Education programs for disabled students under attack in Michigan
By Debra Watson 9 May 2001 Use this version to print Send this link by email Last month students, teachers and parents rallied on the steps of the state capitol building in Lansing, Michigan to oppose plans by the state's Department of Education to reform the Michigan Special Education Code. The proposed reforms would slash education and therapy provided by public school districts to tens of thousands of Michigan children with disabilities. The reforms, which could go into effect some time in the next school year, will force families to pay a greater share of the cost of essential and often expensive services. Parents who cannot pay will see their children go without. The Joint Committee on Administrative Rules, a special committee appointed by state officials, developed the changes, claiming they were required to bring Michigan law in line with federal regulations. When the current Michigan rules for special education were first established in the early 1970s there was no nationwide requirement for even the most basic education for physically, cognitively or emotionally impaired children. In 1975 the federal government mandated minimal standards and partial federal funding for some services in public schools. When the US Congress authorized the Individuals with Disabilities Education Act (IDEA) in 1990, the earlier federal standards were incorporated into the new act.

What regulations determine the class size of special education classrooms? What is the ratio of special education students to teachers? The teacher-pupil ratio in special education is determined by each state. Some states have statewide policies on class size; some states have no policy; and a few states let the local education agency (LEA) determine class size. Staffing ratios are usually based on the disability category and educational placement of the student, with classes for children with severe disabilities usually having fewer students. Some states are reexamining their policies to better support students in inclusive settings. As they revise their policies on the teacher-student ratio, they are looking at the intensity of services needed and the amount of time required for the specially designed instruction. A Guide to Selected Michigan Standards, Laws, Regulations, and Policies For Teachers Introduction As you may already know, our United States Constitution makes no reference to the education of its citizens, young or old. Accordingly, the responsibility for the establishment and regulation of schooling in America falls upon the Legislature in each individual state. In Michigan, our state constitution mandates that “schools and the means of education shall forever be encouraged.” (M.C.L. 8.1) Our resulting system of public schools (including public charter schools) is regulated by a series of important laws enacted over the years by the Michigan Legislature and known today as the Revised School Code (RSC). The Revised School Code establishes the fundamental structure for public schooling in our state. It also has created a State Board of Education, which is empowered by the Legislature to “provide leadership and general supervision over all public education…” In doing so, the State Board establishes specific regulations and rules for our public schools, consistent with state law. Today, many of the procedures followed by Michigan public schools have been established in order to comply with State Board of Education regulations and rules.

The Master of Arts in Education requires a minimum of 33 hours of coursework at the graduate level. The Early Childhood endorsement requires 21 graduate credit hours. All graduate level courses are numbered 500 and above and are open only to graduate students except by special permission. Students must be formerly admitted to the specialization program for which they have completed the degree requirements to be recommended for graduation. Michigan
Under Michigan law, the Superintendent of Public instruction has supervisory power over all private, denominational and parochial schools, i.e. schools other than public schools giving instruction to children below the age of 16 years, in the first 8 grades. The sanitary conditions, the courses of study, and the qualifications of the teachers are intended to meet the same standards provided under the general school laws of the state. Mich. Com. Laws Registration/Licensing/Accreditation: Length of School Year/Day: Instruction in English: Discrimination: Teacher Certification: Under Michigan law, teachers in the regular or elementary grade studies in a private, denominational or parochial school, i.e. People v. DeJonge , 442 Mich. 266 (Mich. 1993). Persons without valid teaching certificates who have the requisite college credit may apply to the Michigan Department of Education for a teaching permit for employment in a nonpublic school under Mich. Admin. Code r. 390.1142 (full-year permit); 390.1143 (substitute permit); and 390.1144 (emergency permit). The State of Michigan does not have a generic "business license." Several "occupations" and "types" of businesses are required to be licensed by the state. Michigan has several hundred licensed occupations and services ranging from doctor to manicurist to wildlife exhibitor to consulting. These occupations and the "types" of businesses connected with these occupations often require specific regulations as well as legal, education, and examination requirements. In several cases, there are also licensing fees that are required for a specific occupation or profession. Depending on the specific type of business or manufacturing operation, some type of certification, license or permit may be required. To access the Michigan licensed occupations search our online database of required licenses . Check with the city and county clerk ( See Appendix A ) to determine if any local licenses or registrations are required and to obtain the necessary forms.

WASHINGTON - Today, a diverse network of school districts, the National Education Association (NEA) and several state education associations filed the first-ever national lawsuit to force the Bush Administration to pay the costs of its own rules and regulations under the No Child Left Behind law.
"Today we're standing up for children, whose parents are saying, 'No more' to costly federal regulations that drain money from classrooms and spend it on paperwork, bureaucracy and big testing companies," said NEA President Reg Weaver. "The principle of the law is simple; if you regulate, you have to pay." The plaintiffs represent several school districts in Vermont, Texas and Michigan as well as the nation's largest teacher's organization. These groups say they are filing the suit because the Administration has not heeded its own demands of accountability which states: "Nothing in this Act shall be construed to authorize an officer or employee of the Federal Government to mandate, direct, or control a State, local education agency, or school's curriculum, program of instruction, or allocation of State or local resources, or mandate a State or any subdivision thereof to spend any funds or incur any costs not paid for under this Act."

The Individuals with Disabilities Education Improvement Act (IDEA 2004), 20 U.S.C.  1400 et seq., provides federal funds to assist state and local agencies in educating disabled children. IDEA 2004 conditions the receipt of such funds upon a state's compliance with certain goals and procedures. State legislatures and departments of education have enacted statutes and promulgated regulations respectively to ensure compliance with IDEA 2004 requirements. IDEA 2004 and its implementing regulations require schools to conduct functional behavioral assessments (FBAs) but provide little to no guideance on what an FBA is or how to conduct one. Ms. Morgan is also an Ashbrook scholar at Ashland University. Introduction Schools around the United States are now faced with education a growing number of children who lack basic English skills. According to the National Clearinghouse for Bilingual Education , there are 2,437,723 Limited English Proficiency students in the U.S.1 Only a few years ago, many schools had never dealt with a language minority child. Today, an increasing number do. The challenge of providing a quality education to all students is doubled when schools must also teach a child an entire new language as well as academic courses. Over the last 30 years, elected officials, education agencies, and the courts have established guidelines for the education of these students. Federal requirements allow states a wide deal of latitude in selecting the most effective programs for their limited-English-proficient (LEP) students. Many states have enacted their own laws governing the management and style of programs for LEPs. These laws have been developed in cooperation with, or under coercion from, federal agencies and/or activist organizations. The result has been a patchwork of laws and regulations that can vary greatly from state to state.

State law requires full completion of sessions (6 hour credit). If your attendance is interrupted, the course will automatically be "bookmarked" to continue your next session until completed in full.
Registration Periods
Student may register and attend the course at anytime, however, if attendance takes place after the official license expiration (December 31st of the current year) then other rules may apply to activate the license.
