The Sensibilities of Our Forefathers
The History of Sodomy Laws in the United States
By George Painter
Mississippi
"[Fellatio] is unnatural, detestable, and abominable." The Post-Revolution Period, 1776-1873 The 1798 Organic Law for the Mississippi Territory made no provision for criminal law. It included a criminal code that was silent both as to sodomy and common-law crimes. However, in a code adopted in 1802, Mississippi recognized common-law crimes, thus making sodomy a capital offense. This remained the only law dealing with sodomy until 1839 when Mississippi adopted a new criminal code that contained a sodomy law with a maximum penalty of 10 years. The law retained the common-law definition of sodomy. Period Analysis: For its first few years of existence, Mississippi allowed sodomy. After recognizing common-law crimes and thus making sodomy a capital offense, no specific sodomy statute was enacted until 1839. It used the common-law definition and lowered the maximum penalty to 10 years. The Victorian Morality Period, 1873-1948

§ 45-33-21. Legislative findings and declaration of purpose. The Legislature finds that the danger of recidivism posed by criminal sex offenders and the protection of the public from these offenders is of paramount concern and interest to government. The Legislature further finds that law enforcement agencies' efforts to protect their communities, conduct investigations, and quickly apprehend criminal sex offenders are impaired by the lack of information shared with the public, which lack of information may result in the failure of the criminal justice system to identify, investigate, apprehend, and prosecute criminal sex offenders.
The Legislature further finds that the system of registering criminal sex offenders is a proper exercise of the state's police power regulating present and ongoing conduct. Comprehensive registration and periodic address verification will provide law enforcement with additional information critical to preventing sexual victimization and to resolving promptly incidents involving sexual abuse and exploitation. It will allow law enforcement agencies to alert the public when necessary for the continued protection of the community.

For plantation owners in the Deep South, the loss of slavery was tolerable because sharecropping and Jim Crow ("Apartheid") for African Americans replaced it. After the Reconstruction Period (1865-1877), Klan activity and Black codes spread like wildfire. To the Klan way of thinking, keeping a foot squarely on the neck of Black folks was a sacred calling to maintain their way of life. Most other European White Americans in the region went along because they were fearful of the Klan, which often held or influenced positions of power. Another reason is somebody had the do the backbreaking work in sun-drenched cotton fields. Letting African Americans vote, live, work and learn where they please would surely upset the socioeconomic order.
After Medgar Evers The Evers family moved to Jackson and together set up the NAACP office. Their efforts helped get James Meredith admitted to the University of Mississippi in 1962. That simple feat opened the door for more civil rights advancement in the state. But an ensuing campus left two people dead, which in the minds of many racists lay squarely at the feet of Medgar Evers. Hatred, which had been fermenting towards him for his many civil rights activities, reached a boiling point. BACK TO TOP Page 1 Page 2 Robins Design

    Emancipation in the United States
Emancipation is not available in every state in the United States. Where it is available, emancipation is a legal process by which minors can attain legal adulthood before reaching the age at which they would normally be considered adults (this is called the "age of majority"). The rights granted to legally emancipated minors might include the ability to sign legally binding contracts, own property, and keep one's own earnings. However, each state has different laws governing emancipation and some states simply have no law or legal process concerning emancipation. In states where minors wishing to become legally emancipated will have to break new legal ground. This page is designed to give minors information on the laws and available legal processes regulating emancipation in their state. The information is based on available state legal statutes and in some cases also includes information obtained from various legal aid organizations in that state. Some states have different legal terms for emancipation and can also differ in their definition of the rights granted to an emancipated minor.
