    Federal Treasury Offset Program
    Purpose To provide information to all State departments and agencies on the Federal Management System debt collection procedures. Background The Debt Collection and Improvement Act of 1996 provides that any non-tax debt or claim owed to an agency of the Federal Government that remains unpaid for a period of 180 days shall be referred to the U.S. Department of Treasury for appropriate action. The Department of Treasury is empowered to withhold or reduce certain federal payments for the purpose of collecting delinquent non-tax debts owed to the Federal government. This collection process is known as "administrative offset" or "offset". Before referring a debt for collection by administrative offset, the Federal creditor agency must provide each debtor with: (a) a written notification of the nature and the amount of the debt, the intention of the agency to collect the debt through administrative offset, and an explanation of the debtor's rights; (b) an opportunity to inspect and copy the records of the agency; (c) an opportunity for review within the agency; and (d) an opportunity to enter into a written repayment agreement.

    Website: www.ocfs.state.ny.us The Office of Children and Family Services (OCFS) was officially created on January 8, 1998, by merging the programs of the former state Division for Youth, the developmental and preventive children and family programs administered by the former state Department of Social Services, and the Commission for the Blind and Visually Handicapped. OCFS was created to improve the integration of services for New York State's young people, its vulnerable adult populations, and families in need of strengthening; to promote their development; and protect them from violence, neglect, abuse, and abandonment. The agency provides a system of family support, juvenile justice, and child welfare services with a funding level of $3.6 billion for programs that support the safety and well-being of children and adults. OCFS has wide-ranging responsibilities for the provision of services to children, youth, families, and vulnerable adults. The agency is responsible for programs and services involving foster care, adoption and adoption assistance; child protective services, including operating the Statewide Central Register for Child Abuse and Maltreatment; preventive services for children and families; services for pregnant adolescents; child care and referral programs; and protective programs for vulnerable adults. Additionally, the agency is responsible for all elements of the state's juvenile justice programs, administering and managing 34 residential facilities for over 2,000 youth remanded to the agency's custody by family and criminal courts. OCFS also coordinates, in part, the state government response to the needs of Native Americans and their children on reservations and in communities.

    What public purpose-funded energy efficiency programs are available in my state?
    In 1998, as part of restructuring, the New York State Public Service Commission (PSC) designated the New York State Energy Research and Development Authority ( NYSERDA ) as the administrator of funding for energy-efficiency and load management programs. These programs, collectively known as the New York Energy $mart Programs, are paid for through a System Benefits Charge (SBC) on the electricity transmitted and distributed by five of the state's investor-owned utilities. In January 2001, the PSC extended these programs through June 2006, and increased the total annual public benefits funding to $150 million, including $83 million for energy efficiency and load management. Customers of ConEdison, Orange and Rockland, Niagara Mohawk, New York State Electric and Gas, Central Hudson Gas and Electric, and Rochester Gas and Electric are eligible for NYSERDA programs. Customers of Long Island Power Authority and New York Power Authority should refer to the section below on utility energy efficiency programs. There are a number of commercial and industrial NYSERDA programs that may be of interest to federal customers.     Even so, the capital management picture has improved in the Empire State. The state is finally paying attention to maintenance funding, both in facilities and transportation. Bridge maintenance is a particular priority, which is sensible because New York bridges are among the worst in the nation; about 20 percent are structurally deficient and an additional 21 percent are functionally obsolete, based on Federal Highway Administration data.

    Despite solid leadership from the top levels of the Pataki administration, many rigid and unsound practices remain. Managers are limited in their ability to hire and promote, and the hiring lists they receive can be too old for successful use. Removing an employee with performance problems is an arduous and time-consuming task; the state terminated a minute 0.4 percent of employees in fiscal 1999. Technology to provide online training has been a plus. But there was a hitch in the training budget in fiscal year 1999. Labor agreements expired. Unions went months without contracts. And during this time, the training money that usually stems from collective-bargaining agreements dried up.

    Public Editor
    The New York Times Calame retired at the end of 2004 as a deputy managing editor of The Wall Street Journal. His responsibilities included paper-wide quality control, maintaining and monitoring reporting and ethical standards, and taking charge of the Journal in the absence of the managing editor. Calame, who is 66 years old, had joined the Journal in September 1965 and worked as a reporter in New York, Los Angeles and Washington, D.C., before becoming a bureau chief in Pittsburgh in 1974. He returned to Los Angeles as bureau chief in September 1978 and in 1985 became an assistant managing editor in charge of West Coast coverage. He returned to New York as a senior editor in 1987, and in May 1992, he became the deputy managing editor.
