INTRODUCTION "Nothing is more harmful to the service than the neglect of discipline; for that discipline, more than numbers, gives one army superiority over another." (1) As commander of the Continental Army, George Washington recognized that no military unit could function without an effective means of preserving discipline. These words uttered in 1759 ring no less true today. Commanders must have the ability to ensure that service members perform their duties and follow orders, even in situations involving life and death. The American military justice system, formulated over centuries of experience, meets this need.

3 August 2005 APCML Deputy Director LTCOL Geoff Cameron was honoured to host the visit by the US Army's Judge Advocate General, Major General T. J. Romig to the APCML and Military Law Centre (MLC) at Randwick Barracks on 3 August. MAJGEN Romig was visiting Australia to conduct meetings with senior Defence personnel with a view to promoting the continuation of the Centre for Lessons and Military Operations (CLAMO) officer exchange program between the US and Australia. Accompanied by Colonel John Ley JR (US Judge Advocate) and the Director General ADF Legal Services (Air Commodore Simon Harvey), MAJGEN Romig was briefed on the activities of the APCML and the work undertaken by the inaugural US Exchange Officer from CLAMO, Major Mike Roberts, who was located at the MLC from mid 2003 to mid 2005.

military law: an overview
The Constitution grants to Congress the power to raise and support armies and a navy, to suppress insurrections, and repel invasion among other military-related governmental roles. Thus, the main source of legal authority in this area is federal law. Congress's control over formation, organization and governmnet of the national armies is plenary and exclusive. Military law consists of the Uniform Code of Military Justice and other statutory provisions for the government of persons in the Armed Forces to which may be added the unwritten common law of the usage and custom of military service as well as regulations and authorized by the President as Commander in Chief of the Armed Forces ( See 10 U.S.C.S. § 121). It is a part of our body of law as a whole, and is fully recognized by civil courts; it is in force in time of peace as well as in time of war. All persons serving in the Armed Forces of the United States are subject to military law at all times.

What we are starting to see is 50 years of legal refinement and revisions for oversight being quietly jettisoned.
Steven Aftergood, an intelligence policy specialist at the Federation of American Scientists The Army, while not disputing that the visit took place, declined to comment, saying the incident is under investigation. Last year, the Office of Naval Intelligence, the nation's primary source of global maritime intelligence, demanded access to the U.S. Customs Service's database on maritime trade, saying it needed information to thwart potential terrorist activity. Customs officials initially resisted the Navy's demands but eventually agreed to give naval intelligence much of what it wanted. In another sign of military interest in domestic information-gathering, the Defense Intelligence Agency's new antiterrorism task force is looking to share information with law-enforcement officials in California and New York City, according to an August 2003 General Accounting Office report.

    A U.S. citizen who is a resident or citizen of a foreign country may be subject to compulsory military service in that country. Although the United States opposes service by U.S. citizens in foreign armed forces, there is little that we can do to prevent it since each sovereign country has the right to make its own laws on military service and apply them as it sees fit to its citizens and residents. Such participation by citizens of our country in the internal affairs of foreign countries can cause problems in the conduct of our foreign relations and may involve U.S. citizens in hostilities against countries with which we are at peace. For this reason, U.S. citizens facing the possibility of foreign military service should do what is legally possible to avoid such service. Federal statutes long in force prohibit certain aspects of foreign military service originating within the United States. The current laws are set forth in Section 958-960 of Title 18 of the United States Code. In

Sadiq Zoman Abrahim, 55 years old, lies in a coma in Tikrit hospital.
7 January 2003 Sadiq Zoman Abrahim, 55 years old, was detained this past August in Kirkuk by US Soldiers during a home raid which produced no weapons. He was taken to the police office in Kirkuk, questioned by the Americans there, then transferred to Kirkuk Airport Detention Center.
It was from this detention center he was transferred to Tikrit Airport Detention Center. While in this detention center Mr. Abrahim managed to find a man who was about to be released, and have him pass on to his family information about where he was.

Mexican mercenaries expand base into U.S.

A renegade band of Mexican military deserters, offering $50,000 bounties for the assassination of U.S. law-enforcement officers, has expanded its base of operations into the United States to protect loads of cocaine and marijuana being brought into America by Mexican smugglers, authorities said.
The deserters, known as the "Zetas," trained in the United States as an elite force of anti-drug commandos, but have since signed on as mercenaries for Mexican narcotics traffickers and have recruited an army of followers, many of whom are believed to be operating in Texas, Arizona, California and Florida.
Authorities said the Zetas control the city despite efforts by Mexican President Vicente Fox to restore order. He sent hundreds of Mexican troops and federal agents to the city in March to set up highway checkpoints and conduct raids on suspected Zeta locations.
Authorities said the Zetas operate over a wide area of the U.S.-Mexico border and are suspected in at least three drug-related slayings in the Dallas area. They said as many as 10 Zeta members are operating inside Texas as Gulf Cartel assassins, seeking to protect nearly $10 million in daily drug transactions.
