Produced by New York Congress of Parents and Teachers, Inc. (NYS PTA) and New York State United Teachers (NYSUT) All Students Can Learn Every child can learn. Across New York State, children with disabilities are learning and achieving at unprecedented levels. Some children with disabilities need special education programs and services or other supports to help them learn. The Federal Individuals with Disabilities Education Act (IDEA) establishes a prominent and active role for parents and teachers in planning and implementing educational programs for eligible students with disabilities. Parents and teachers, working collaboratively with other school staff, play critical roles in helping students become contributing individuals in adult society. Sometimes special education policies and procedures can seem overwhelming to parents, teachers and school personnel. Take heart: The information provided in this guide can help you participate meaningfully in a child's educational program. General Information A student with a disability has a mental, physical or emotional impairment that affects his or her educational performance and requires special services and programs. In New York State, special education is provided for preschool students (ages 3 to 5) and school-aged children (ages 5 through 21.) For school-age children, disabilities that may require special education services include autism, deafness, deaf-blindness, emotional disturbance, hearing impairment, learning disability, mental retardation, multiple disabilities, orthopedic impairment, other health impairment, speech or language impairment, traumatic brain injury, or visual impairment (including blindness).

Special education means specially designed instruction, services or programs, provided at no cost to the parent, to meet the unique needs of students with disabilities. Special education services and programs may be provided individually to a student or in a group with other students with similar educational needs. Each school district's Committee on Special Education makes recommendations about appropriate special education services and programs, which are described in detail in a written plan for each child, known as the Indivdualized Education Program (IEP). Special education may include specially designed instruction or supplementary instruction and services provided in the general education class, help from a consultant teacher, resource room programs, special classes, home and/or hospital instruction or programs and services provided in other public or private schools.

    July 25, 2005 SONY SETTLES PAYOLA INVESTIGATION Company Acknowledges Problems; Agrees to Sweeping Reforms Attorney General Eliot Spitzer today announced an agreement to halt pervasive "pay-for-play" in the music industry. Under the agreement, SONY BMG MUSIC ENTERTAINMENT, one of the world's leading record companies and owner of a number of major record labels, has agreed to stop making payments and providing expensive gifts to radio stations and their employees in return for "airplay" for the company's songs. Such payoffs violate state and federal law. "Our investigation shows that, contrary to listener expectations that songs are selected for airplay based on artistic merit and popularity, air time is often determined by undisclosed payoffs to radio stations and their employees," Spitzer said. "This agreement is a model for breaking the pervasive influence of bribes in the industry."

    By JEFFREY GOLDBERG - New York Times, June 25, 2000 A bout two hours east of the Khyber Pass, in the North-West Frontier Province of Pakistan, alongside the Grand Trunk Road, sits a school called the Haqqania madrasa. A madrasa is a Muslim religious seminary, and Haqqania is one of the bigger madrasas in Pakistan: its mosques and classrooms and dormitories are spread over eight weed-covered acres, and the school currently enrolls more than 2,800 students. Tuition, room and board are free; the students are, in the main, drawn from the dire poor, and the madrasa raises its funds from wealthy Pakistanis, as well as from devout, and politically minded, Muslims in the countries of the Persian Gulf. The students range in age from 8 and 9 to 30, sometimes to 35. The youngest boys spend much of their days seated cross-legged on the floors of airless classrooms, memorizing the Koran. This is a process that takes between six months and three years, and it is made even more difficult than it sounds by the fact that the Koran they study is in the original Arabic. These boys tend to know only Pashto, the language of the Pathan ethnic group that dominates this region of Pakistan, as well as much of nearby Afghanistan. In a typical class, the teachers sit on the floor with the boys, reading to them in Arabic, and the boys repeat what the teachers say. This can go on between four and eight hours each day.

    Inclusion Initiative, New York City
    The Inclusion Initiative (formerly called the Early Childhood Initiative) in New York City is an early childhood and elementary program that combines general education students and children with special needs in the same classroom. Funded by New Visions for Public Schools , the program emphasizes team teaching of special education and general education teachers, heterogeneous mixing of students, developmentally appropriate practice, authentic assessment, parent and family involvement in children's learning, and professional development. In addition to combining early childhood education and special education, some of the classrooms taking part in the initiative also are bilingual. The overall goal of the program, according to Rodriguez (1997), is "to create child-centered learning environments that encourage early school successes for all students and to eliminate tracking that occurs as children with diverse strengths and needs progress through the city school system" (p. 1). She adds that the program model includes "not only the full range of general education studentsfrom struggling to excelling studentsbut also students with a wide range of special education designationsfrom mild to severe" (p. 2). The special-needs students are fully integrated into the classroom with its challenging curriculum and high standards. In each classroom, the use of team teaching (a general education teacher and a special education teacher), a classroom assistant or paraprofessional, and smaller class size allows the teachers to provide individualized attention to each student.
