Recommendations for Extended School Year Policies
Local school districts are required to consider the need for Extended School Year Services (ESY) for each student with a disability. ESY may be necessary to provide a particular student a free appropriate public education as required by P.L. 94-142. It is recommended that districts have ESY policies to avoid arbitrary decisions concerning the provision of an ESY for any student, and to assist district personnel in determining the appropriateness of ESY for any individual student. An extended school year policy is required to be in place if a district wants to receive exceptional pupil aid for the students served during the extended school year period. The policy should provide that ESY be addressed in Individualized Education Programs (IEPs) by the IEP team, in the same manner as are all other programming needs. ESY is not a supplemental or related service, but an integral part of the student's IEP. Therefore, documentation of the goals and objectives to be addressed during the extended school year session should be reflected in the student's annual IEP. Parental involvement is significant in planning for ESY programs, as it is in all other IEP decisions. As with all other programming needs, it is recommended that the need for ESY be documented via data gathered about the student's performance in relation to the IEP goals and objectives. Additionally, it is recommended that if there is insufficient data at the time of the initial IEP meeting to determine whether ESY is appropriate, the team specify a time frame and the methods that will be used to collect data to determine the appropriateness of ESY at a future IEP meeting.

Disciplining Students With Disabilities

A child runs, out-of-control, down the busy school hallway and punches another child who is quietly waiting in line outside her classroom. She starts to cry while the disruptive child continues down the hall, not responding to the teacher aide's commands to stop. Another adult says, "He's special ed, there's nothing that we can do. You can't send him to detention. I'll tell his teacher." The aide is frustrated and upset as she comforts the crying child. A child, who is labeled seriously emotionally disturbed, sets a trash can on fire. When brought to the principal's office the security specialist is told that it is a manifestation of the child's disability and the usual disciplinary procedures will not be followed. The security specialist leaves muttering, "Those kids get away with murder!" Both examples are serious, wrongful misunderstandings of the procedural safeguards of the Individuals with Disabilities Education Act. IDEA procedural safeguards were designed to assure that students with disabilities (receiving special education and related services) were not arbitrarily removed from their parent-approved program without consent and were guaranteed a free and appropriate public education (FAPE) within the least restrictive environment (LRE).

    School Nursing Services for Special Children

    Parents of children with special needs are often confronted with problems relating to the delivery of nursing services while their child is at school. On rare occasions, without the provision of such services, it is impossible for a student to attend school on a regular basis. This situation can be highly disruptive to family operations, as parents struggle to juggle the impossible burden of work obligations, while, at the same time, taking the time to personally provide the services for the child.
    The Garrett F. Court did not address how the 1997 Amendments to the IDEA impact on the issue of providing school nursing services for children with special needs (because the issue before the Court dealt with facts and law prior to the enactment of the revisions to the special education laws in 1997). In 1997, Congress amended the IDEA to clarify that public educational agencies (local school districts) are the payors of last resort whenever another public agency has a funding responsibility to an exceptional child.
    In one recent case, a federal Court of Appeals held that a school district does not need to provide a person to administer medications to a child on homebound instruction, and that the school district’s policy of requiring a parent to remain at home during in-home instruction does not violate the IDEA. See Daniel O. v. Missouri Board of Education, 32 IDELR 113 (8th Cir. 2000).

    Individuals with Disabilities Education Act (IDEA) is a federal education program to provide federal financial assistance to State and local education agencies to guarantee special education and related services to eligible children with disabilities, aged birth through 5. Under the legislation, states have the responsibility to provide a free, appropriate public education and must develop an Individualized Education Program for each child served. Parts of this law were formerly known as the Education for all Handicapped Children Act of 1975, as PL 94-142 and as the Education of the Handicapped Act (EHA) of 1986. Part B of the Individuals with Disabilities Education Act is the state and local grant program.
