THE BOARD OF EDUCATIONAL LANDS AND FUNDS In the Enabling Act of Congress passed April 19, 1864, pursuant to which Nebraska became a State on March 1, 1867, and as a condition of statehood, the federal government granted generally every section 16 and 36 in each township in Trust for the support of Nebraska's common (K-12 public) schools. The Trust nature, conditions and obligations of this grant are reflected in Article VII, Sections 6, 7, 8 and 9 of the Nebraska Constitution and have been recited in numerous decisions of the Nebraska Supreme Court including, for example, State ex rel. Ebke v. Board of Educational Lands and Funds, 154 Neb. 244 (l95l). Nearly 2.9 million acres have been acquired in Trust for the support of Nebraska's K-12 public schools and about 1.45 million of these acres have been sold to private sector owners. Approximately 85% of the deeded acres were conveyed pursuant to cash sales, or contractual purchase rights vested in the buyers, prior to 1900 and several decades before the Board of Educational Lands and Funds came into existence. In accordance with Article VII, Sections 7 and 8 of the Nebraska Constitution, the proceeds from all sales comprise part of the permanent school trust fund and all school trust funds are invested exclusively by the Nebraska Investment Council.

Proceeds from mineral royalties and land sales are deposited into the Permanent School Trust Fund, which is managed by the Nebraska Investment Council. The annual earnings (interest and dividends) from the Permanent School Trust Fund, less the investment management costs, are also distributed to the public schools each year. The Board of Educational Lands and Funds is required to manage and conduct all School Trust operations and activities consistent with mandatory fiduciary duty. Previous research has shown great disparity in property taxes among states, with Nebraska residents having some of the highest property valuations and taxes among top agricultural producing states and neighboring states. However, great disparities also exist within the state. This report examines the property tax burdens for Nebraska’s highest and lowest income counties. The data show that the heaviest property tax burdens occur in rural, agriculturally-dependent counties and counties with low per capita incomes. In terms of per capita income, Nebraska is home to five of the nation’s 15 lowest income counties – Loup, Blaine, Grant, Arthur, and McPherson. The data outlined herein demonstrate the regressive nature of the property tax when the lowest income areas of the state shoulder tax burdens over 200 percent greater than the highest income areas of the state.

About Tri County
Tri County Public School is a State and North Central Accredited K-12 school located in the country south of DeWitt, Nebraska. The towns of DeWitt, Plymouth, Swanton and rural districts consolidated in 1966 to form a district of 270 square miles of Jefferson, Gage, and Saline counties. The economic basis of the district is mainly agriculture, with some industry. Our K-12 student population is currently at 428 and we have 40 certified staff members. Our School is located 2 miles north of the Highway 103 and Highway 4 intersection. Click here to see a map! This web site has been up and running since August 1, 1996.
Mission Statement
The mission of Tri County Schools is to develop productive and responsible citizens who will live in a global society and who are adaptive and sensitive to both cultural and technological changes. The educational process at Tri County will insure and perpetuate an environment for learning in which each student can reach his or her maximum potential.

Taxes in Nebraska Users and Uses of Major State and Local Taxes Local Use K-12 Schools K-12 SCHOOLS AND PROPERTY TAXES T he three charts above focus on the largest user of the property tax dollars elementary and secondary education in Nebraska. As the first chart shows, property taxes in support of K-12 education have grown at less than the rate of growth in the economy, but more than the rate of inflation for the 20-year study period. The impacts of major school finance legislation in 1990 and 1997 are easily seen in the line chart. The bottom two line charts show data from 1995 to 2000. This is the period of time covered by the recent property tax relief initiative of the Legislature that included budget limitations, levy limits, school finance reform, and several other initiatives.
