Post reporter Bradley Graham, who was recently given a tour of Northcom headquarters at Peterson Air Force Base. The article thus appears to be a deliberate leak conducted for the purpose of accustoming the American population to the prospect of military rule. The Post The Post The Post While Northcom was established only in October 2002, its headquarters staff of 640 is already larger than that of the Southern Command, which overseas US military operations throughout Latin America and the Caribbean. About 1,400 National Guard troops have been formed into a dozen regional response units, while smaller quick-reaction forces have been set up in each of the 50 states. Northcom also has the power to mobilize four active-duty Army battalions, as well as Navy and Coast Guard ships and air defense fighter jets.

It is inspired by the desire to diminish the evils of war by: a. Protecting both combatants and non-combatants from unnecessary suffering; b. Safeguarding certain fundamental human rights of persons who fall into the hands of the enemy, particularly prisoners of war, the wounded and sick, and civilians; and c. Facilitating the restoration of peace.... Basic Principles a. Prohibitory Effect. The law of war places limits on the exercise of a belligerent's power in the interests mentioned in paragraph 2 and requires that belligerents refrain from employing any kind or degree of violence which is not actually necessary for military purposes and that they conduct hostilities with regard for the principles of humanity and chivalry. The prohibitory effect of the law of war is not minimized by "military necessity" which has been defined as that principle which justifies those measures not forbidden by international law which are indispensable for securing the complete submission of the enemy as soon as possible. Military necessity has been generally rejected as a defense for acts forbidden by the customary and conventional laws of war inasmuch as the latter have been developed and framed with consideration for the concept of military necessity.

Badger, Associated Press , 24 November 2001 SAN ANTONIO America's military is largely prohibited from acting as a domestic police force, but with the increased fears of terrorism, some experts say it's time to rethink those restrictions. "Our way of life has forever changed," wrote Sen. John Warner, R-Va., in a letter last month to Defense Secretary Donald Rumsfeld. "Should this law now be changed to enable our active-duty military to more fully join other domestic assets in this war against terrorism?" The law, known as the Posse Comitatus Act , was championed by Southern lawmakers in 1878 who were angry about the widespread use of the Army in post-Civil War law enforcement. It currently bans the Army, Navy, Air Force and Marines from participating in arrests, searches, seizure of evidence and other police-type activity on U.S. soil. The Coast Guard and National Guard troops under the control of state governors are excluded from the act. Deputy Defense Secretary Paul Wolfowitz, testifying in October before the Senate Armed Services Committee, agreed that it might be desirable to give federal troops more of a role in domestic policing to prevent terrorism.

Important The U.S. Army's Field Manual 27-10, The Law of Land Warfare , is one of the major resources used for educating U.S. military personnel on the law of war. It contains numerous pertinent direct quotations from the various Geneva and Hague Conventions, as well as several official interpretations of these conventions. I obtained the official online version of FM 27-10 and have posted it here with some minor revisions. The only revisions I've made are as follows: 1. I changed the font to make it easier to read. 2. I added color as background to the title. 3. I amended the note beneath the title to be more understandable. 4. I deleted a lengthy document before the foreword which required certain amendments to the 1956 version, doing so because I deemed it unnecessary since the revisions are contained in the manual itself and are specifically indicated. 5. I deleted a brief "authorization" note at the end as being superfluous. 6. I corrected several obvious spelling and/or typographical errors. 7. I corrected innumerable intra-document links which would not work in order to, with hope, make them work properly.

The classified plans, developed here at Northern Command headquarters, outline a variety of possible roles for quick-reaction forces estimated at as many as 3,000 ground troops per attack, a number that could easily grow depending on the extent of the damage and the abilities of civilian response teams. The possible scenarios range from "low end," relatively modest crowd-control missions to "high-end," full-scale disaster management after catastrophic attacks such as the release of a deadly biological agent or the explosion of a radiological device, several officers said. The strategy is outlined in a 40-page document, approved last month, that marks the Pentagon's first attempt since the attacks of Sept. 11, 2001, to present a comprehensive plan for defending the U.S. homeland. The document argues that a more "active, layered" defense is needed and says that U.S. forces must be ready to deal not just with a single terrorist strike but also with "multiple, simultaneous" attacks involving mass casualties. The document does not ask for new legal authority to use military forces on U.S. soil, but it raises the likelihood that U.S. combat troops will take action in the event that civilian and National Guard forces are overwhelmed. At the same time, the document stresses that primary responsibility for domestic security continues to rest with civilian agencies.
