State Regulation of Private Schools - June 2000
New Jersey
Registration/Licensing/Accreditation: New Jersey law places registration requirements on a limited category of private schools that are not operated by charitable institutions or religious denominations, i.e. for-profit nonsectarian private boarding schools established after 1920 and private schools charging tuition for certain vocational education. This limited category of schools must obtain a certificate of approval from the Commissioner of Education to legally operate within the state. N.J. Rev. Stat. 18A:69-1 et seq Recordkeeping/Reports: Length of School Year/Day: Curriculum: Special Education: et seq Health: Safety: Transportation: The New Jersey Constitution declares that the state legislature may, within reasonable limitations as to distance, provide student transportation (ages 5-18) to and from any school. New Jersey Const. Art. 8, 4, par. 3. Home Schooling: New Jersey does not have a code that addresses the area of home schooling. New Jersey?s compulsory education law states that every child between the ages of six and 16 must attend a public or private school, or receive "equivalent instruction elsewhere than at school". N.J. Rev. Stat. § 18A: 38-25. Responsibility for enforcing the compulsory education law rests with the local board of education. When a school board has reason to believe that a parent or guardian is not complying with the compulsory education law, the local board of education can initiate truancy proceedings in municipal court, requiring parents or legal guardians to document their activities in providing "equivalent instruction". N.J. Rev. Stat. §§ 18A: 38-27 through 18A: 38-31.

Testimony
by NJEA Secretary Treasurer Joyce Powell on the Special Education Code
Before the New Jersey State Department of Education on
April 17, 2001
Good afternoon. My name is Joyce Powell, and I am the secretary-treasurer of NJEA. On behalf of NJEA’s 162,000 members, but most importantly on behalf of the thousands of special education students and our members who work with them, I want to thank you for the opportunity to speak to you today regarding the Special Education Code. I wanted to begin by thanking you for listening to the concerns raised by the many organizations that testified before you on the special education regulations. As an officer of NJEA and a special education teacher, I’m sure you can understand how important these regulations are to me. We appreciate your efforts in making significant changes that code. Over four years ago, when the concept paper was first introduced, I appeared before you with serious concerns about the direction that this state appeared to be taking with respect to special education. I am pleased that by working together with the department and many other organizations, many of the adopted regulations ensure that our special education students receive the services that they need.

Timelines to complete college programs
In addition to the proposed amendments, N.J.A.C. 6A:9-10.1(l) gives matriculated students in all other programs offered by colleges and universities in New Jersey until September 1, 2007 to complete the requirements for certification under the former regulations. New Jersey teachers enrolled in programs in states that border New Jersey should have the same window of time to complete the programs they started before the adoption of the new regulations that matriculated students in New Jersey programs are provided in N.J.A.C. 6A:9-10.1(l). Therefore, the Association recommends that Subchapter 10 of the discussion regulations, N.J.A.C 6A:9, Professional Licensure and Standards be amended to include candidates who complete an approved program at an out-of-state college or university by September 1, 2007. This additional flexibility will increase the pool of certified teachers in special education, bilingual education, school counselor and speech language pathology among others. It will also mitigate the element of unfair surprise for these teachers.

The Right to Special Education
in New Jersey

A Guide for Advocates
Acknowledgments This manual was written by Ellen Boylan, senior attorney at Education Law Center, with contributions by her colleague, Elizabeth Athos, and the attorneys at Education Law Center-Pennsylvania. Additional assistance in the preparation of this manual was provided by Education Law Center attorneys, Ruth Lowenkron and Elisabeth Yap. About the Education Law Center Education Law Center (ELC) was established in 1973 to advocate on behalf of New Jersey's public school children for access to an equal and adequate education under state and federal laws. ELC works to improve educational opportunities for low-income students and students with disabilities, through public education, policy initiatives, research, communications, and when necessary, legal action. ELC currently operates two projects to improve education for New Jersey's children: the Student Rights Project (SRP) and the Abbott Schools Initiative (ASI). SRP provides free legal representation to school children who are denied access to an adequate or appropriate public education. The types of cases accepted by SRP include: special education for children with disabilities, school discipline, school district admissions, and other violations of individual student rights. SRP is the only legal services program in New Jersey, and one of very few across the country, that specializes in education law.

New Jersey requires the parent to provide their children with an education, either in a private school, the public schools or elsewhere. You should maintain records or documentation that shows you are providing your homeschooled children with equivalent instruction as in the public schools. However, New Jersey homeschoolers do not have to notify the school of their curriculm or to present it for approval even if asked. There is no requirement in the law that states that the parents have to initiate notification to the school district of their intent to homeschool.
