General Example of a State's "Lemon Law" Information The following is intended to give you a general example of a State "Lemon Law."
It is Section 1793.22 of California's Civil Code that makes up California's Lemon Law.
REMEMBER, Lemon Laws and their application vary from state to state. California's Lemon Law - California Civil Code Section 1793.22 California's consumer warranty law requires the manufacturer of a new motor vehicle leased or sold with a manufacturer's written warranty to repair the vehicle during the warranty period so that it conforms to the warranty within the first 18 months of purchase or 18,000 miles, whichever occurs first. The vehicle may be a new car, van, truck or the chassis portion of a motorhome, but it must have been purchased or leased for nonbusiness use. If the manufacturer or dealer cannot fix the vehicle to conform to the warranty within a "reasonable" number of repair attempts, then the manufacturer must replace the vehicle or reimburse the buyer or lessee for its purchase price, whichever the consumer prefers (less a mileage offset for the consumer's use of the vehicle prior to the first repair attempt), subject in certain cases to arbitration that the consumer may or may not accept. The Lemon Law uses a presumption as a guideline for determining whether a "reasonable" number of repair attempts have been made on a new vehicle. In order for the buyer or lessee to use the Lemon Law presumption, all of the following must be true:

  • (a) Authentication.
    (a) Authentication.
      (1) Domestic. An official record kept within the United States or any state, district, commonwealth, territory, or insular possession thereof, or within the Panama Canal Zone, the Trust Territory of the Pacific Islands, or the Ryukyu Islands, or an entry therein, when admissible for any purpose, may be evidenced by an official publication thereof or by a copy attested by a person purporting to be the officer having the legal custody of the record, or his deputy. If the official record is kept outside the State of Mississippi, the copy shall be accompanied by a certificate under oath of such person that he is the legal custodian of such record and that the record is kept pursuant to state law.
    (b) Lack of Record.   • (a) Jurisdiction Unaffected.

(a) Jurisdiction Unaffected. These rules shall not be construed to extend or limit the jurisdiction of the courts of Mississippi.
(b) Venue of Actions. Except as provided by this rule, venue of all actions shall be as provided by statute.
(c) Venue Where Claim or Parties Joined. Where several claims or parties have been joined, the suit may be brought in any county in which any one of the claims could properly have been brought. Whenever an action has been commenced in a proper county, additional claims and parties may be joined, pursuant to Rules 13 and , as ancillary thereto, without regard to whether that county would be a proper venue for an independent action on such claims or against such parties.
(d) Improper Venue. When an action is filed laying venue in the wrong county, the action shall not be dismissed, but the court, on timely motion, shall transfer the action to the court in which it might properly have been filed and the case shall proceed as though originally filed therein. The expenses of the transfer shall be borne by the plaintiff. The plaintiff shall have the right to select the court to which the action shall be transferred in the event the action might properly have been filed in more than one court. Comment

Back to top. DISTINCTION BETWEEN CIVIL AND CRIMINAL CASES The distinction between civil and criminal cases is an important one. In a civil case, a trial or contested matter occurs between two or more persons, while in a criminal case, the trial is between the State of Mississippi and a person accused of committing a crime. This is true even when a criminal case is begun by the victim of a crime filing an affidavit charging someone with criminal activity. There are times when the wrong which has been done might give rise to either a civil suit or criminal charge or both. But the justice court judge must keep in mind the distinction, for it is improper for criminal process to be used to collect a civil debt or damages. Every justice court judge should be familiar with the case of State Ex Rel. Richardson v. Edgeworth, 214 So.2d 579 (Miss. 1968). In this case, our state Supreme Court held that justice court judges who permitted people to sign criminal affidavits for collection of debts without advising them of the criminal nature of the documents; who permitted criminal affidavits to be signed in blank without requiring affiants to appear to make their sworn statements; who solicited collection of accounts through their deputy sheriffs and constables; and who used criminal processes for collection of civil debts; were guilty of intentional abuse of process and would be liable for damages caused by their actions.
