and guidelines. Susan Sclafani, Counselor to the U.S. Secretary of Education, Rod Paige, gave the keynote address, in which Dr. Sclafani provided an overview of the strengths of the NCLB legislation. She emphasized that the new legislation is serious that no child will be left behind. The four pillars of No Child Left Behind are accountability, local control and flexibility, parental choice, and doing what works. The goal of the legislation is that all students be proficient by 2014. She said that while she understands that change is difficult, the old ways of public education are no longer acceptable.

Issues and Agenda
Ohio has addressed the issue of time structures in education not as a separate or isolated issue, but rather as an integral part of larger school improvement efforts. Ohio has focused on cohesive school improvement strategies that address systemic educational change at the building level. A centerpiece of this effort has been the Venture Capital initiative, which targets a significant amount of dollars to individual school buildings that have developed comprehensive plans for school improvement. Within this framework, schools have the resources necessary to support time for professional development, whether through team planning time, use of substitute teachers, release time, or other time structures and strategies.   • We are here today to talk about Ed-Flex- a common-sense program in which all states should be able to participate. We will hear from GAO, who will report on how Ed-Flex has been implemented in the states. In addition, we will also hear from Texas and Ohio about their experiences with Ed-Flex, as well as the state superintendent from North Carolina and a local school superintendent from Maryland. On Tuesday, Mr. Roemer and I introduced H.R.800, the Education Flexibility Partnership Act of 1999. Our bill would lift the 12 state cap off this program and allow all 50 states to apply. It also adds more accountability language to ensure that states measure the performance of students affected by the program. States and local school districts have been telling us for some time now that they need more flexibility. Right now there are scores of K-12 federal education programs, which require thousands of administrators in state education agencies across the country. Paperwork requirements and regulations often put state and local school districts in the position of having to put compliance before performance.
