Registration/Licensing/Accreditation Recordkeeping/Reports: On the third day of classes, in private, denominational, and parochial schools, the teachers shall send to the superintendents or administrator of the school a list of the pupils enrolled in his or her school with the age, grade and address of each. Neb. Rev. Stat. 79-205. Length of School Year/Day: Douglas v. Faith Baptist Church , 301 N.W.2d 571 (1981). Instruction in English: Instruction must be given in the English language in private, denominational and parochial schools. Neb. Const. Art. I, Sec. 27. Teacher Certification: Curriculum: Special Education: The Nebraska legislature may permit state and political subdivisions to contract with nonsectarian institutions for the education of disabled students. That style, in some cases, varies radically from one practitioner to another. In other instances, it may differ only in the pressure of touch or the scent of a lotion. Similarly, massage-license requirements can vary from state to state by as much as 750 hours of education, or by as little as a background check or an oral exam. But while diversity of technique among touch therapists keeps the field fresh, diversity in massage-licensing laws can pose obstacles for those moving to another state. Making reciprocity a reality should be one of the primary goals of massage regulation, according to ABMP. The massage association lists reciprocity among its recommendations for massage-and-bodywork legislation. According to Dolly Wallace, national government-relations committee chair for the American Massage Therapy Association (AMTA), more than half of AMTA members surveyed online says they had to meet additional requirements to get a massage credential in another state. Forty-four percent says it took more than three months to get the credential; 70 percent says they were required to sit for additional testing; and 47 percent says the process cost more than $200.

Ms. Garcia is also a scholar at the University of California at Berkeley for the Foundation for Teaching Economics.
Ms. Morgan is also an Ashbrook scholar at Ashland University. Introduction Schools around the United States are now faced with education a growing number of children who lack basic English skills. According to the National Clearinghouse for Bilingual Education , there are 2,437,723 Limited English Proficiency students in the U.S.1 Only a few years ago, many schools had never dealt with a language minority child. Today, an increasing number do. The challenge of providing a quality education to all students is doubled when schools must also teach a child an entire new language as well as academic courses. Over the last 30 years, elected officials, education agencies, and the courts have established guidelines for the education of these students. Federal requirements allow states a wide deal of latitude in selecting the most effective programs for their limited-English-proficient (LEP) students. Many states have enacted their own laws governing the management and style of programs for LEPs. These laws have been developed in cooperation with, or under coercion from, federal agencies and/or activist organizations. The result has been a patchwork of laws and regulations that can vary greatly from state to state.

Rule 20 and accompanying Guidelines

Title 92, Nebraska Administrative Code, Chapter 20: Regulations for the Approval of Teacher Education Programs and accompanying guidelines. Effective date: March 6, 2002. Rule 21
Title 92, Nebraska Administrative Code, Chapter 21: Issuance of Certificates and Permits to Teach, Counsel, Supervise, and Administer in Nebraska Schools. Effective date: December 21, 2003. Rule 22
Title 92, Nebraska Administrative Code, Chapter 22: Regulations Governing the Master Teacher Program. Effective date: January 13, 2002. Rule 22 was passed by the Legislature in 2000; however, no funds were appropriated to the Nebraska Department of Education for Rule 22. As stated in Rule 22, the purpose of the master teacher program was to "build a group of recognized teachers of high achievement in the teaching profession." Rule 23

The State Board of Education has the responsibility to grant, deny, or revoke approval of teacher education programs in 17 public and private colleges and universities. Rule 20, Regulations for the Approval of Teacher Education Programs and accompanying Guidelines, Guidelines Recommended for Use with Rule 20, and Rule 24, Regulations for Certificate Endorsements and accompanying Guidelines, Guidelines Recommended for Use with Rule 24, govern Nebraska teacher education programs. Rules 20 and 24 are first approved by the Nebraska Council on Teacher Education (NCTE). NCTE then recommends approval for Rule 20 and Rule 24 to the State Board of Education. After approval by the State Board of Education and Attorney General, Rules 20 and 24 become the basis for teacher education program approval state visits, which are conducted at each college or institution every seven years. After each state visit, the visitation report is reviewed by NCTE to determine compliance with Rules 20 and 24. NCTE, in turn, makes a recommendation to the State Board of Education to grant, deny, or revoke approval to the institution receiving a state visit. Teams made up of NCTE members and Nebraska Department of Education representative(s) conduct the state visits to Nebraska institutions of higher education. During the visitation process, the team reviews compliance with the requirements of Rules 20 and 24 for PreK-12 school personnel preparation programs.

Employee Classifications (Policy Regulation 4100.1) The Human Resources Division determines the job title and the classification of each employee taking into consideration relevant state laws and Nebraska Department of Education regulations. The descriptions below do not include every position within the district but indicate the general separation of employees into the three categories:
  • Certificated employees include teachers and other educators, as well as school psychologists, school social workers and registered nurses. Also included are administrators who perform duties requiring a certificate issued by the Commissioner of Education. We have now upgraded our dental program to 8.0. They will train the rest of the staff about the features of this program with our goal being that of having a "paperless" chart.

The focus  will be the reauthorization of IDEA in order to provide information regarding the implementation of the new requirements of IDEA 2004.  Major legal issues in special education along with interpretations of the U.S. Department of Education draft regulations will be presented and explored through keynote addresses and breakout sessions. Presenters include Melinda Baird, Jim Walsh, Julie Weatherly, and others. The registration fee for the conference is $150 per person.     Educational Guidelines
    As a reminder, all Medical Radiographers, Limited Radiographers, and Provisional Limited Radiographers, practicing in Nebraska, must document at least twenty-four (24) hours of continuing education, related to Medical Radiography, every two (2) years. Part 16.09, of the State of Nebraska Regulations for Control of Radiation-Ionizing, describes continuing education requirements for persons Performing Medical Radiography. The State may audit any renewal application, to determine if compliance of continuing education requirements are being met by the individual. Those selected for audit shall be required to produce documentation of his or her attendance at those continuing education activities listed on the renewal application. Therefore, documentation of continuing education is essential. At a minimum, the documentation necessary for acceptance by the State must include:
  • The Topic of the Program
  • The Name of the Provider
  • The Location of the Continuing Education
  • The Date(s) of the Program
  • The Number of Hours Received for the Program

All of the members of the Real Estate Commission were present except for Commissioner Paul Landow, who was absent and excused. Also present were Director Les Tyrrell, Deputy Director Teresa Hoffman, Deputy Director for Enforcement Terry Mayrose, and Administrative Assistant Heidi Burklund. Abbie Widger, Special Assistant Attorney General and Counsel to the Commission, was present for the Hearing in Complaint #1999-041. Notice of Meeting (Adopt Agenda) Director Tyrrell presented a Public Notice and Proofs of Publication thereof relating to this Meeting, all of which are attached to and made a part of these Minutes. Chairperson Moore reported that all Commissioners had been notified of the Meeting simultaneously, in writing, and that a proposed Tentative Agenda accompanied the notification. Chairperson Moore pointed out to those in attendance that a A Public Copy of the materials being used during the Meeting was available to the public on the Counsel table in the Meeting Room, and that the procedures followed were in accordance with the Open Meetings Law. Chairperson Moore asked that guests sign the guest list.
