"[Fellatio] is unnatural, detestable, and abominable." The Post-Revolution Period, 1776-1873 The 1798 Organic Law for the Mississippi Territory made no provision for criminal law. It included a criminal code that was silent both as to sodomy and common-law crimes. However, in a code adopted in 1802, Mississippi recognized common-law crimes, thus making sodomy a capital offense. This remained the only law dealing with sodomy until 1839 when Mississippi adopted a new criminal code that contained a sodomy law with a maximum penalty of 10 years. The law retained the common-law definition of sodomy. Period Analysis: For its first few years of existence, Mississippi allowed sodomy. After recognizing common-law crimes and thus making sodomy a capital offense, no specific sodomy statute was enacted until 1839. It used the common-law definition and lowered the maximum penalty to 10 years. The Victorian Morality Period, 1873-1948

"We cannot think upon the sordid facts contained in this record without being reminded of the savage horror practiced by the dwellers of ancient Sodom from which this crime was nominally derived." The Post-Revolution Period, 1776-1873 Alabama originally was part of the Mississippi Territory. The Organic Act of 1798 made no reference either to sodomy or common-law crimes. In 1802, the Mississippi Territory enacted a new code that recognized common-law crimes, thus making sodomy a capital offense. The Mississippi Territory was divided in 1807 and, in that year, the new Alabama Territory enacted its own code. This Code continued to recognize common-law crimes, but contained another provision stating that "all statutes of England and Great Britain" not contained in the original Mississippi Territory code were repealed. It is a mystery as to how laws that never were adopted could be repealed.

(States With Homicide Laws That Recognize Unborn Children as Victims Throughout the Period of Pre-natal Development) Arizona:
The "unborn child in the womb at any stage of its development" is fully covered by the state's murder and manslaughter statutes. For purposes of establishing the level of punishment, a victim who is "an unborn child shall be treated like a minor who is under twelve years of age." Senate Bill 1052, signed into law on April 25, 2005, amending the following sections of the Arizona Revised Statutes: 13-604, 13-604.01, 13-703, 13-1102, 13-1103, 13-1104, 13-1105, 13-4062, 31-412, 41-1604.11 and 41-1604.13. Idaho: Murder is defined as the killing of a "human embryo or fetus" under certain conditions. The law provides that manslaughter includes the unlawful killing of a human embryo or fetus without malice. The law provides that a person commits aggravated battery when, in committing battery upon the person of a pregnant female, that person causes great bodily harm, permanent disability or permanent disfigurement to an embryo or fetus. Idaho Sess. Law Chap. 330 (SB1344)(2002).
