A 50 State Survey of Requirements for the Education of Language Minority Children
November 1997
By Anita Garcia and Cynthia Morgan Ms. Garcia and Ms. Morgan are Adjunct Fellows at the Center for Equal Opportunity in Washington, D.C.
Ms. Garcia is also a scholar at the University of California at Berkeley for the Foundation for Teaching Economics.
Ms. Morgan is also an Ashbrook scholar at Ashland University. Introduction Schools around the United States are now faced with education a growing number of children who lack basic English skills. According to the National Clearinghouse for Bilingual Education , there are 2,437,723 Limited English Proficiency students in the U.S.1 Only a few years ago, many schools had never dealt with a language minority child. Today, an increasing number do. The challenge of providing a quality education to all students is doubled when schools must also teach a child an entire new language as well as academic courses. Over the last 30 years, elected officials, education agencies, and the courts have established guidelines for the education of these students. Federal requirements allow states a wide deal of latitude in selecting the most effective programs for their limited-English-proficient (LEP) students. Many states have enacted their own laws governing the management and style of programs for LEPs. These laws have been developed in cooperation with, or under coercion from, federal agencies and/or activist organizations. The result has been a patchwork of laws and regulations that can vary greatly from state to state.

The unlicensed teachers must have either a bachelor?s or master?s degree with verified full-time or supervised experience. Recordkeeping/Reports: Private elementary and secondary schools may not permanently admit a student until the parent/guardian furnishes a birth certificate or other proof of the child's identity, and if applicable, the students prior school records. Children must be admitted to a school under the name appearing in the identifying documents, unless the parent/guardian furnishes a court order to the contrary or the child is in the custody of the welfare division. If the parent/guardian fails to furnish identifying documents within 30 days of conditional admission, the principal must notify the local law enforcement agency and request a determination whether the child has been reported missing. Nev. Rev. Stat. 394.145. Curriculum: Health: Safety: Transportation: Home Schooling: A child may be excused from compulsory attendance requirements when written evidence is provided to the board of trustees of the county school district that the child will receive equivalent instruction. Opinion No. 98-25 SCHOOL DISTRICTS: MOTOR VEHICLES: PRIVATE SCHOOLS:
The 11 to 15 person van may be used by private or public schools to transport students to extra curricular activities only under certain circumstances. The words "regularly operated for the transportation of children" in NRD 484.148 does not mean "operated daily for the transportation of children."
Dr. Keith Rheault
Deputy Superintendent

Department of Education
700 East Fifth St.
Carson City, NV 89701-5096
Dear Dr. Rheault: You have asked the Attorney General for an opinion regarding numerous issues raised by private and public schools within Nevada concerning use of passenger vans designed to carry 11 to 15 persons to transport pupils for school-related activities. You have asked the following questions: QUESTION ONE May a public or private school legally use vans designed to carry 11 to 15 persons that are owned or leased by a private school or public school district to transport students to school-related events on a less than regular basis if the van does not meet school bus standards pursuant to the State Board of Education regulations regarding school buses? ANALYSIS TO QUESTION ONE The answer to your question focuses on the definition of "school bus" and whether an 11 to 15 person van fits within that definition. The education chapters of the Nevada Revised Statutes do not define a school bus. However, state law defines a school bus in the chapters of the Nevada Revised Statutes related to traffic safety and driver's licenses and for purposes of this opinion we adopt that definition.

What are the nevada statutes regarding compulsory education? Under nevada law and regulation a parent of a homeschooled child takes full responsibility
http://www.nevadahomeschoolnetwork.com/laws.html
NV Homeschoolers are governed by Nevada Revised Statute 392.070 and its counterpart in Administrative Codes NAC 392.011-.065 which pertain to the exemption from compulsory attendance laws. As described in NRS 392.040 children in Nevada are required to attend public school between the ages of 7 and 17, unless they receive a waiver of exemption.
In December 2002, homeschoolers went before the State Board of Education to clarify, lessen, and streamline many of the Administrative Codes regarding homeschooling in NV. Two years later, on Oct 23rd, 2004 homeschoolers again went before the State Board of Education to make some changes and again, won those changes. Finally, on December 4, 2004 homeschoolers again won some new wording in the NACs. Hopefully we're done for awhile! While the new changes are effective immediately, it may take some time to get all the districts and their staff members aware of them. You may read the new NAC's here: NAC's Dec 4, 2004
In order to notify the school districts of your Intent to Homeschool, you may use NHN's form found here: NHN's Intent Form, October 2004

The Individuals with Disabilities Education Improvement Act (IDEA 2004), 20 U.S.C. 1400 et seq., provides federal funds to assist state and local agencies in educating disabled children. IDEA 2004 conditions the receipt of such funds upon a state's compliance with certain goals and procedures. State legislatures and departments of education have enacted statutes and promulgated regulations respectively to ensure compliance with IDEA 2004 requirements. IDEA 2004 and its implementing regulations require schools to conduct functional behavioral assessments (FBAs) but provide little to no guideance on what an FBA is or how to conduct one. State laws and regulations are filling the gap. To learn about your state's FBA requirements, follow the links below and contact your State Department of Education directly. 36. Issue Brief: Too Cool For School
As nevada children return to school over the next few weeks, NHERI study found that excessive regulations do not produce a better education for students
http://www.npri.org/issues/issues97/too_cool.htm
Examining Issues Facing Nevada August 20, 1997 Too Cool for School By D. Dowd Muska A Why Home School? Parents who choose to educate their children at home do so for a variety of reasons. The majority continues to home school due to religious motivations, but more and more parents choose to teach their own children to avoid the bureaucratic, union-dominated public education system. Other parents have removed their children from private schools that did not have the means or ability to teach students with special needs. "There are many motives for opting out of traditional public or private education," writes mother Susan Olasky, who home schools her children in Austin, Texas. "But there is one result: a trend toward schooling that is decentralized, personal and entrepreneurial." Student Achievement Spending Home schooling has produced even more evidence that education spending has no correlation whatsoever with student performance. An average of $546 is spent on each home-school child. By comparison, public schools spend an average of $5,325 per student. Thus, home-school students score significantly higher on standardized tests than public school students, at 10 percent of the cost. Laws and Regulations recently reported that Nevada home schoolers must "fill out a request to be exempted from the state’s compulsory attendance law. That form must include the methods parents plan to use to teach their children, a curriculum, list of materials, goals for each child in each subject and the days of each month they plan to hold school." Yet the NHERI study found that excessive regulations do not produce a better education for students taught at home—scores remained the same in all states, regardless of the level of regulation. "Legitimate questions may be asked," writes Ray, "concerning the purpose of such regulations since there is no apparent effect of student learning." Mark Brandly of the Ludwig von Mises Institute goes even further: "The only real function of regulations is to deter and hamstring parents."

37. Issue Brief: What Is A Charter School?
Discussions of education reform often include the term charter schools, but The nevada bill exempts these schools from state and local regulations
http://www.npri.org/issues/issues97/charter_schools.htm
April 15, 1997 What is a Charter School? By Erica Olsen D The Charter Schools Model This nine-component model is what charter school advocates might call the "ideal type" of charter school law. The model is outlined below with an analysis of the Nevada bill as it pertains to each component.
  • The actors permitted to organize a charter school. Anyone from a group of teachers to community leaders may start a charter school. The Nevada bill allows teachers, parents, other citizens, non-profit organizations and businesses to be operators, also called the governing body. The sponsoring body. The model specifies that more than one type of public authority should be eligible to sponsor a charter school. The Nevada bill allows district school boards or the University Board of Regents to be sponsoring bodies. The legal status . Charter schools are non-sectarian public schools that exist independent of a school district. Such schools are legally and fiscally autonomous entities, free to make their own decisions regarding school operations, including matters such as curriculum, personnel and contracting for services. The Nevada bill allows state funding, if approved, to go directly to the charter school and bypass the district, allowing the governing body to control finances. However, if the school receives state money, the governing body is required to do an annual fiscal audit for the Department of Education and the legislature. On the curriculum side, the bill only requires charter schools to adhere to core curriculum set by the State Board of Education. Other class requirements are left up to the governing body.

Compliance A critical component of the overall mission of the University of Nevada Intercollegiate Athletics programs is a strong commitment to rules compliance as established by the National Collegiate Athletic Association (NCAA), the Western Athletic Conference (WAC) and the University of Nevada. Nevada will comply with the rules and regulations of those organizations in the conduct of its intercollegiate athletics programs. Our program educates and monitors staff, coaches, student-athletes and representatives of athletics interests to assure compliance. At Nevada, compliance oversight is accomplished via the Athletic Director, a compliance team, and a designated Coordinator of Compliance. To maintain a system of checks and balances, two members of the compliance team's four-person executive committee have reporting lines directly to the University's President. The Coordinator of Compliance handles the majority of the daily compliance functions, with the compliance team reviewing those functions and focusing on education and strategic planning. The Athletic Director has the responsibility for the conduct of Nevada's Intercollegiate Athletics program. The Compliance Team is made up of eight members, including the Associate Athletic Director/Senior Women Administrator (SWA), Assistant Athletic Director for Student Services, Faculty Athletic Representative (FAR), Coordinator of Compliance, Associate Director of Admissions and Records, Director of Student Financial Services, Manager of Student Accounts in the Controller's Office, and the Chair of the Intercollegiate Athletics Board.
