102. Fed-Soc.org - NJ Tax Court Maintains Churches' Tax Exemption - Winter 1998
NJ Tax Court Maintains churches’ Tax Exemption *Christopher John Stracco is a partner in Morristown, new jersey’s Pitney, Hardin,
http://www.fed-soc.org/Publications/practicegroupnewsletters/religious liberties
Christopher John Stracco, Esq.* In its decision the court initially set out the three-tier test for qualification for a property tax exemption under New Jersey tax law:
  • The organization claiming the exemption for the property must be organized exclusively for the exempt purpose;
    The property must actually and exclusively be used for the exempt purpose; and the owner entity must not operate or use its property for profit.(2)
The Tax Court noted that the New Jersey exemption statute "only requires actual and exclusive use and does not impose a de minimis test on entitlement to religious worship or religious purposes exemptions."(6) The Court found that the New Jersey statute was consistent with the favorable treatment of religious institutions in New Jersey which are protected by three separate provisions of the New Jersey Constitution, one of which specifically requires the granting of exemptions from taxation for property exclusively used for religious purposes.(7) In upholding the tax exemptions on the properties in question, the Tax Court held as follows: To measure the quantum of religious use of a completed building as a condition of granting a tax exemption would engage the courts in an improper evaluation of religious practice....once [a property is] occupied and used...the failure to grant exemptions would be inappropriate.

From The Eight Old Swedes' Churches of New Sweden by Rev. Dr. Kim-Eric Williams New Sweden Center, Wilmington, DE 1999 (Republished with the author's permission) Trinity Episcopal Church (photo: Christina Lassen) Considerable trouble from Moravian dissenters caused a division in the congregation and the establishment of the Zion Moravian Church of Oldman's Creek, south of Swedesboro, in 1743 (present building, 1786) and a chapel on the Maurice River (Port Elizabeth) in 1746. Trinity Episcopal Church (photo: Christina Lassen) In 1988 a log cabin outbuilding from a Swedish farm (the VanLear-Schorn Log Cabin) was moved to the north end of the cemetery in the park. The roof of the church was restored and strengthened in 1996, and the steeple is currently being restored. None of the original furnishings remain, but a Colonial atmosphere is carefully maintained. Among the principal treasures of the congregation is the 18th century silver communion service. Many original Swedish and Finnish colonists are buried in the cemetery, including Peter Gunnarson Rambo, a Justice for William Penn under English rule. On the exterior of the building are the initials of many who worked on the erection of the church, but Nils Collin's carved words, "Gloria Deoll - to the Glory of God - remain as perhaps the best summary of the work of the congregation.

UMCOR sends 30,000 pounds of supplies to New Jersey
Date: September 24, 1999 NEW YORK Flood victims in the Bound Brook, N.J., area are benefiting from 30,000 pounds of cleaning supplies donated by the United Methodist Committee on Relief (UMCOR). The supplies , which arrived Sept. 25, included a thousand mops, brooms and flood buckets full of cleaning items, along with paper towels, cleaning solutions and bleach. The items were shipped by truck from the UMCOR Depot in Baldwin, La. The downtown section of Bound Brook was nearly submerged when rains from Hurricane Floyd caused the Raritan River to overflow on Sept. 16. Efforts to rescue residents trapped in their homes involved hundreds of National Guard troops, police officers, firefighters, six helicopters and numerous boats. United Methodists have joined with other churches and synagogues in the area to bring both spiritual comfort and physical healing to those affected by the disaster, according to United Methodist Bishop Alfred Johnson, New Jersey Area. The Rev. Aida Fernandez, serving as interim disaster response coordinator for both the Northern and Southern New Jersey United Methodist Conferences, told United Methodist News Service she has been impressed by the ecumenical effort.

Ceremony brings rift to N.J.
Monday, November 22, 2004
MEL EVANS / THE RECORD Bishop William J. Skilton of South Carolina performing the confirmation service Tuesday at St. Anthony of Padua Church in Hackensack. The confirmation service was like any other in the Episcopal Church: A procession of teenagers filed into a Hackensack church on Tuesday night as the choir sang "hallelujah" and parents smiled, waved and clicked their cameras from the pews. He wasn't even from New Jersey. The cleric, dressed in white and gold vestments, who celebrated the sacrament of confirmation before about 325 people, was a conservative churchman from South Carolina who had arrived in Hackensack just hours before the ceremony. Bishop William J. Skilton's official visit to St. Anthony's - a parish under the authority of Croneberger - served notice that the battle for the soul of the Episcopal Church has hit home in North Jersey. The congregation had sought an outside bishop to perform pastoral duties as a way to signal its discontent.
