DOE Modifies Special Education Regulations Parental consent, IEP team accord and timely documents are some areas that require compliance. By Cherie L. Maxwell, Esq. ONCE AGAIN THE DEPARTMENT OF Education has revisited and revised Title 6A:14 of the New Jersey Administrative Code dealing with special education. Some of the changes may have a far-reaching impact on districts and must be carefully reviewed to assure prompt compliance. Parental Consent to Initial IEP One of the most significant changes in the special education code is reflected in an August 21, 2001 memorandum issued by Barbara Gantwerk, director of the Department of Education’s Office of Special Education Programs.1 In response to a review by the U.S. Department of Education, New Jersey has been directed to modify the code that addresses parental consent during initial evaluation procedures.2 While the long-standing rule in New Jersey has been that a district may (and should) use due process or mediation procedures when a parent refuses consent for an initial evaluation and/or refuses initial implementation of an individualized education program, the federal Department of Education has interpreted the federal regulations to mean that a board of education may not use due process procedures in these cases. This change is effective immediately. This means that a board of education no longer has the ability to file a due process petition to seek implementation of an initial IEP if the parent withholds consent. The practical effect of this modification is that a district can evaluate, determine eligibility and recommend a program, but unless the parent agrees, it can do nothing to implement the IEP program and services for the student. Clearly, this position runs counter to the historic position of the New Jersey Department of Education, which has encouraged districts’ efforts to assure that each student with a disability receives appropriate services.

Synopsis of Services Publications Resources Selected Articles from School Leader C a p i t o l w a t c h By Thomas McGough and Robert Woodruff The Role of the NJ State Board of Education The New Jersey State Board of Education develops statewide policy for public education and makes decisions that impact the state's 2,500 schools serving over 1.25 million students from preschool through grade 12. As we begin the new millennium, the state board realizes that our task is to provide opportunities for all students to receive an education that will prepare them to be competitive in the international marketplace of the future. In order to be successful, we need to have an ongoing dialogue with parents, teachers, administrators and local board members. The purpose of this article is to give an overview of the role of the state board and some examples of how we meet our statutory responsibilities for public education in our state. The thirteen state board members are appointed by the governor with the advice and consent of the state Senate. Members serve without compensation for six-year terms. By law, three members of the state board must be women, and no two members may be appointed from the same county. The commissioner of education is secretary of the board and serves as its official agent for all purposes. Since 1978, the board has also included a nonvoting student representative, chosen annually by the New Jersey Association of Student Councils.

Permitting the self-administration of medication by a pupil for asthma or other potentially life-threatening illnesses in the public schools of New Jersey has always been controversial. This has led to many "close calls" when medication conditions require immediate action, but the school nurse was unavailable. On April 19, 2001, a new law in New Jersey was enacted which addresses this problem. That law is reprinted below. Note that the act shall take effect on the 180th day after enactment, but the Commissioner of Education may take such anticipatory administrative action in advance as shall be necessary for the implementation of the act.

What is IDEA
The Individuals with Disabilities Education Act (IDEA) was signed on June 4, 1997, by President Bill Clinton. This was the first major revision to the Act in more than 23 years (since the enactment of P.L.94-142, the Education of all Handicapped Children Act of 1975). This law guarantees all children with disabilities access to a free and appropriate public education. This Act strengthens academic expectations and accountability for the nation's 5.8 million children with disabilities and bridges the gap that has too often existed between what children with disabilities learn and what is required in regular curriculum. EC PHARMACY UPDATE
In 2004, Assemblyman Anthony Chiappone introduced a bill, A 2714 , to permit pharmacists who work under a protocol to provide emergency contraception directly to women. The bill says that pharmacists must work under a protocol, put the pharmacist and the physician name on the prescription, and must send the file to the physician for review right away. The bill has been referred to the Assembly Health and Human Services Committee, but has not been heard. In June 2003, both houses of the New Jersey legislature passed a passed a new Pharmacy Practice Act, but authority was not granted to pharmacists to initiate EC. Planned Parenthood Affiliates of New Jersey sees EC as a priority but formal outreach to pharmacists or surveys has not been conducted at this time. Back to top

IDEIA 2004
Now that President Bush has signed the Individuals with Disabilities Education Improvement Act of 2004 (IDEIA) parents, teachers and school administrators can expect to see changes in special education regulations. But exactly what those changes will be and how they will impact the children of New Jersey has yet to be determined. While most of IDEIA becomes effective on July 1, 2005, some provisions of the law will not go into effect in New Jersey, because the current New Jersey Administrative Code (NJAC) provides greater protection to students and their parents then IDEIA. On June 3, 2005 The New Jersey Office of Special Education Programs issued “Guidance for Implementation of the IDEIA 2004” which is intended to interpret the provisions of IDEIA and NJAC
US Supreme Court to Hear Special Education Case:
The U.S. Supreme court has scheduled to hear the case of a Maryland teenage special education student on October 5, 2005. At the heart of the case, Schaffer v. Weast, is who bears the legal burden of proof when parents and school districts disagree over services of a classified student. While IDEA includes both parents and school officials on the IEP teams, the law does not specify which side has the burden of proof in an administrative hearing when the two sides disagree. Currently 5 of the federal appeals courts have recognized that school districts bear the burden of proof while others courts have held that parents bear the burden when they are the parties challenging the IEP. In papers filed with the Supreme Court Schaffer’s family, says the 6.5 million children who receive special education services under IDEA deserve national uniformity. This is exactly what 13 states have asked the high court to do in a friend of the court brief. The states do not express an opinion on how the court rules, just that they do.

Good afternoon. My name is Braden Hexom, and I am the Legislative Affairs Director for the American Medical Student Association. I am also a medical student and have recently completed my third year at the Medical College of Wisconsin. The American Medical Student Association is the oldest and largest independent, student-governed organization of medical students. We represent nearly 50,000 physicians-in-training and have chapters in all four New Jersey medical schools. For over 50 years, we have been committed to representing the concerns of physicians-in-training and improving medical education and the nation's health. The issue of limiting resident physician work hours is not new. For almost a century, resident physicians have been a source of efficient and inexpensive labor for hospitals. Forcing residents to work to the point of exhaustion puts patients at risk and prevents them from performing their primary responsibility: learning how to become a competent and caring physician.
