I. MOLDOVA: GOVERNMENT FAILS IN BESSARABIAN CHURCH APPEAL. The European Court of Human Rights in Strasbourg has rejected the Moldovan government's attempt to appeal against last December's ruling that its refusal to register the Bessarabian Orthodox Church violated its commitments under the European Convention on Human Rights. A court official confirmed to Keston News Service from Strasbourg that on 27 March judges refused to allow the appeal to go forward to the Grand Chamber of the court. The government must now pay the Church compensation. The leader of the church welcomed the ruling, but was sceptical as to whether the government would in fact register the Church. II. MOLDOVA: CONCERN OVER "DISAPPEARED" CHURCH ACTIVIST. Friends and supporters of Vlad Cubreacov, a politician and active layman in the Bessarabian Orthodox Church, have expressed growing concern about his fate in the wake of his disappearance in the Moldovan capital Chisinau late on 21 March. "I know him as a friend and he is a person of transparent integrity," John Warwick Montgomery, a British-based lawyer who represented the Bessarabian Church in Strasbourg, told Keston News Service on 9 April. "His disappearance is terrible." Church leader Metropolitan Petru Paduraru told Keston he believed that Cubreacov had been abducted not just because of his anti-government political activity, but his religious activity also.

Felix Corley, Keston News Service, 10 April The European Court of Human Rights (ECHR) in Strasbourg has rejected the Moldovan government's attempt to appeal against last December's ruling that its refusal to register the Bessarabian Orthodox Church violated its commitments under the European Convention on Human Rights. Court official Cristina Sandru, who has been responsible for handling the case, confirmed to Keston News Service on 9 April from Strasbourg that on 27 March the five-member panel of judges refused to allow the appeal to go forward to the Grand Chamber of the court. "The judgment in the case of the Metropolitan Church of Bessarabia is now final," she declared. "The text of the [December] judgment remains the same." This decision means that the original verdict, handed down on 13 December, now enters into force. By refusing to register the Church, the court ruled, the state was effectively denying it the right to operate legally (see KNS 14 December 2001), Under the ruling, the government must now pay compensation to the Bessarabian Church of 27,025 Euros (24,400 US dollars or 16,800 British pounds) "for pecuniary and non-pecuniary damage and for legal costs and expenses". Interest is chargeable on the compensation - calculated at French interest rates - if it is not paid within three months.

Felix Corley, Keston News Service, 14 December John Warwick Montgomery, a British-based lawyer who represented the Bessarabian Church at the court, also welcomed the ruling. "The ECHR judgment entirely vindicated the Bessarabian Orthodox Church's position, as we knew it would," he told Keston on 13 December, immediately after the judgment was handed down. "The Moldovan government had - and has - no business deciding what is a proper church and what is not. That is for the religious believers to determine, not the state." Officials in Chisinau were reluctant to comment, claiming they had not yet received the text of the ruling (although the full text was posted on the ECHR's website at the time it was released). "We have no comment as we haven't seen the official text of the judgment," Valeriu Turia, chief spokesman of the Foreign Ministry, told Keston from Chisinau on 14 December. "I just spoke to the head of the Council of Europe department of our ministry and he does not yet have the text." He declined Keston's offer to email the text of the judgment, saying the ministry's email system was not working at present. Likewise Armasu refused to comment in detail. "We will not give a comment until we have read the judgment, which we don't yet have."

    General Information
    The Republic of Moldova is slightly larger in area than Maryland, and has a population of 4.5 million. Moldova became independent in August 1991 following the breakup of the Soviet Union; it is located immediately to the east of Romania, and it is bordered only by Romania (to the west) and Ukraine (to the north, south, and east). There are twelve administrative regions (called 'judets') plus the municipality of Chisinau and the autonomous Transdneister territory (sometimes known as Transnistria); these are shown in Figure 1. The capital city, Chisinau, is located near the middle of the country and has a population of about 700,000. Moldova's currency, the leu, has an exchange rate, as of March 2004, of 12.12 leu per U.S. dollar. The GDP (based on purchasing power parity) is $11 billion, which ranks it 125th among 212 countries and territories. Figure 1: Administrative Divisions of Moldova
