Code Ann. §§ 41-29-501 to -537: It is generally a violation of Mississippi law to intercept and acquire the contents of wire, oral or other communications with a mechanical or electronic device. The law against interception of communications applies neither to a "subscriber" to a telephone who "intercepts a communication on a telephone to which he subscribes," nor to members of the subscriber's household. Miss. Code Ann. § 41-29-535, Wright v. Stanley , 700 So.2d 274 (Miss. 1997) (state law prohibition on wiretapping did not apply to former wife who intercepted communications on her own telephone). Violations can be punished as misdemeanors carrying the potential for imprisonment for up to one year and fines of up to $10,000. Miss. Code Ann. § 41-29-533. It is a felony, however, for anyone who is not a law-enforcement officer to disclose the contents of intercepted communications for any reason other than testifying under oath in a governmental or court proceeding, and the penalty for such disclosure can be up to five years imprisonment and up to $10,000 in fines. Miss. Code Ann. §§ 41-29-511, 529. Civil liability for an unlawful interception is expressly authorized for actual damages, $100 a day for each day of violation or $1,000 — whichever is greater — along with punitive damages, attorney fees and litigation costs. Miss. Code Ann. § 41-29-529. In addition, the law specifically provides that if a person is a party to a communication, or has obtained consent from any one of the parties, no civil liability can be imposed unless the interception was accompanied by a criminal or tortious intent. Miss. Code Ann. § 41-29-531. According to current legislation, the laws in place regarding the interception of wire and oral communications are set to be repealed on July 1, 2004. Miss. Code Ann. § 41-29-537.

CANON I
A Judge Should Uphold the Integrity and Independence of the Judiciary An independent and honorable judiciary is indispensable to justice in our society. A judge should participate in establishing, maintaining, and enforcing, and should himself observe, high standards of conduct so that the integrity and independence of the judiciary may be preserved. The provisions of this Code should be construed and applied to further that objective.
A Judge Should Avoid Impropriety and the Appearance of Impropriety in All His Activities A. A judge should respect and comply with the law and should conduct himself at all times in a manner that promotes public confidence in the integrity and impartiality of the judiciary.

FOR THE FIFTH CIRCUIT
On behalf of the Board of Governors of the Society of American Law Teachers (SALT) – the largest membership organization of law professors in the nation – we write to express our grave concerns regarding the nomination of Charles Pickering to the United States Court of Appeals for the Fifth Circuit. Since its founding thirty years ago, SALT has sought to make the legal profession more inclusive and responsive to under-served individuals and communities. These goals have particular meaning in the states of Texas, Louisiana and Mississippi, which comprise the Fifth Circuit. The Fifth Circuit also is home to the largest percentage of racial and ethnic minorities in any of the eleven circuits. For residents of these states who must turn to the courts to vindicate their rights, the Fifth Circuit is, as a practical matter, the court of last resort.

SUPREME COURT JURISDICTION
The Supreme Court consists of nine Justices. The Justice with the longest continuous tenure shall be the Chief Justice and the two Justices with the next longest tenure shall be Presiding Justices. The term of office for members of the Supreme Court is eight years. They are elected by the people concurrently with the regular election for representatives in Congress.
The Mississippi Constitution provides in Article VI, Sec. 146 that "The Supreme Court shall have such jurisdiction as properly belongs to a Court of Appeals." The Mississippi Constitution provides in Article VI, Sec. 145 B that there shall be nine Supreme Court Justices.
Rule 24 of the Mississippi Rules of Appellate Procedure (1995) provides that the Supreme Court sittings for the hearing of oral arguments will be held on any day when cases are set at the convenience of the Court, Sec. (A) of Rule 24 provides that ". . The Court sits in panels of three Justices. The Chief Justice shall preside over Panel A; The Senior Presiding Justice shall preside over Panel B; and the junior Presiding Justice shall preside over Panel C."
Section 11-51-1 of the Miss. Code of '72 Annotated provides: ". . . all cases, civil and criminal, at law and in chancery, shall be taken to the Supreme Court by appeal as herein provided, and shall be dealt with by said court without regard to the manner of removing the cases to such court."
