GENERAL INFORMATION REGARDING
STATE EDUCATION RULES AND REGULATIONS Statutory Authority:
The Administrative Procedures Act (Sections 84-901 to 84-920 of the Revised Statutes of Nebraska ) contains the main statutory provisions detailing how state agency rules and regulations are adopted. Under state law, the terms "rules" and "regulations" may be used interchangeably. The State Board of Education has the authority to adopt state rules and regulations for carrying out the State Board's constitutional responsibilities and those responsibilities assigned to the State Department of Education by the Legislature. State regulations that are properly adopted and filed with the Secretary of State have the effect of statutory law (See Nucor Steel v. Leuenberger , 233 Neb. 863 (1989).
Nebraska Administrative Code: All Nebraska state agency regulations are compiled in the Nebraska Administrative Code (NAC). Each agency is assigned certain titles of the Code for its rules and regulations. The Nebraska Department of Education uses Titles 92 and 93. The Nebraska Department of Education administration regulations are contained in Title 92 of the NAC, and each of the Department of Education's "rules" are actually "chapters" of Title 92 of the NAC. Thus, the formal legal citation to the Department's "Rule 1" is "Title 92

Draft ESEA Regulations
Allow Test Flexibility
Spring 2002
Draft regulations on state assessments issued by the U.S. Department of Education confirm that states will be allowed to use systems that include both state and local assessments to meet the requirements of the new Elementary and Secondary Education Act (ESEA; see Examiner, Winter 2001-02). The regulations also will allow states to use commercial norm-referenced tests, provided that additional questions are added to adequately assess student progress on state standards. Regulations implementing the accountability provisions in the law will be written later this spring.
The draft regulations presented to the rule-making committee largely repeat language from the law. They require every state system of academic assessments to:
Though the law requires that the assessments provide useful diagnostic information about individual students, a purpose often touted by ESEA proponents, that requirement is not specified in the regulations, indicating that the Department will not insist that state exams be diagnostically useful.

CURRICULUM AND INSTRUCTION
Health Education
Rule for elementary school and for middle school requires instruction in health education, though amounts and topics are not specified. Rule
Administrative Rule (2003), Regulations and Procedures for the Accreditation of Schools, outlines the required K-12 curriculum for Nebraska schools. While the state has not formally adopted standards for health education, Nebraska Health Education Frameworks (1998) is the recommended curriculum framework.
Students in Nebraska are not required to pass a statewide exam covering health education topics.
HIV, STD, and Pregnancy Prevention Education
The Nebraska State Board of Education does not require HIV, STD, or pregnancy prevention education to be taught in schools, explicitly stating that this is a matter of local control. The state does not require schools to follow a specific curriculum, if they choose to offer such instruction, nor does it place any limitations on what can be taught. However, officials do recommend that schools follow the standards outlined in the Nebraska Health Education Frameworks , the introduction to which emphasizes that the State Board of Education favors an abstinence approach. Nebraska does not require parent or guardian permission for such courses, nor does it have a policy that allows for parents to remove a student from specific portions of health education.
