September 21, 2005
The City of Bismarck did not violate state law when, as a prerequisite to considering an individual's proposal for an air charter service, the city requested the individual to address concerns expressed by the air charter operators and the individual held two meetings that were not open to the public. The meetings held were not meetings of the Bismarck City Commission or a committee of the Commission and, therefore, were not subject to the open meetings law.

Map Showing Louisiana Purchase (Pink) Courtesy: Library of Congress STATEHOOD: The land called South Dakota was purchased from France in 1803 as part of the Louisiana Purchase. Lewis and Clark visited parts of South Dakota with the Corps of Discovery as they made their way up the Missouri River in 1804 and on their return trip in 1806. Reports of an abundance of fur-bearing animals brought trappers and fur traders to South Dakota and led to the establishment of the first western settlements in the area. Between 1812 and 1834, South Dakota was part of the Missouri Territory but for twenty years, from 1834 through 1854, the eastern and western parts of the state followed separate paths. While western South Dakota remained a part of the Missouri Territory until 1854, eastern South Dakota became, alternately, part of the Michigan, Wisconsin, Iowa, and Minnesota territories. In 1854, western South Dakota became part of the Nebraska Territory. South Dakota began to come into its own when Congress created the Dakota Territory in 1861. Dakota Territory, named for the Native Americans of the area, consisted of present-day North and South Dakota and much of Montana and Wyoming. Yankton was the capital

    Although the state income tax pulls in relatively little money, the tax structure is generally well balanced and the revenue picture has been aided by recent increases in oil and gas prices. Employee pensions are almost fully funded. Budgeters did rely on transfers from the state-owned Bank of North Dakota, as well as the use of some trust fund money for operating expenses in recent years, but the amounts involved were not alarming. In fact, the most significant fiscal negative in North Dakota is the lack of an active rainy day fund. The state Office of Management and Budget has maintained that such a fund is unnecessary given the ability to draw money from the Bank of North Dakota, but the state auditor has been critical of this policy, saying it puts both the state and the bank at risk.     The state has good mechanisms to deal with fiscal downturns, and recently added an Oil Trust fund to help even out the ups and downs of oil prices.
    CAPITAL MANAGEMENT: B
    North Dakota puts a lot of effort into looking ahead. A key component to that vision is the recent establishment of a new position, called the State Facility Planner. The planner lends his expertise to agencies that lack architectural staff and brings long-range perspective to the capital-planning process.
    HUMAN RESOURCES: B
    The positive impact of this is that agencies have long had the flexibility in hiring and making salary decisions that other states are now moving toward. The negative impact is that more centralized data would help work-force planning efforts. At the moment, managers have a hard time distinguishing between an employee who moves from one agency to another and an employee who moves to New Zealand. Decentralization results in some inefficiencies for job applicants as well. A person may have to apply over and over again to be considered for several different jobs in the state. Vacancies are centrally posted on the Internet, however, and a list-server function sends out a notice of new openings to anyone who cares to subscribe. The central personnel office has also started to coordinate job advertising.

    South Dakota Becomes a State Timeline
    United States Constitution ratified Dakota Territory created Capital moved to Bismarck South Dakota becomes a state Pierre wins permanent state capital State capitol finished Tribal governments set up Intertribal court of appeals started At first, there were only thirteen states. A new part of the country was called a territory. When enough people lived there, they could ask Congress to make it a state. There were good reasons for wanting statehood. People who lived in territories could not vote for their leaders. Their governors were not elected. They were appointed, or put in power, by the president of the United States. The people could not check the power of a governor by voting. Also, they could not elect members of Congress to vote for laws in Washington, D. C. This was a problem in Dakota Territory when Nehemiah Ordway was governor. Ordway and his political friends moved the capital out of Yankton. The year was 1883. Yankton was in the southern half of the territory. Most of the people lived in this area. Bismarck became the new capital. It was in the north and central part of the territory. The people could not vote the governor out of office to show that they were not happy. Leaders in the south thought it was time for a change. They asked Congress to make southern Dakota a state all by itself.
