Ohio Lawsuit Challenges Charter Schools, Claims State's Program Has Gone Astray (Spring 2001) A group of Ohio teachers unions and other educational groups has filed a lawsuit in state court claiming that the state's charter school program violates the Ohio state constitution. The group also attacks the for-profit organizations overseeing some of the schools, saying they are "hijacking" the schools. While a number of court challenges to charter schools have arisen and failed in other states, the Ohio lawsuit comes in the midst of several legal battles involving Ohio's education system, which may give the suit momentum. Some observers say the lawsuit is necessary to correct a state charter school system that has gone astray, while others say it's without merit. The Ohio Federation of Teachers (OFT), along with nine other organizations including the Ohio School Boards Association and the Ohio Congress of Parents and Teachers, filed the complaint against the Ohio State Board of Education May 14 in Franklin County Court of Common Pleas in Columbus, Ohio. State Superintendent of Public Instruction Susan Tave Zelman and The Lucas County Educational Service Center also are named as defendants. The lawsuit contends that the entire charter school program is unlawful on several grounds. First, the constitution calls for a system of common schools. Since charter schools aren't required to meet the same standards as traditional public schools, they're not part of that system, the lawsuit says. Second, charter schools don't answer to local school boards, as, the OFT says, is constitutionally required. Third, local tax dollars are being spent at charter schools without voter approval. And finally, the lawsuit contends that some Ohio charter schools are illegal because they are run by for-profit companies.

Biography
Dr. Nancy L. Zimpher On October 1, 2003, Nancy L. Zimpher became the twenty-fifth President of the University of Cincinnati and the first woman president. She previously served as the Chancellor of the University of Wisconsin-Milwaukee and held a faculty position in the School of Education. Prior to the appointment in Wisconsin, she served as the Executive Dean of the Professional Colleges and Dean of the College of Education at The Ohio State University in Columbus, Ohio. Dr. Zimpher has served in various administrative positions and engaged in research and development efforts concerned with improving the preparation of teachers, especially teachers for urban contexts. She is the co-author and co-editor of books on higher education (including University Leadership in Urban School Renewal and A Time for Boldness: A Story of Institutional Change ) and books on teacher education (including Profiles of Preservice Teacher Education: Inquiry into the Nature of Programs ). She also has authored and co-authored monographs, book chapters, and academic journal articles related to academic leadership, school/university partnerships and teacher education. Her many contributions in education and education research have resulted in her being sought after as a key participant in conferences both national and international. She has made numerous presentations at the American Association of Colleges for Teacher Education (AACTE), Association of Teacher Educators (ATE), American Educational Research Association (AERA), American Association for Higher Education (AAHE), National Association of State Universities and Land-Grant Colleges (NASULGC), American Council on Education (ACE) and other national and international conferences.

Definitions, Procedures and Guidelines
Previous Contents System Overview Rule 3301-14-01 contains specific guidelines, requirements and administrative procedures requiring interpretation. Specific authorities and responsibilities, provided by the Department through the Division of Information Management Services, include but are not limited to the following: Scope All public school districts are subject to the provisions of Rule 3301-14-01: "The provisions of this rule shall apply to all city, county, local, exempted village, and joint vocational school districts and Ohio's designated data acquisition sites pursuant to Section 3301.0714 of the Revised Code." [Rule 3301-14-01(B)] System Objectives Rule 3301-14-01 emphasizes data definitions, collection and transfer procedures from the district to the Department, and end-user access. Specifically, the regulations:

    The Governing Board of the Hancock County ESC believes that every individual possesses the capacity and will to learn. We recognize that every learner has different abilities, needs and interest which affect their degree of learning and realize that this necessitates a varied curriculum and a stimulating environment.
    We also believe that it is our responsibility to develop a high quality educational service organization dedicated to providing administrative, curricular, instructional, pupil personnel, and professional development services to the schools of Hancock County by the most efficient and economical means possible. These services are primarily designed to assist boards of education, administrators, teachers, and other staff members of the local school districts so that they may develop into strong leaders in their schools and that the students may become socially and economically productive members of society.
    Therefore, to promote this belief, we recognize that it is our purpose to assist local school districts in developing educational programs that they deem necessary and compelling for the improvement of their schools and to provide leadership that is alert to the best educational practices of the day.
