Finally Released
On March 12, 1999, the US Department of Education, Office of Special Education Programs (OSEP) released the final federal regulations for the Individuals with Disabilities Education Act (IDEA) Amendments of 1997. School system personnel and parents have been anxiously awaiting the final regulations since the release of the "draft" regulations in October 1997 in hopes that the final document would provide further guidance and stop the debate about controversial sections of the law, for example, the discipline of students with disabilities. Also, the NC Department of Public Instruction, Exceptional Children Division could not finish revising the state PROCEDURES Governing Programs and Services for Children with Special Needs without the final federal regulations. The regulations of most interest to families are those related to Part B of IDEA. The following pages of this Special Edition NEWS LINE only provide an overview of the changes made between the "draft" and the final regulations. Previous newsletters described the new law and proposed or draft regulations. You can also request additional information on IDEA and regulations on our web site www.ecac-parentcenter.org

Teacher Education Mission Statement Admission to the Teacher Education Program
The Teacher Education Committee selectively admits and periodically evaluates students in the Teacher Education Program on the basis of scholastic aptitude and suitability for teaching. Admission into the University as a student does not automatically satisfy eligibility requirements for admission to the Teacher Education Program. Eligibility for admission into the Teacher Education Program will be determined by regulations current at the time initial application is made for admission into the program.     NORTH CAROLINA OFFICE-BASED SURGERY GUIDELINES Office-based surgery is surgery* performed outside a hospital or an outpatient facility accredited by the North Carolina Division of Facility Services. Although surgery is not a perfect science in any setting, office-based surgery is generally safe, effective, and efficient, provided proper measures are taken in the process. It is the position of the North Carolina Medical Board that the physician is responsible for providing a safe environment for office-based surgery.
    The following general guidelines are recommended for office-based surgery.
    • Training:
      Any procedures, whether done in an office or a hospital, should be performed by physicians operating within their area of professional training. Appropriate training and continuing medical education should be documented and that documentation should be readily available to patients and the North Carolina Medical Board. Those who perform office-based surgery must have plans, such as prearranged hospital admission protocols, for managing emergency complications.

    In the past decade North Carolina has experienced a rapid rise to the top of the meat producing states. Current USDA statistics have North Carolina number in one turkey production (59.5 million head on farm), number two in swine production (9.5 million head on farm), and number four in broiler production (681 million head) (World Wide Web address http://www.agr.state.nc.us/stats/nc_rank/ncrallyr.htm ). Even though the meat-animal industry contributes to the economic development of North Carolina, it is not without a perceived cost. The general belief among much of the nonagricultural community is that current production schemes have a negative effect on the environment as well as society. Recognizing the public's concern, the North Carolina state legislature and regulatory agencies have adopted rules and laws to minimize negative impacts to the environment and reduce any interference with the use and enjoyment of adjoining property. In 1993 the North Carolina Water Quality Nondischarge Rules became effective. Under the Nondischarge Rules, animal waste management plans are required for all farms meeting the definition of a feedlot.

  • Academic Credit for FWS Positions FEDERAL WORK STUDY: WHAT IT IS AND HOW IT WORKS The Federal Work Study (formerly known as the College Work Study) program dates back to the Economic Opportunity Act of 1964. It was originally intended to provide part-time employment for students from low-income families. The program became a student financial aid program when it was incorporated into the Higher Education Act (1965) in 1972. As such, it is a federal "Title IV" aid program. Federal Work Study (FWS) funds are allocated to East Carolina University on an annual basis, as part of the "campus-based aid program" funding process. ECU is required to match FWS funds so that 75% of a student's earnings are paid with federal funds and 25% of the earnings are paid with "other" funds. Currently, North Carolina State Education Assistance Authority provides some of the "other" funds and ECU provides the rest.

    NORTH CAROLINA
    State Law (effective 11-1-98), under House Bill 926 (new Sections 58-3-5 and 58-3-6 of Chapter 58 of the North Carolina General Statutes) appears to provide a "conditional exemption" (editor's words) from regulation for charitable organizations (described in section 501(c)(3) or section 170(c) of the IRC), or for "educational Institutions" (public or private colleges, universities and community colleges) from the North Carolina Attorney General's opinion that only charities that qualify as "insurance companies" may issue gift annuities in North Carolina. Charity has been in continuous operation for at least 3 years and has "a minimum of $100,000 in unrestricted cash, cash equivalents or publicly traded securities, exclusive of the assets contributed by the donor for the annuity agreement." A charitable gift annuity agreement issued after 11/1/98 must contain the following wording: "This annuity is not issued by an insurance company, is not subject to regulation by the State of North Carolina, and is not protected or otherwise guaranteed by any government agency or insurance guaranty fund." A public [501(c)(3) or Section 170(c)] charity or an educational institution that issues charitable gift annuity agreements shall notify the North Carolina Department of Insurance of their participation by 1/1/1999 or within 90 days of their issuing its first annuity, whichever date is later.

All Federal Requirements in the basic boating course apply to North Carolina; this section lists North Carolina Boating Requirements that are above and beyond Federal Requirements. Personal Flotation Devices: All recreational vessels must have one Type I, II or III PFD of a suitable size for each person aboard and each skier being towed. In addition, recreational vessels 16 feet and over must also have one throwable Type IV PFD. Required PFDs must be readily accessible. Speed Limits and Reckless Operation: Although local conditions may warrant the imposition of definite limitations on speed of vessels, a general speed limit is that which is implied in safe vessel operation under existing circumstances. Speed which is excessive under the circumstances, and which endangers persons or property, is one form of reckless operation which is prohibited by North Carolina boating law. Watercraft entering, leaving or passing within 50 yards of a state-owned or controlled boating and fishing access area must do so at "no-wake" speed.

Definitions.In this Article, unless the context otherwise requires, the following definitions shall apply: (5) "Physical therapy aide" means any nonlicensed person who aids in the practice of physical therapy in accordance with the provisions of this Article, and who at all times acts under the orders, direction, and on-site supervision of a licensed physical therapist or physical therapist assistant. An aide may perform physical therapy related activities which are assigned and are commensurate with an aide's training and abilities, but an aide's work shall not include the interpretation and implementation of referrals from licensed medical doctors or dentists, the performance of evaluations, the determination and modification of treatment programs, or any independent performance of any physical therapy procedures. Members shall be appointed to serve three-year terms, or until their successors are appointed, to commence on January 1 in respective years. In the event that a member of the Board for any reason shall become ineligible to or cannot complete a term of office, another appointment shall be made by the Governor, in accordance with the procedure stated above, to fill the remainder of the term. No member may serve for more than two successive three-year terms. The Board each year shall designate one of its physical therapist members as chairman and one member as secretary-treasurer. Each member of the Board shall receive such per diem compensation and reimbursement for travel and subsistence as shall be set for licensing boards generally.

    Authorizes private prisons. CHAPTER 8. PRIVATE PRISON FACILITIES Authorizes import of prisoners. Authorizes speculative building by contract with the county or municipal government of the site where the facility is to be located. Authorizes import of minimum to medium security inmates; out-of-state inmates must be screened/treated for tuberculosis and be HIV negative; inmates will not be accepted who have "a record of institutional violence involving the use of a deadly weapon or a pattern of violence while confined in a facility … or a record of escape or attempted escape…." ILLINOIS CODE Prohibits the state from contracting out the total operation and management of secure adult correctional facilities that house state inmates. KENTUCKY REVISED STATUTES ANNOTATED Authorizes the state to contract with private providers to establish and operate private prisons.
